HomeMy WebLinkAbout20120827.tiff RESOLUTION RE: APPROVE MEMORANDUM OF UNDERSTANDING BETWEEN WELD COUNTY AREA AGENCY ON AGING AND COLORADO DEPARTMENT OF PUBLIC HEALTH AND ENVIRONMENT AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,the Board has been presented with a Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services,Area Agency on Aging, and the Colorado Department of Public Health and Environment, commencing April 1, 2012, and ending March 31, 2015,with further terms and conditions being as stated in said Memorandum of Understanding,and WHEREAS, after review, the Board deems it advisable to approve said Memorandum of Understanding, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Memorandum of Understanding between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Human Services, Area Agency on Aging, and the Colorado Department of Public Health and Environment be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Memorandum of Understanding. Griego, Director, Human/Servicesi " RE: Memorandum of Understanding between the Weld County Department of Human Services' Area Agency on Aging and the Colorado Department of Public Health and Environment Enclosed for Board approval is a Memorandum of Understanding between the Department's Area Agency on Aging and the Colorado Department of Public Health and Environment. This Agreement was reviewed by Pass-around Memorandum dated March 5, 2012, and approved for placement on the Board's Agenda. The ARRA Grant between the Colorado Department of Public Health and Environment (CDPHE) and the Area Agency on Aging (AAA) ends March 31, 2012. CDPHE has approached multiple participating ARRA grant agencies throughout the state to assist them in the purchase of a license in order to continue the Chronic Disease Self-Management and Diabetes Self-Management programs in Weld County. AAA has been offering these programs throughout the County since 2008 under the license of other various agencies. By having a separate license, AAA will be able to control the expansion or reduction of workshops based on funding availability and have control of their own fidelity checks. The MOU agreement between CDPHE and AAA is not an exchange of funds, but a sharing of resources. AAA has always provided demographic data to the license holder under which they currently operated. This would not change, and in return, CDPHE would provide materials such as books and CDs to AAA. The term of this Memorandum of Understanding is April 1, 2012 through March 31, 2015. I. Purpose/Scope The purpose of this Memorandum of Understanding(MOU) is to clearly identify the roles and responsibilities of each party as they relate to sharing information and resources related to providing the Stanford Chronic Disease Self Management Program series to the residents in Weld County, Colorado. II. Background Colorado has an existing statewide participant data collection process for those providing the Stanford Chronic Disease Self Management Program (CDSMP) series and requests that organizations providing any versions of the CDSMP workshops participate in this process. The reasons for this process are as follows. • Funding opportunities. Colorado has received funding from state and federal sources as well as local foundations, which support leader training, participant books, marketing materials, and other resources. Increasingly these funders are requiring the use of some key standardized questions and collection of attendance data to allow for state and national data on the reach and impact of these programs. This information can support efforts to seek coverage under health plans, such as Medicaid, Medicare, and other third- party payers. • Greater ability to assess participant retention and areas for expansion. By linking participant information to attendance data, Colorado will be able to more accurately depict participant retention statewide and by county, and have an increased ability to analyze retention rates by demographic groups (i.e., sex, age, race/ethnicity, etc), allowing programs to address retention if significant differences between demographic groups are found. Also, the data will show where and to whom programs are offered to identify areas or populations that are not accessing this program, so steps can be taken to expand into these areas. Effective Date, Modification, and Termination This MOU shall become effective upon the signature of both parties for a 3 year period following the length of the license agreement with Stanford. It shall commence on April 1, 2012, and terminate March 31, 2015 or when the Stanford license has expired, whichever is later. This MOU may be amended if mutually agreed upon, to change scope and terms of the MOU. Such changes shall be incorporated in writing to this MOU. This MOU may be terminated by either party at any time; however, the terminating party shall provide written notice to the other party at least thirty (30) days in advance of the effective date of termination unless there is a critical failure to perform. IV. Weld AAA Responsibilities Weld AAA shall undertake the following activities: • Send workshop promotional information to be posted on the Be Well Colorado website at least 2-4 weeks prior to workshop. • Collect information from each CDSMP participant including: workshop attendance, year of birth, race, ethnicity,types of chronic conditions, zip code, number of people in household, and whether they have taken the workshop before. • Provide books and CD's to participants during or after the second session of the workshop to reduce waste. • Collect workshop information including: dates of workshop, location of workshop, names of leaders, number of attendees, and number of participants attending at least 4 of the 6 sessions. • Submit copies of the completed information within 30 days of workshop completion to: Colorado Dept. of Public Health Chronic Disease Self Management PSD-CD-A5 4300 Cherry Creek Drive South Denver, CO 80246 Phone: 1-877-495-2604 Fax: 303-758-3448 Email: info@bewellcolorado.org V. Colorado Department of Public Health and Environment Responsibilities CDPHE shall undertake the following activities: • Authorize Weld AAA to order CDSMP workshop materials through the state fulfillment center, including Living a Healthier Life with Chronic Conditions book and A Time for Healing CD. Based on availability, the number of books and CD's CDPHE will authorize will be based on the number of attendees present after the first workshop session as documented in the participant attendance information. Requests shall be authorized only after completed participant and workshop information has been received. • Enter participant and workshop information into a password protected database that is compiled with information from workshop participants around the country. The information stored in the database will not include participant names. • Securely store participant and workshop information in a locked cabinet until they are destroyed following state rules. Settlement of Disputes The parties agree to good faith consultation with one another to resolve disagreements that may arise under or relating to this MOU before referring the matter to any other person or entity for settlement. VII. Capacity to Enter Into Memorandum of Understanding The persons executing this Memorandum of Understanding on behalf of their respective entities hereby represent and warrant that they have the right, power, legal capacity, and appropriate authority to enter into this agreement on behalf of the entity for which they sign. This MOU shall begin on April 1,2012 and end on March 31,2015. IN WITNESS WHEREOF, the parties hereto have executed this Agreement on the day first written above.
