The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 40 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. The business will utilize the existing access from CR 40. Adequate (min 60") truck turning radiuses are required at the access. Please show the existing access on the Plat and label it with the approved Access Permit number(will be provided). Tracking Control is required to prevent tracking of mud and debris onto the County Roadway. A set of • double cattle guards set one right after the other is recommended for tracking control. Please show and label the cattle guards on the site plan. A stop sign is required at the exit of the site. Please show and label the stop sign on the site plan. Please provide a blown up view of the operations area on the site plan showing buildings, parking, circulation, storage, etc. There may be additional requirements after the revised site plan is reviewed. The water quality feature as designed is not acceptable. Please see the attached redlines and revise the calculation. The area to be used for water quality must be completely on the proposed USR property and all of the water from the operations area must reach it. Please show the boundaries of the Water Quality Depression and label it as "Water Quality — No Build or Storage Area". The depression may need to be moved closer to the operations area. An improvements and road maintenance agreement is required for this project. The applicant will be responsible for a proportional share of any future upgrades to CR 40, will be required to provide dust control along the haul route (CR 40 from the site entrance to CR 49) and will be responsible for any road damages attributed to hauling from the property. A draft of the Improvements and Road Maintenance Agreement will be provided to the applicant if the project is approved by the Board of County Commissioners. This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). REQUIREMENTS: 1. Show the existing access point on the Plat and label it with the Access Permit number (will be • provided). 2. Show adequate (min 60') radiuses at the access point along with cattle guards for tracking control and a stop sign at the exit. Provide a blown up view of the operations area with buildings, storage, and all parking clearly identified. 4. Provide revised Water Quality Feature calculations. Add the following notes to the plat: a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. b. The historical flow patterns and run-off amounts will be maintained on site in such a manner that it will reasonably preserve the natural character of the area and prevent property damage of the type generally attributed to run-off rate and velocity increases, diversions, concentration and/or unplanned ponding of storm run-off. c. The roustabout service will utilize the existing shop building. Painting operations will occur in a new shop building proposed on the site. It is proposed that 4 full-time employees will be at the site for the painting operations and 40-50 employees will access the property to pick up and drop off equipment for the roustabout service. The existing shop is served by an individual sewage disposal system (Permit G19860084). According to this Departments records, the septic system was sized for 8 persons. The existing septic system will require review by a Colorado Registered • Professional Engineer to determine if it is adequate for the proposed hydraulic load. In addition, if the existing septic system serves 20 or more persons per day, a Class V Injection well permit from the Environmental Protection Agency (EPA) for any large- capacity septic system will be required. A new engineered designed septic system will be installed when the proposed shop for the painting operations is constructed. The facility will be served by an existing well which is currently approved for watering of poultry. The applicant has submitted an application to the State to re-permit the well to commercial for business usage. A dust abatement plan was submitted and was found to be adequate. Access driveways and parking areas will be covered with gravel or other road base material. If dust is created the applicant will either apply water using a water tanker truck or portable sprinkler system. A waste handling plan is required and should include the name, address and phone number of the waste removal and disposal companies. The plan should indicate how any waste associated with the facility, including waste generated from vehicle and equipment maintenance and repairs, is contained and disposed of. The amount and type of hazardous materials, such as paints, thinners, solvents, cleaning products, and vehicle fluids that will be on site is also required. The waste handling plan shall address cleanup and disposal of hazardous material spills. • • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. The applicant shall submit evidence of an Air Pollution Emission Notice (A.P.E.N.) and Emissions Permit application from the Air Pollution Control Division, Colorado Department of Health and Environment, if applicable. Alternately, the applicant can provide evidence from the APCD that they are not subject to these requirements. 2. In the event the applicant intends to utilize the existing septic system for business use, the septic system shall be reviewed by a Colorado Registered Professional Engineer. The review shall consist of observation of the system and a technical review describing the system's ability to handle the proposed hydraulic load. The review shall be submitted to the Environmental Health Services Division of the Weld County Department of Public Health and Environment. In the event the system is found to be inadequately sized or constructed the system shall be brought into compliance with current Regulations. 3. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any • large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. 4. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing area(s) shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 5. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the proposed business use. 6. In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. 7. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: • 2 • 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). 8. The applicant shall submit documentation that floor drain wastes from any vehicle maintenance facility is captured in a watertight vault and hauled off for proper disposal. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. We recommend that the following requirements be incorporated into the permit as development standards: • 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any vehicle washing area(s) shall capture all effluent and prevent discharges from drum washing and the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. • 3 • 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Adequate drinking, hand washing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11. In the event the facility's water system serves more 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. (25 people per day over a 60 day period) • 12.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 13. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. 14.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Additionally, please note the following: 1. This application is proposing a well(s) as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health • 4 • and Environment. It is recommended that a code analysis be done on the project by a design professional with experience in this area. A building permit application must be completed and two complete sets of plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required. Water Division 1, Water District 2 Dear Mr. Gathman: This referral does not appear to qualify as a "subdivision" as defined in Section 30-28- 101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy • any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. The subject parcel has historically been used as a turkey farm. It is currently in the recorded exemption process to divide the parcel into four lots. This process is addressed in a separate letter from our office. The subject proposal is to use an existing building as a shop for an oil field roustabout support and a new building for a oil field equipment painting. The proposed water supply for the oil field support business is an existing well that is not permitted. BB Colorado Holdings submitted a commercial well permit application for a well located in the NW1/4 of the SE1/4 of Section 32. Our office does not have a record of any wells in the NW1/4 of the SE1/4. Since the proposed use of the well is different from the historic use, the well could only be permitted as"the only well on a site at least 35 acres", pursuant to 37-92- 602(3)(b), C.R.S. This type of permit allows only drinking and sanitation uses inside a single commercial business. No outside water use is allowed. The ability to obtain a new permit for this well and the type of permit available will be evaluated at the time that the well permit application is received in our office.
