HomeMy WebLinkAbout20121102.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO APRIL 25, 2012 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, April 25, 2012, at the hour of 9:00 a.m. e ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Sean P. Conway, Chair- EXCUSED Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Esther Gesick Director of Finance and Administration, Monica Mika e MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of April 23, 2012, as printed. Commissioner Rademacher seconded the motion, and it carried unanimously. (Clerk's Note: Chair Conway is now present.) e AMENDMENTS TO AGENDA: There were no amendments to the Agenda. e PUBLIC INPUT: No public input was given. e CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. e COMMISSIONER COORDINATOR REPORTS: Commissioner Garcia commented he attended a Pretrial Services meeting and reviewed the progress made to-date. e Chair Conway stated on Monday the State Senate Committee voted three to two, against H.B.1103 concerning emissions testing; however, another year will continue to demonstrate the deficiencies of the program. He also commended Representative Glenn Vaad for sponsoring this item further through the legislative process this year. 1)2) ' a Minutes, April 25, 2012 2012-1102 Page 1 BC0016 Fcommissioner Rademacher commented the State of Colorado published its annual Air Quality Grade Report and all along the Front Range entities were graded with D's and F's; however, Weld County was upgraded from an F to a C, which demonstrates the continued improvement in air quality. BIDS: APPROVE BID#61200029, COPIER / PRINTER/ FAX SOLUTION - DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT: Mark Wallace, Director, Department of Public Health and Environment, recommended approval of the bid from Capital Business Systems, Inc., as explained in his memorandum, dated April 23, 2012. Commissioner Rademacher moved to approve said bid, as recommended by staff. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. E9 PRESENT BID #61200072, CLASS 6 GRAVEL SUPPLY - DEPARTMENT OF PUBLIC WORKS: Monica Mika, Director, Department of Finance and Administration, presented the three bids received and stated staff will make a recommendation on May 9, 2012. OLD BUSINESS: F CONSIDER NONEXCLUSIVE LICENSE AGREEMENT CONCERNING INSTALLATION OF IRRIGATION LINE BENEATH AND ALONG CRS 18 AND 39 AND AUTHORIZE CHAIR TO SIGN - DAVID DECHANT (CONT FROM 04/16/2012): Janet Carter, Department of Public Works, was present to review the terms of the agreement authorizing David Dechant to bore under County roadways for placement of an irrigation pipeline. In response to Commissioner Rademacher, Mr. Barker confirmed Mr. Dechant will assume all liability for any damages as a result of the pipeline. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Rademacher, the motion carried unanimously. F CONSIDER INTERGOVERNMENTAL AGREEMENT CONCERNING THE OWNERSHIP AND USE OF PARCELS LOCATED IN THE UNION COLONY SUBDIVISION AND AUTHORIZE CHAIR TO SIGN - CITY OF GREELEY (CON'T FROM 04/18/2012): Stephanie Arries, Assistant County Attorney, was present to review the terms of the agreement, which was previously approved by the City of Greeley, recognizing the long-standing use of the subject properties. Leon Sievers, Department of Public Works, was present to answer any questions. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Garcia, carried unanimously. NEW BUSINESS: F CONSIDER MEMORANDUM OF AGREEMENT FOR ADOPTIVE FAMILY REQUIREMENTS AND AUTHORIZE CHAIR TO SIGN — PROJECT 1.27: Judy Griego, Director of Department of Human Services, reviewed the terms of the agreement, as further detailed in her memorandum dated April 23, 2012. Commissioner Long moved to approve said Memorandum of Agreement and authorize the Chair to sign. Commissioner Kirkmeyer seconded the motion, and it carried unanimously. ER CONSIDER AGREEMENT FOR TAX INCENTIVE PAYMENTS AND AUTHORIZE CHAIR TO SIGN - PTI USA MANUFACTURING, LLC: Ms. Mika explained the terms of the agreement for the record. Chair Conway reviewed the positive economic impacts of the company locating within Weld County. In response to Commissioner Rademacher, Ms. Mika stated she will provide a copy of the spreadsheet detailing the reimbursement amounts to be added into the public record. Commissioner Rademacher moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. Minutes, April 25, 2012 2012-1102 Page 2 BC0016 E5 CONSIDER RESOLUTION RE: COMPLIANCE WITH SENATE BILL 12-031 REQUIRED CHANGES TO FEDERAL MINERAL LEASE DISTRICT STATUTE FOR WELD FEDERAL MINERAL LEASE DISTRICT AND APPOINTING THE MEMBERS OF THE DISTRICT BOARD TO STAGGERED THREE-YEAR TERMS: Mr. Barker explained the purpose of the Resolution in obtaining compliance with Senate Bill 12-031 and State statutes, and he reviewed the terms of the Federal Mineral Lease Act District Board members. Commissioner Kirkmeyer moved to approve said Resolution and the staggered appointments. Commissioner Garcia seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
