RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO NOVEMBER 26, 2012 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, November 26, 2012, at the hour of 9:00 a.m. IR ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Sean P. Conway, Chair- EXCUSED Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer - EXCUSED Commissioner David E. Long Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Tammy Waters/ Esther Gesick Director of Finance and Administration, Monica Mika F MINUTES: Commissioner Rademacher moved to approve the minutes of the Board of County Commissioners meeting of November 21, 2012, as printed. Commissioner Long seconded the motion, and it carried unanimously. El AMENDMENTS TO AGENDA: There were no amendments to the agenda. F PUBLIC INPUT: Doug Meyer, County resident, submitted an article titled U.S. Seasonal Drought Outlook, marked Exhibit A, and reported on a meeting he attended last week with speaker Dr. Chuck Leaf. El CONSENT AGENDA: Commissioner Long moved to approve the Consent Agenda as printed. Commissioner Rademacher seconded the motion, and it carried unanimously. NEW BUSINESS: El 1) CONSIDER RENEWAL APPLICATION FOR HOTEL AND RESTAURANT LIQUOR LICENSE AND AUTHORIZE CHAIR TO SIGN - LUZ ESTELA TARIN, DBA TAQUERIA RANCHO ALEGRE: Brad Yatabe, Assistant County Attorney, presented the application. Deputy Lisa Carpenter, Sheriff's Office, reported no concerns. Commissioner Long moved to approve said renewal application and authorize the Chair to sign. The motion was seconded by Commissioner Rademacher, and it carried unanimously. Minutes, November 26, 2012 2012-3338 ?).� Page1 BC0016 In 2) CONSIDER TEMPORARY CLOSURE OF CR 61 BETWEEN U.S. HIGHWAY 34 AND CR 50: Janet Carter, Department of Public Works, reviewed the provisions of the closure. Commissioner Rademacher moved to approve the temporary closure. Commissioner Long seconded the motion, which carried unanimously. IR 3) CONSIDER CANCELLATION OF TAX LIEN SALE CERTIFICATE (TS CERT 2004-0288): John Lefebvre, Treasurer, provided a brief explanation of the lien holder situation and responded to questions from the Board regarding the timing and property owner's rights through the endorsement process. Stephanie Arries, Assistant County Attorney, explained payment of the taxes creates a potential investment opportunity; however, the investor does not own the property at that point. Mr. Lefebvre reviewed the notification process. Commissioner Rademacher moved to approve said cancellation. Commissioner Long seconded the motion, which carried unanimously. ID 4) SECOND READING OF CODE ORDINANCE #2012-12, IN THE MATTER OF REPEALING AND RE-ENACTING, WITH AMENDMENTS, CHAPTER 8 PUBLIC WORKS, OF THE WELD COUNTY CODE: Commissioner Rademacher moved to read the ordinance by title only. Commissioner Long seconded the motion, which carried unanimously. Mr. Barker read said title for the record. Mr. Yatabe provided a brief summary of the proposed revisions and stated no changes have been made since the first reading. No public testimony was offered concerning this matter. Commissioner Long moved to approve Code Ordinance #2012-12 on second reading. Commissioner Rademacher seconded the motion, which carried unanimously. PLANNING: la 1) CONSIDER PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT #1591 - C & M RODRIGUEZ SERVICES, INC.: Chris Gathman, Department of Planning Services, stated the Use by Special Review (USR) permit was approved on June 20, 2007, and encompassed Lots A and B of Recorded Exemption #4105; however, the existing business is only located on Lot A and the applicant's request is to vacate the USR from Lot B to avoid overlapping USR boundaries. Commissioner Rademacher moved to approve said partial vacation. Commissioner Long seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance#2012-12 was approved on second reading. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
