The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 118 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. An access permit has been approved for this project. Please show the approved accesses on the Plat and label them with the approved Access Permit number (AP12-00047). Traffic to the gas plant is minimal. Due to the staging and storage of equipment and 3 semi trips per day access improvements and a water quality feature will be required. Access improvements are required and shall include 60' radiuses to accommodate turning trucks and tracking control to prevent the tracking of mud and debris onto the County roadway. The standard recommended tracking control for gravel roadways includes a double cattle guard at the exit of the site. Other means of tracking control may also be proposed. An improvements and road maintenance agreement is required for this site. Public Works will provide a draft of the agreement after the Board of County Commissioners hearing for this project. Road maintenance requiring dust control and repair of any damages to the County roadway due to hauling from the site will be included in the agreement. There shall be no parking or staging of vehicles on CR 118. Please provide a water quality depression for this site downstream of the storage and equipment parking area. This area will need to be shown on the plat and labeled as "Water Quality — No Build or Storage Area". Please see the attached procedures for calculating the required Water Quality volume. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Add the following conditions of approval to the plat: a. Show the access points on the Plat and label them with the Access Permit number (AP12-00047). b. An Improvements and Road Maintenance agreement is required. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. DATE: 11/9/2012 Environmental Health Services has reviewed this proposal for a mineral resource development facility, expansion of an existing gas plant. As there will be no permanent employees located at the site, permanent water and sewer are not required. A portable toilet is acceptable in accordance with Environmental Health Policy 2.2.K. On site dust will be controlled by watering as necessary and reducing vehicle speed. The waste handling section states that trash will be contained and transported to an approved disposal site. Noise may be regulated by the Colorado Oil and Gas Conservation Commission. The use of berms, sound walls and enclosing equipment in a sound proof building could be utilized to limit noise impacts if necessary. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirement be met prior to allowing the plat to be recorded: 1 . The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment to Environmental Health Services Division of the Weld County Department of Public Health & Environment. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. We recommend that the following requirements be incorporated into the permit as development standards. 1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 6. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. Portable toilets and bottled water are allowed for employees or contractors that are on site for less than 2 consecutive hours a day 7. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or with all applicable State noise statutes and/or regulations. 8. The operation shall comply with all applicable rules and policies regulated by the Colorado Oil and Gas Conservation Commission. 9. All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 10.The applicant shall comply with all provisions of the State Underground and Above Ground Storage Tank Regulations. 11.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, as applicable. 12.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. 2 MEMORANDUM WI`Dc COLORADO To: Michelle Martin, Planner November 9, 2012 From: Bethany Salzman, Zoning Compliance Officer Subject: USR12-0046 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV12-00154)was noted. This violation was initiated due to the operation of an oil & gas Support and Services business without first completing the necessary Weld County Zoning Permits. This case has not been presented to the Weld County Court Magistrate through the Violation Hearing process; therefore, an investigation fee is not required at this time. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff initiated complaints. This application if approved by the Board of County Commissioners and once a plat is recorded will correct the violation. If this application is denied, all oil &gas operations and associated activities and/or storage shall be removed from the property within 30 (thirty)days of denial or the violation will proceed in court accordingly. The findings are as followed: There are no building permits on file forany of the structures on the site. A building permit will be required for each structure as well as for the covers over the compressor units. An engineer will need to investigate the foundations and provide a letter for each foundation stating that it meets the current adopted Weld County Codes. Electrical permits will also be required. Any existing electrical wiring that has not been permitted will need to be inspected and the proper permits pulled. Any owner or authorized agent who intends to construct, enlarge, alter, repair, move, demolish, or change the occupancy of a building or structure,or to erect, install, enlarge, alter, repair, remove, convert or replace any electrical, gas, mechanical or plumbing system, or to cause any such work to be done, shall first make application to the building official and Weld County to obtain the required permit.
