RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY
SPECIAL REVIEW PERMIT#1733 - SUSAN MAESTAS AND SHARON ARANDA
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on April 21, 2010, the Board approved the application of Susan Maestas
and Sharon Aranda, 15169 Lamb Avenue, Fort Lupton, Colorado 80621, for a Site Specific
Development Plan and Use by Special Review Permit#1733 for a Kennel (up to 40 dogs) and
an Animal Grooming Shop (dogs and cats) in the A (Agricultural) Zone District, on the following
described real estate, being more particularly described as follows:
Lot 4, Block 43, Aristocrat Ranchettes Subdivision,
Second Filing; located in part of the SW1/4 of
Section 27, Township 2 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, the Department of Planning Services notified the applicants of outstanding
Conditions of Approval and items to be completed prior to recording the plat, by letters dated
August 5, September 26, and December 15, 2011, and
WHEREAS, on the 16th day of January, 2012, an Initial Hearing was held before the
Board to consider granting additional time to meet all of the conditions/requirements of approval
and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special
Review Permit #1733 and Deny the application, and
WHEREAS, at said hearing, Susan Maestas was present, and
WHEREAS, after hearing all testimony presented, the Board deemed it advisable to
refer the matter back to staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the applicant has demonstrated a willingness and ability to complete the
process and record the plat and the matter be, and hereby is, referred back to staff.

Ok I was under the understanding that the mylar plat map was due when the changes were made
These changes have caused huge financial issues for me I am smaller than small business. With the bad economy
no one is bathing and grooming their dogs this can't be a surprised to you.
I have been working on things as I can the building permit had one year on it so I thought that's what I
had. And I have been working on things I have had 2 bids on the septic and I now have the electrical
done and had a inspection but the guy was alittle lost as to what he is looking at and is suppose to get back with
me. I have to leave town as my father inlaw has past away I will be back and will get in touch with you this next week.

Dear Applicant:
The Planning Department is working through our historical case files in an effort to resolve unrecorded
and outstanding land use permits. You are receiving this letter because you have applied for a Use by
Special Review (USR) permit with Weld County but have never followed through the steps to complete
the process. You should have received two other letters from me in August, 2011 and September, 2011
concerning the same topic.
On April 21, 2010, your application for an Use by Special Review was approved by the Weld County
Board of County Commissioners with specific Conditions of Approval. At this time the conditions of
approval have not been satisfied and a Mylar Plat has not been recorded with Weld County Clerk and
Recorder.
One of the required Conditions of Approval in the Board of County Commissioners resolution grants the
applicants sixty (60) days to submit a Mylar Plat, and provide written evidence that all conditions outlined
in the resolution have been completed. Should you choose not to complete the Use by Special Review
process and provide the required Mylar Plat, the Department of Planning Services requests written
notification of your decision to withdraw the application and that the use is not active on the property.
If you are unable to meet the Conditions of Approval and record the plat by January 16, 2012 an initial
hearing is scheduled with the Board of County Commissioners. The hearing will take place at the Weld
County Administration Building, located at 1150 O Street, at 9:00 am on January 16, 2012. It is strongly
encouraged that you attend this hearing. At this hearing the Board of County Commissioners has the
authority to grant additional time to meet all the conditions/requirements of approval and record the plat or
schedule a final determination hearing to rescind approval of Use by Special Review, USR-1733 and
deny the application.
If you chose to withdraw the application please sign and date the enclosed form and return to the Weld
County Department of Planning Services, Attn: Chris Gathman, 1555 N 17th Ave., Greeley, CO 80631.

Good Morning Chris
Just an update I just yesterday finally got the information from the other engineer about
the spetic system I got verbal but I knew that Lauren won;t get anything til I did so she
should have recieved the report either yesterday or today.
I need to call and see now if i need a permit to do the plumbing that is needed
I have gotten alittle confused again so I will call them and get it straight
the engineer sen tme a whooper of a bill and whoa I faxed everything and i think Luren had
given him the other information that he needed and the bill is just crazy high. OH well it
just puts me back getting the next permit I was shocked and dishearrted but oh well one day
I will have this all behind me and have everybody blessing to keep helping these little guys
be beautiful
have a great day and weekend i will stay in touch I will call either today and Monday to the
biulding dept and have another talk with them to get things straight I am also waiting for a
call from a Electrical engineer about the work that has already been done and see how he
might help me with the bldg put as well I have 1 wall still Aally open so the wires can
be seen and have him put together plans

I have 1 engineer working on floor plans that they said I would need to get building permit
I have another engineer working on the spetic issues he has been in contact with Laruen Light
and should have something for me soon
The dumpster is scheduled for the 15th to get enclosed.
thats where I am at this point PLEASE PLEASE if I am over looking something PLEASE remind me
as I am running full tilt and am still having trouble keeping things focused.
I know it's not your job to babysit me but with my issues I need a little help to get
through this

Waste removal and chemical uses at 15169 Lamb Street
Grooming shop:
Grooming shop waste materials are dog and cat hair and the normal empty shampoo containers and
other trash.
Hair is kept in a large trash drum and cleaned up with a shop vac and/or a broom throughout th day.
This waste is disposed of 3 times a week as needed in large trash bags into on site dumpster.
Cleaning materials used in the grooming shop are Pine sol,Mr.Clean and Clorox are the main d ansers,
and we at times use Windex and a lavender disinfectant.

Fecal matter is picked up once to twice a day and this is put in a bucket with lid lined with a plastic
grocery bag in it so we can tie it up and throw out as often as needed. This is also put in the ons to
dumpster.The large yard at the house is picked up weekly and disposed of in the same manner.
Cleaning supplies are Clorox. We wash down pads daily and mist gravel often with a Clorox and ater
mix to keep smell down. We use newspapers for any puppies we might have and this is picked p and
put in the same large trash bag and put in dumpster.
For inside crates we use bleach water or a lavender disinfectant as well as Mr.clean.

Oust abatement Plan for property located at 15169 Lamb Ave
The property is landscaped in such a way that it leaves little chance of much dusk We do have wa er
taps along the driveway and parking area. Anytime dust is an issue we can water the area down. mb
Ave is a dirr road.I have a water tap that will make it possible to water down the road should du t
become as issue in front of the house.

This is a letter to request additional time to finalize my conditions.
I have been busy getting the gravel in, finishing some concrete with the grade I need for
drainage.
I have bids to get the trash dumpster enclosed. Thoses bids range from $800 to a $1000 just
to enclose the dumpster.
I have had a water line break that shut my buisness down for 2 days.
I am dealing with some personal health issues that have over come me this summer due to the
stress, not just from these county issues
but the day to day struggles it takes to try to run a small business in this hard economy.
Times are hard and my business is pretty seasonal,
not to mention not a mandatory expense for most family budgets. I will need to come up with
money for permit, fees, septic and I have been told that the change of use permit can be as
much
as $1200. This is big big money for a tiny buisness. I want to get this all done, this is my
lively hood and my passion. I need to get a better handle on what needs to be done and set up
a time frame
so I don't feel so over whelmed and that is why I am requesting more time. I have found some
one to help me keep these things rolling so that will help, if I can just get an exetion on
my time.

Dear Sue,
I wanted to let you know that I was directed by my supervisor to send out letters on all
cases (not just yours) that were past the timeframe to finalize conditions and record plats.
A 60-day timeframe to finalize conditions and submit the plat for recording is a standard
provision for Use by Special Review plats and was included in your Use by Special Review
permit resolution approved by the Board of County Commissioners. I have attached another copy
of the resolution of approval from the Board of County Commissioners.
I tried to give you and other applicants reasonable period of time (30 days) to finalize your
remaining conditions. I understand (as you stated below) that you have some mitigating
circumstances that may require some additional time on finalizing your USR. You have the
option of writing a letter (or sending an e-mail) to our Department requesting additional
time to finalize your conditions of approval along with justifications as to why additional
time is needed (similar to what you presented below). We can then schedule a 9 AM meeting
before the Board of County Commissioners where you can present your request.
I have attached another copy of the Board of County Commissioners resolution. The conditions
of approval are listed on pages 3-5 in the resolution. The major conditions are conditions C
and D and H - pertaining to the septic system and the Building Permit. The other conditions
are relatively simple and involve providing letters or documentation. The Dust Abatement Plan
and Waste Handling plan would be reviewed by Lauren Light with Environmental Health -11ight@co.weld.co.us or (970)304-6410 ext. 2211.

I was not aware or had mis understood I thought I had time to get things done and a little
time to get money together
I was told I would need to fence in my trash dumpster and I have a $1000 bid to do that I am

I understand that it is not the ountries concern how the businesTcomes up with the the
money they require but this is my lively hood and in these times grooming your dogs has not
been on the top of everyone list but I am working on things I am getting the little things
done like bring in more gravel for my pens that aren't concrete for drainage which is another

I would of loved a heads up and more help from your department. I just know Ben Hansford told
me what a great help your dept was and maybe it's my fault but
I feel real blind sided here. can you please tell me what I have not done.
