It is the opinion of the Planning Commission that this proposed operation is in compliance with the provisions of Section 3 . 3 .E. 2 . of the Weld County Zoning Resoltuion . The proposed use will be compatible with the surrounding area, in harmony with the character of the future development in the area and will not adversely affect the health, safety and welfare of the inhabitants of the area and the county . This determination is based upon the following : A. The dairy operation and management practices as outlined and controlled in the Development Standards will make this operation compatible with the surrounding area by minimizing any potential adverse impacts . B. The request is to establish an agricultural enterprise in the Agricultural Zone District with existing land uses being predominantly agricultural . C. The following referral entities have reviewed this request and have set forth no objections to it : 1. The Weld County Engineering Department 2 . The Town of Milliken Board of Trustees 3. The Johnstown Fire Protection District 4 . The Colorado Geological Survey provided sub- surface conditions in excavations are evaluated by qualified personnel to assure proper foundation design for all new structures if adverse soil conditions are present 5 . The West Greeley Soil Conservation District 6 . The Weld County Extension Service 7. The Weld County Health Department provided the applicant complies with the Health Department ' s comments in its letter dated April 11, 1979 . The Health Department ' s comments are incorporated in the attached Development Standards . The Planning Commission recommendation for approval is conditional upon the following: 1 . The attached Development Standards being recommended and adopted for the Special Use Permit . 2 . No building or electrical permits shall be issued for the Special Use Permit area until the Development Standards for the Special Use Permit have been placed on the Special Use Permit plat and said plat has been delivered to the Department of Planning Services office. ZEugene Brownwood - SUP - Dairy DEVELOPMENT STANDARDS 1. The dairy operation on the hereon described parcel shall be limited to the facilities shown which are designed to handle a total of 400 milking cows. , 2 . The Special Use Permit area shall be maintained in such a manner so as to prevent soil erosion, fugitive dust , and the growth of noxious weeds. 3. All phases of the operation shall comply with all County and State Health Standards and Regulations pertaining to air quality, water quality, noise emission, and sanitary disposal systems. a. The dairy operation is required to conform with Regulation No. 2 of the Colorado Air Pollution Control Commission. Odors must not exceed 31 : 1 dilution to threshold as long as best practical maintenance and operating practices are being used. b. Septic permits will be required for all planned toilet facilities. An engineer-designed septic system will be required for any system other than a single unit family dwelling. 4. Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May , 1968. The applicant shall be responsible for any additional applicable directives or guidelines issued by the Colorado Department of Health Water Pollution Control Division. 5 . All accesses shall have the approval of the Weld County Engineering Department . All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department . 6. All plans, specifications and data pertaining to the dairy operation shall be submitted to the Weld County Health Department for approval prior to obtaining a Building Permit for the dairy operation. • 7. There shall be no discharge of wastes into any streams, other bodies of water, or adjacent drainage systems without obtaining a National Pollution Discharge Elimination System Permit from the Colorado Department of Health. 8. The Special Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. Any material deviations from the plans and/or Development Standards as shown or stated above shall require the approval of an amendment to the Special Use Permit by the Planning Commission and the Board of County Commissioners before such changes from the plans and/or Development Standards shall be permitted. Any other changes from the plans and/or Development Standards shall be filed in the office of the Department of Planning Services . /1"/"/"----- - a ' comments : 1. The applicant has submitted a petition form signed by two adjacent property owners in favor of this request . 2 . Our office has received a letter from School District RE-5J at Milliken. Their main concern is the potential of undesirable pollutants crossing school property during periods of high natural drainage run-offs. The applicant did submit additional information subsequent to the April 3 , 1979 Planning Commission meeting addressing this issue and the previous concerns of the Weld County Engineering Department identified in their memorandum dated March 20, 1979. APPLICANT: Continental Pipeline Company CASE NUMBER: SUP-385 : 79 : 7 SUBJECT: Amend SUP-187 for an Oil Storage Facility LEGAL DESCRIPTION: Pt . NW* NW4, Section 2 , T1N, R67W LOCATION: Southeast of the intersection of County Roads 21 and 14 APPEARANCE: Steve Theede, Assistant District Manager - Cheyenne DISCUSSION: Mr. Theede first gave a brief description of why Continental Pipeline Company is doing business in Weld County. This primarily being gathering crude oil from producing wells. The crude is gathered into a main station at Fort Lupton and injected into the main line system that moves south to Denver to serve refineries in that area. Part of this total system encompasses two locations. One at the location applied for in this request and the other at U.S . Highway 85 and County Road 182i Planning Commissio] mutes Page 2 April 17 , 1979 being Spindle A and Spindle B respectively . The proposed use for this amendment is for a crude oil truck unloading facility and transfer facility to receipt pipeline gathered crude into the facility for subsequent delivery, by pipeline, to Continental Pipeline ' s Fort Lupton station . This will increase the accuracy of measuring receipt volumes from truck transports and reduce truck traffic . Discussion followed regarding the truck traffic. Tom Honn then read the staff ' s recommendation for approval of the request and the Development Standards . The Chairman then asked Frank Suckla and Percy Hiatt for their comments on their site review of the proposal . Mr . Suckla stated that he feels the existing facilities are too close to the road and too close to the farm buildings . Mr . Hiatt stated he felt the same as Mr. Suckla and does not want to see the facility enlarged any more closer to the surrounding property owners, being the Berger' s. Chairman Carlson then asked for comments from the audience . At this time Jack Berger, Jr . expressed his opposition to the facility as he feels that it is a safety hazard and does not want the facility enlarged for this reason. He distributed pictures of a spill of the facility. He also stated that trucks are operating 24 hours a day and the circular area is not paved . Jack Berger, Sr . stated he felt the same way . He has no objection if they move it farther awaay . Chairman Carlson then asked John Hall of the Weld County Health Department for his comments . regarding this . PIr . Hall at this time stated that at the Spindle B site there was oil on the ramp where the trucks unloaded. The oil was being transported on the truck tires and then onto the road. He also stated that he did some noise level testing at both sites and the noise level was too high when the trucks were running and unloading. When they left the level was alright . Mr. Gilbert then asked if the area was in fact paved as stipulated in the permit . Mr. Theede stated that a concrete drive was put in because asphalt deteriorates . MOTION: Be it therefore resolved to table the request until the Planning Commission meeting on May 1, 1979 for further research by the Planning Staff as to whether they have in fact met the commitments that were made in the original Special Use Permit ; further information on the capacity of the bermed area if an additional 1 ,000 barrel storage is added. There are no water rights with this property and no irrigation water. The topography of the land has not allowed this property to be farmed, so this is only native grass . Some discussion followed regarding the small pond that will be developed in the existing drainage area. Tom Honn and the Planning Staff were unable to make a recommendation regarding this request . Kerbs, surrounding property Planning Commissioi mutes Page 4 April 17, 1979 owner, stated that the only thing she is concerned about is that a provision should be made for damage to property if the pond should wash out . Jim Gilbert stated that he had site reviewed the property and feels that this is an excellent concept and a very natural and compatible use for the property. Also that it would be the highest and best use of the property. Mrs . Kountz asked if the applicant was aware of the snow-making machines that could create noise at the Sharkstooth Ski area. Mr. Moore said he was aware of this . MOTION: Be it therefore resolved to recommend approval- to the Board of County Commissioners because it is an extremely compatible use for this piece of ground in that the Planned Unit Development will only disturb 15 acres of property and because it is the highest and best use for this piece of ground. Metcalf stated that the proposed site is a property of 150 acres . The towers will not prevent future farming. Ben Nix then asked why four towers are needed. Ihor Sulyma then explained that the towers are used to control the amount and direction of the signals to provide coverage and to meet requirements as set down by the FCC . Tom Honn then read the staff ' s recommendation for approval and the Development Standards . Chairman Carlson then asked for any comments from persons in the audience . At this time Bob Ray , in representing Julius and Annabell Lindquist , expressed their opposition to the request . Wilbur Schild also expressed his opposition as he feels his property will be devaluated and he has towers surrounding his property now. Mr. Nix then asked why this particular site was chosen . Mr. Metcalf responded that they had looked for several months and this site was the only one which would be the least affected as regards agricultural ground. MOTION: Be it therefore resolved to recommend denial for the following reasons : 1) Just because the water has been sold off the farm does not remove the designation of prime agricultural ground; 2) Concern with the number of towers that are going to go into that area that are proposed now, that are existing now, that are proposed and will be proposed in the future ; 3) In this type of request the neighbors feelings have to be strongly considered in any recommendation the Planning Commission makes . As part of their long-range planning they have designed and hope to build a private microwave system consisting of 32 towers in the three-state area. This 100' tower is part of that system. It will receive and transmit a microwave signal between similar facilities . The application has FCC and FAA approval and will pose no danger to humans or animals and will not interfere with radio and television reception. The preliminary plan was presented and reviewed by the Weld County Utilities Advisory Committee on March 29. The application was tabled for revisions on the plat. Bill Shade, attorney representing the applicants, stated that he does not agree with the Planning Staff in delaying this request any longer because of the Utility Board tabling decision and also because these are minor problems that can be worked out. He also mentioned that there is a 30 ' access easement along the north side of the property running the entire length of the property which belongs to the Camenishes . Plans are to take part of the easement and overlay it iwth a public street. He said this would in no way involve the Camenishes or be of concern to them. This should be a matter for the County Attorney to advise the Board of County Conuuissioners in this regard. Tom Honn then responded that the Planning Staff did not have adequate time to fully consider and review the proposal which is another reason for the requested delay in making a decision. The concerns of the Highway Department and the Engineering Department must also be considered before a final decision is made by the Planning Staff. He then read the staff' s recouuuendation for continuing the preliminary plan to April 17 , 1979 and approval of the Unit Development plan. He stated that this is a Unit Development which was left off the AGenda. Discussion followed. The subject was then brought up by Frank Suckla regarding the water table. Virginia Jaskot, water engineer, explained that an evapotranspiration system will be used, but it is not exactly known at this time the types and what size uses will be needed. Mr . Gilbert asked if the concerns of the Longmont Fire Protection District have been addressed. Mrs . Jaskot responded that they have seen the revised plan with the fire hydrants relocated. Discussion followed regarding the access easement. Mr. Camenish, land owner to the west and also owner of the access easement, stated that he was not notified of the proposal regarding the easement until the day before the Planning Commission hearing. He also has never seen any drainage plans , etc. and not well informed regarding the proposal. Mr. Shade responded that it does not disturb their access and they have no right to interfere with this development. Mr. Camenish was also concerned with the waste water disposal. DISCUSSION: Mr. Blakely first stated that the four cities of Fort Collins, Estes Park, Loveland and Longmont have obtained their electrical power from the Federal government. This invovled hydroelectric power. These cities were informed by the Bureau that there would soon be no more hydrelectric projects and that the demands would run out in late 1977 . The four cities then formed Platte River Power Authority. ! He then discussed the process of how they are now coming before the Planning Commission in regard to meetings, etc. they have presented' to Larimer County. Bill Slimak explained how the transmission line is to be constructed by the use of a map. Tom Keith, Environmental Planner, presented a slide presentation showing where the line would be located of both the County Line Route and the preferred route which also showed residences which expressed concern of the County Line Route. Tom Honn then read the staff' s recommendation for the County Line Route and the Development Standards. Herb Shaw then commented on three items of concern regarding the staff' s recommendation. His first comment was that of the impact on agricultural ground which the Planning Staff said would affect 60% of the agricultural ground. He felt this figure was too high when comparing the two routes. He also commented on the regional aesthetics regarding the view of the line in Weld County. He also felt there will be a great deal of impact on Black Hollow Reservoir which would be a major disadvantage. Dicussion then followed on moving the pole Planning Commission mutes • Page 5 April 3 , 1979 structures east 200' to 300' to where they would be behind the residences on the east rather than on the west immediately adjacent to the road right-of-way and the alternative routes which could be taken for the line. The Chairman then opened the discussion to audience participation. At this time Leonard Anderson expressed his concern regarding the amount of agricultural land it crosses and how this line could create a real problem for aerial sprayers. He does not feel the line benefits Weld County; Robert Moser said that no mention had been made that the line will go through a subdivision and affect nine homes. He also commented his land is worth too much to him and would rather have it condemned. Wayne Foster stated he prefers the County Line Route. Jose Base expressed opposition to the County Line Route and does not want the transmission line at all and also would decrease the property values; Roger Vermeer was opposed to the County Route. Bob Barnes was in favor of the County Line Route. MOTION: Be it therefore resolved to recouuuend approval for the County Line Route based on the staff' s recommendation. The dairy operation is required to conform with Regulation No . 2 of the Colorado Air Pollution Control Commission. Odors must not exceed 31 : 1 dilution to threshold as long as best practical maintenance and operating practices are being used. b . Septic permits will be required for all planned toilet facilities. An engineer-designed septic system will be required for any system other than a single unit family dwelling. 4 . Lagoons for wastewater retention shall be installed as per Rules and Guidelines for Water Pollution Control at Livestock Confinement Areas issued by the Colorado Department of Health, May, 1968 . Based on field inspection, the location of the existing pens in relation to Weld County Road 46 appears to be inaccurate. 2. Site plan should show all existing rights-of-way. Irene Street which runs along the east side of the property is maintained by usage only. It would be appropriate, at this time, to show a 30 foot right-of-way dedication along Irene Street. Since the Brownwood's own both sides of Irene Street, perhaps a full 60 foot dedication could be done at this time. 3. Access should not be permitted within 300 feet of an intersection. There also appears to be adequate existing access to the property now. The internal system of roads should be redesigned so as to not incorporate public road- ways and with no additional accesses from what is now existing. 4. There is a history of flooding through the area of the proposed development. The Little Thompson Ditch has overtopped during heavy rainfall on numerous occasions. The water flows north, across Weld County Road 46 and into the town of Milliken. Therefore, this property appears to be a most unappropraite location for a dairy facility. A complete drainage study and an analysis of the facilities impact on drainage patterns should be required. 5. A plan to handle all existing irrigation structures along the south and east property lines should be submitted. 6. We feel it would be much better if the dairy could be re-located, or if drainage could be re-routed to avoid this possible contact with students. Each party agrees that they shall pay their own respective attorney, accountant, engineering and other advisory and closing fees in connection with this agreement. Each party represents that no act has been taken to permit or suffer any lien to be attached to the property, and in the event that any such lien is determined to be attached to said property or will be attached to such property, then Seller shall hold Buyer harmless from any and all amounts incurred by said Buyers in removing said lien. Sellers shall forthwith remove such lien so that Buyers shall have title free and clear of such encumbrance. 11. Buyers agree that they will, upon written notifica- tion by Sellers, enter into a Contract for Exchange wherein the -3- P property which is the subject matter of this Contract is ex- changed for other property which is owned by the Sellers ("Other Property") ; provided, however, that the Contract for Exchange shall close simultaneously with another Contract wherein the other property is sold to a third-party purchaser. Sellers agree to indemnify and hold the Buyers harmless of and from any and all loss, claim or damage which may be occasioned by Buyers by reason of the execution of the Contract for Exchange. Further, the Buyer shall convey by either Quit Claim Deed or Special Warranty Deed, any and other conveying document shall be without warranties or guarantees. All expenses of said exchange and sale over and above the expenses of the Buyers contemplated by this Contract shall be borne by Sellers hereunder. 12 . It is mutually understood and agreed that Sellers ' • obligation to sell under the terms of this contract are specifi- cally contingent upon Seller obtaining other real property with which to exchange satisfactory to Sellers and in the event that Sellers are unable to find such property, Sellers shall have the right to return to Buyers the FIVE HUNDRED DOLLARS ($500. 00) down- payment heretofore provided and cancel and invalidate this contract, without further obligation. 13. The primary soil in the area is Olney fine sandy loam, 1 to 3 percent slopes (21B-B). This is a deep, well drained soil with moderate permea- bility, moderate water holding capacity, effective rooting depth of 60 inches or more, medium surface runoff and low water erosion hazard. This soil has a moderate limitation for use with animal waste lagoon systems due to permeability in the subsurface which will allow seepage. Lagoons will need to be sealed to prevent seepage and possible contamina- tion of underground water. Manure fines and fine silts from wash opera- tions should help to seal the lagoon. This soil also exhibits few to slight limitations for\construction of dwellings and commercial buildings. An on-site investigation has been made of this site and conditions as expressed in our soil survey information are accurate. If, however, conditions other than those described above are found, a more detailed on-site investigation should be performed for design criteria.
