RESOLUTION RE: GRANT OF MOBILE HOME REQUEST TO EAGLES NEST GUN CLUB FOR A PRINCIPAL DWELLING IN AN AGRICULTURAL ZONE DISTRICT ON A PARCEL OF LAND DESCRIBED AS PT. E2 SECTION 18, T4N, R62W of the 6th P.M. WELD COUNTY, COLORADO. WHEREAS, the Board of County Commissioners of Weld County, Colorado , pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Eagles Nest Gun Club has applied to the Board of County Commissioners of Weld County, Colorado for a permit to place a mobile home on the following described real estate , as a prin- cipal dwelling, and which is to be occupied in an A-Agricultural Zone District, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 12thday of June, 1978, considered the request of Eagles Nest Gun Club for a mobile home as a principal dwelling on a parcel of land more particularly described as follows : Pt. E1/4 Section 18, T4N, R62W of the 6th P.M. , Weld County, Colorado. WHEREAS, The Board of County Commissioners , having heard the applicant, finds that said request should be granted. Those twelve individuals intend to utilize the approximately 209 acres as a game refuse and hunting reserve. I A new 16' x 60' mobile home will be located on the property approximately I4,300 feet from the nearest dwelling. The mobile home contains one bedroom, a bathroom, and a kitchen facility, plus general living quarters. Parking for the twelve general partners and their guests will be in and around the clubhouse facility. Potentially near this same location will also be spaces provided for the quartering of 3 or 4 hunting dogs while they are not being utilized for hunting. Dogs will not be raised or breed at the site, however, Igame fowl will be raised on the site and released permanently, such as quail , pheasant, etc. Chicks will be purchased contained until they are old enough to be released. Feeders for all fowl will be spotted throughout the 209 acres to encourage fowl habitation. In the operation of the Gun Club horses may be used or maintained. From time to time, a portable clay skeet gun may be utilize by the members and their guests, throughout the acreage. It is the intent that this conditional use permit cover all of the above described activities. The area in quest1Oa lays in the bottom lands of the South Platte River which has excellent potential for wildlife habitat.. Hu building activitie , as out- lined in the application, are located out of the flood plain and are on the soil type Valenti. sand, 3 to 9 percent slopes. The activities as outlined in the application are consistent with the limitation of that soil . No erosion control plan was snibmi_tted as part of the application for review. A plan should he prepared which will allow for revegetation of disturbed r rea areas, particularly in the club house area as that oil type is extremely e1 e to wind erosion without proper soil cover. Excluding previous comments, we believe the application should receive favorable consideration. The location proposed for the trailer home will apparently be protected from floods by the Bijou Canal. One possible constraint which was not addressed in the application was the potential for high ground water table and its affect on the sewage disposal system. We believe that if this problem is properly considered before final planning and construction that there is no geologic reason why this application should not be approved. We do not see the necessity for another road approach onto State Highway 34 for the five activities described under "Operations" in the review materials. D. Farr and George Allard , who are in receipt of a Notice that the Planning Commission will review a request from Eagle ' s Nest Gun Club for a conditional use permit for a gun club and game reserve on 'Sections 17 and 18-4-62 . Allard Cattle Company' s ranch adjoins the subject property. I have been instructed to advise that basically Allard Cattle Company has no objection to the granting of the permit , subject to appropriate limitations insuring that in the process of hunting on the land in question, adequate safeguards will be imposed and enforced assuring that neither livestock or persons on Allard Cattle Company lands will be placed in any physical danger by the activities conducted on the land for which the permit is granted. I am sure everyone recognizes that shotguns are not aware of nor have any respect for, property lines , particularly if game is shot while flying over property other than that belonging to the gun club. It is our assumption that if and when the permit is granted appropriate safeguards will be incorporated in the permit together with a condition that strict liability attaches to any injuries or deaths occurring to livestock or individuals who are occupying adjacent properties .
