RE: APPROVE CERTIFICATION TO THE WELD COUNTY TREASURER OF PUBLIC
NUISANCE ABATEMENT COSTS AS SPECIAL ASSESSMENT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, acting pursuant to
Section 25-1-518(3), C.R.S., as the local Board of Public Health, ordered the owner and
receiver of the Rocky Mountain Vista Mobile Home Park, located at 12623 County Road 6, in
Weld County, Colorado, (Property Profile Account #R6777995, R6777997; Parcel
#147119400016, 147119400017), to abate the public nuisance existing at the park, and
WHEREAS, the Board authorized the Weld County Department of Public Health and
Environment (WCDPHE) to abate the public nuisance if the owner or receiver failed to do so,
which was done by the WCDPHE, and
WHEREAS, as of December 17, 2012, the WCDPHE has expended $12,410.00 in
abatement costs related to the public nuisance abatement order, and
WHEREAS, Section 25-1-518(3), C.R.S., allows these costs to be assessed against the
property and collected as a special assessment by the Treasurer.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, hereby approves the Certification of $12,410.00 to the Weld County
Treasurer to be collected as a special assessment.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 17th day of December, A.D., 2012.

NOTICE OF CERTIFICATION OF LIEN TO WELD COUNTY TREASURER;
ROCKY MOUNTAIN VISTA MOBILE HOME PARK
December 6, 2012
To Whom It May Concern:
As of November 30,2012 the Weld County Department of Public Health and Environment
(WCDPHE)has expended$11,510.00 related to the abatement of the public nuisance existing at
the Rocky Mountain Vista Mobile Home Park(Park), located at 12623 County Road 6,Weld
County Colorado. These costs are directly related to the actions authorized by the Weld County
Board of County Commissioners,acting as the local Board of Public Health,related to the
sewage on the ground at the Park.Copies of these bills are attached.
At the December 17,2012 meeting, at 9:00 a.m.,the Weld County Board of County
Commissioners will determine whether to certify these costs as to the Weld County Treasurer as
a special assessment for collection along with taxes,as permitted by C.R.S. §25-1-518(3). Such
lien would have priority over all other security interests,except for taxes.
In addition to the$11,510.00,the Weld County Treasurer's fee increases the lien by 10%,as
permitted by law. The total amount to be certified is$12,661.00. Should any costs be expended
by the WCDPHE related to the abatement of the public nuisance prior to December 17,2012,
those costs could be included in the certification to the Weld County Treasurer.
