WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, -Colorado, and WHEREAS, the Board of County Commissioners of Weld County, Colorado held a public hearing on the 1st day of October, 1979 at the hour: of 9: 00 o'clock a.m. for the purpose of hearing the Conditional Use Permit application of Blehm Land and Cattle Company for a golf course on the following described real • estate, to-wit: Beginning at the Northeast Corner of the Southeast Quarter of the Northeast Quarter of Section 34, Township 5 North, Range 67 West, Weld County, Colorado; thence South 00°02' 30" East, 250 feet; thence South 62°30 ' 50" West, 730. 50 feet; thence South 38 °51' 29" West, 541. 93 feet; thence South 0B°32; 16" West, 397. 40 feet; thence South 72°00 ' 58" West, 200. 81 feet; thence South 00°24 ' 55" West, 828. 02 feet; thence South 90° East, 210. 00 feet; thence South 000 West, 335 . 00 feet; thence South 19°04 ' 38" East, 253. 95 feet; thence South 20°28' 31" West, 1117. 92 feet; thence along the arc of a curve to the left, the chord of which bears North 48 °18 ' 54" West, 227. 5 feet; thence North 49°25' 59" West, 1513.71 feet; thence North 01°37'11" East, 1459. 92 feet; thence South 89°45' 16" East, 1347. 21 feet; thence North 00°12 ' 27" West, 1326. 32 feet; thence South 89°56 ' 53" East, 1278. 02 feet to the Point of Beginning, containing 93. 4 acres. more or less. WHEREAS, evidence was presented in support of approval of the Conditional Use Permit for a golf course, and WHEREAS, Section 3. 3.D. of the Weld County Zoning Resolution authorizes !such a use in an Agricultural District upon approval of a Conditional Use Permit by the Board of County Commissioners, and WHEREAS, the Board of County Commissioners of Weld County, Colorado heard all of the testimony and statements of those pre- 790020 1 5),5' /L155? i sent, has studied the request of the petitioner and the recom- mendations of the Weld County Planning Commission and all of the exhibits and evidence presented in this matter, and having been fully informed, is satisfied that the request for a Conditional Use Permit for a golf course on the hereinabove described real estate complies with all of the conditions as set forth in Sec- tion 3. 3.D. (2) of the Weld County Zoning Resolution. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the application of Blehm Land and Cattle Company for a Conditional Use Permit for a golf course on the hereinabove described tract of land be, and hereby is, granted subject to the following: 1: The development standards contained in the Conditional Use Permit. 2: No building or electrical permits shall be issued on the Conditional Use Permit area until the development standards for the Conditional Use Permit have been placed on the Conditional Use Permit plat and said plat has been delivered to the office of the Department of Planning Services. 3. The applicant addressing the potential flood hazards from a small drainage area of 0. 7 acres flowing through the property on which this request has been made. This information has been requested by the Water Consertation Board in a letter received September 5, 1979. 4i The applicant being responsible for a right- hand turn deceleration land being constructed on the Southbound lane of Colorado State High- way 257. 5: The applicant noting a reservation of . 75 feet of right-of-way on the Conditional Use Permit plat for future expansion of Colorado State Highway 257. 'This condition for approval has been requested by the Colorado State Depart- ment of Highways in a letter received August 31, 1979. BE IT FURTHER RESOLVED by the Board of County Commissioners of Weld County, Colorado that the reasons for approval contained in the Planning Commission recommendations dated September 18, 1979 be, and hereby are, adopted as the findings of fact of the Board of County Commissioners in this matter. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 1st day of October, A.D. , 1979. NW4NW4, Section 12, T1N, R66W LOCATION: 2 miles east and Z mile south of Fort Lupton APPEARANCE : Jim Smith, Attorney DISCUSSION: Tom Honn was first asked by Chairman Otis to bring the Planning Commission members up-to-date regarding the continuance of this application since July 17 , 1979. This item was tabled pending . receipt of additional information as requested by the State Health Department regarding evaporation. The plans have been revised which now show a change to the design of the operation. There is presently a Special Use Permit on the site, but because an violation has taken place, the applicant chose to solve the problem by amending the SUP to add one additional pond ane redesign the system. Mr. Smith then explained that one of the pits collapsed due to last year' s hard winter. The modification now is for one large pit which would enable more evaporation. There will also be an emergency lagoon and will be constructed exactly the same as the new pit. The emergency lagoon will be resealed with bentonite and an emergency overfill dike will be provided. Jim Gilbert then asked John Hall of the Weld County Health Department to comment on what possible testing could be used to insure the seal is there and continues to be there over a period of years. Mr. Hall stated it would be most appropriate to have some type of test well initiated to monitor possible contamination of the water from leakage. Discussion followed regarding evaporation of Planning Commission Minites Page 2 September 18, 1979 • Mr. Hall also proposed that the applicant guarantee the Health Department an appropriate amount of free-boarding so that the water will not get above the dike. Mr. Smith agreed that this would be most appropriate. Tom Honn then read the Planning Staff' s recommendation for approval, the Development Standards and comments. Some discussion followed. MOTION: Be it therefore resolved to recommend approval with the Development Standards based on the Planning Staff' s recommendation with the conditions that a test well and free-boarding be initiated to the Board of County Commissioners. WZSW4j Section 22, T2N, R66W LOCATION: 1 mile north and 2 miles east of Fort Lupton APPEARANCE: Jeff Rech and Sam Oldenburg, Attorney DISCUSSION: Tom Honn brought the Planning Commission up-to-date regarding the Continuance of this application since its continuance from August 21, 1979. There was a Special Use Permit on this site, however; the Board of County Commissioners has recently revoked the permit when several problems arose. This application is for a revised plan. Mr. Oldenburg gave a brief historical background of the site. Discussion followed regarding the problems that occurred on the site which eventually caused the revocation of the permit, basically because of the failure. of the dike and leaching. County Road 31 was closed because of this problem. Cathy Carter, Zoning Inspector, gave her report of inspections she has made at 'the site and eventual issuance of a zoning violation. John Hall of the Weld County Health Department questions the amount of evaporation from the pit from excess water in the pits. Discussion followed. The subject .was also brought up regarding free'-boarding on the dike. Tom Honn then read the Planning Staff ' s recommendation for approval, the Development Standards , and comments. Jeff Rech answered several of the technical questions regarding the proposal as regards the stability tests and free- boarding. Discussion followed. Ken Lind, representing Mr. and Mrs . Adolph Anderson, expressed several concerns. These basically being that he would like to have approval from the County Health Department as regards the design standards and operation of the site; whether or not the pits will be or are to be sealed, free-boarding of the dike, and that the County Health Department be notified 24 hours after the emergency lagoon is used and that it be used only for an emergency. MOTION: Be it therefore resolved to recommend approval with the Development Standards based on the Planning Staff ' s recommendation. ' Also with the addition of four Development Standards regarding use of the emergency lagoon, free-boarding on the dike, that Zoning Inspectors be allowed access to the site, and sealing of the skim • and settling pits. Tom Honn first read into the record the Planning Staff' s recommendation for approval and the Development Standards for each. Mr. Sears stated he that is in agreement and will comply with the Development Standards as proposed by the Planning Staff. Mr. Sears then discussed the sewage situation as it regards the soil condition in that area. He stated that the land there is no different than other land west of Greeley which has already been developed and uses septic tanks . Mr. Gilbert asked John Hall of the Weld County Health Department if he saw any problems with the septic tanks system. Mr. Hall stated he was concerned with the number of tanks which would be used (approximately 168) and feels there are alternatives to this . It was later suggested that perhaps the septic tank system could be limited to the first filing and would no longer be used once the City of Greeley system is available. Chairman Otis then asked if anyone in the audience would care to comment on the proposal. Bryan Shaha, attorney representing the Homeowners Association and also a property owner in Westridge, expressed their concern regarding the proposal especially as it concerns 24th Street. Because of some large trees located approximately between Lots 6 and 7, the Archers cannot complete a circle drive for the residence. This request is to vacate the lot line between Lots 6 and 7 . A right-hand turn deceleration lane shall be constructed for the southbound lane of Highway 257 . 7. A total of 75 feet of right-of-way on the west side of Highway 257 shall be protected by reservation as shown hereon. 8. All accesses shall have the approval of the Weld County Engineering Department and/or. the Colorado Division of Highways. All accesses shall be constructed in accordance with the recommendations and/or requirements of the Weld County Engineering Department and/or the Colorado Division• of Highways. i 9. The Conditional Use Permit shall be limited to the plans shown hereon and governed by the Development Standards stated above and all applicable Weld County Regulations. The present zoning of the parcel is A-1 Agricultural. It is requested that we be permitted to use the site as an. 18-hole golf course along with ancil- lary uses. The zoning regulations for an A-1 Zone permit "public parks, playgrounds, and other public recreation areas owned and operated by a governmental or other_ non-profit agency." Golf courses are specifically permitted as a conditional use. A vicinity map, legal description and plot plan, prepared in accordance with Conditional Use Permit application guidelines, are submitted herewith. Con- tours of the site, golf course'layout, and probable location of parking, club- house and tennis courts are shown thereon. A soil survey was obtained from the Soil Conservation Service. Their evalua- tion disclosed no unusual problems relating to development of the site. None of the proposed site was found to be prime agricultural land by the Soil Con- servation Service. The proposed development will not cause water pollution, odor, noise, glare, fire or other safety hazards. On the contrary, the land is presently not used. Some pollution does occur from dust and sediment carried to the Big Thompson. Obviously, lack of use can also result in some fire hazard. These difficulties will be largely reduced or eliminated by the landscaping involved in the course development. We believe that clear positive environmental impact will result by the devel- opment of excellent open space which protects natural water flow, avoids ero- sion and air pollution, and creates superb wildlife habitat. Traffic congestion, or traffic noise, 'should be a problem. .The parcel, is bounded on the East by State Highway 257. The Highway Department has been consulted and they have indicated that access will be available from Highway f Weld County Commissioners August 10, 1979 Page Two 257. The proposed facility should have no impact upon noise levels along Highway 257. The highway would.obviously not be noticeably affected by the additional traffic. A simultaneous application for rezoning to permit an estate development East • of the subject parcel is being submitted. Assuming that request is approved, sewers would be constructed which would discharge to the Milliken Sanitation District. Permission has been obtained from the District. A copy of the letter is attached. If for some reason the estate development does not materialize, a septic tank and leach field would be used to service the on-site facilities. The Soil Conservation Service classed the soil at the proposed clubhouse lo- cation as Colby loam (40-B) which is suitable for a septic tank installation. Water is available from either the Town of Milliken or the Little Thompson Water District. From either entity a six-inch line with adequate pressure would deliver the supply. We encourage the granting of this application as providing an excellent rec- reational opportunity not otherwise readily available to a large constituency. Those comments assessed only the potential impacts of the golf course on State Highway 257. We have subsequently reviewed the Blehm Land and Cattle Company application for a Zone Change from "A" Agricultural to "E" Estate. If the County approves this zone change, it will be necessary to assess the additional traffic impacts which will result. Preliminary approval vas given to the. proposed access easement to the golf course, but additional study will be necessary for any other points of access. We would expect this access easement will be available for use by residents of the "Estate" property. If this is the case, it is possible that traffic volumes could warrant a left-turn lane as well as the deceleration lane described in our previous letter. As recommended in our comments on the golf course, projected traffic volumes on S.H. 257 indicate that a total of 150 feet would be needed to accommodate future roadway expansion. We ask that a total of 75 feet on the west side of the centerline be protected by reservation or dedication in order to meet future needs. At such time as a site plan becomes available for review, we would like to address drainage impacts of this site as they relate to the highway and the effects of highway noise on the site. The following are our recommendations and requirements. , 1 . A 250-foot portion of this property is adjacent to State Highway 257. Pro- jected traffic ,volumes on this highway indicate that a total of 150 feet of right of way, 75 feet each side of the centerline, would be needed to accommo- date future roadway expansion. We ask that the developer provide the additional right of way along his property which is necessary to achieve the 75-foot width. 2. The access easement intersection with the highway is acceptable to the Division. However, it is shown as being 70 feet wide and the maximum allowable commercial driveway width pis 35 feet. The existing access at this location must be closed if the new access is con- structed as a "T" intersection as shown on the Vicinity Map. Due to the hill on the west side of the highway, care should be taken to insure that this road meets the highway at an acceptable grade. Our analysis of, the anticipated traffic from the golf course finds that sufficient traffic will be generated to warrant a deceleration lane. The developer will be responsible for the construction of this lane to State Highway standards as shown on the enclosed specifications. The constructioh of the driveway and the deceleration lane will require a Drive- way Permit. Three copies of a plan showing details of the proposed construction and the completed permit should be sent to Mr. David N. Fraser, District IV Maintenance Superintendent, P. 0. From this happening, it is apparent that our comments will be given after the fact, which indicates that the possible needs of wildlife are being overlooked. Inasmuch as reports on soil analysis by the Soil Conservation Service, cropland farming feasibility by the Weld County Extension Service, and commercial gravel feasibility by the Colorado Geological Survey were accomplished, welbelieve that wildlife welfare could have been addressed just as easily b9 request to Mr. Rinella or Courtney Crawford. Therefore, it is somewhat after the fact to try • to second guess wildlife inventories. , It would be -safe to say, however, that • about all of the common species are to be found in the area. These would include deer, coyote, fox, raccoon, muskrat, mink, weasel, beaver, pheasant, • magpie, dove, waterfowl, shore birds, numerous seasonal songbirds, raptors, as well as numerous small and nuisance species such as mice, rats and skunks. Probably one more comment should be included concerning the damage by wild- life, such as deer grazing on greens in late fall and early spring and leaving their hoof prints, also on some greens waterfowl will feed and defecate on the greens, which distresses some golfers. Muskrats also have a tendency to inhabit the water hazzards and to burrow holes in the dams. Thanks for theIopportuunity to comment. The Aquolls , which have dark colored surface layers , make up aboutf,65�percent of the mapping unit . The �Aquents , which have lighter colored surface layers , make up about 25 percent. About L percent is Aquolls and Aquepts , flooded , and Bankard sandy loam. These are deep, poorly drained soils. They formed in recent alluvium. Typically they have mottled , mildly to moderately alkaline , loamy or clayey surface layers and underlying material , and are underlain by sand or sand and gravel within 48 inches . They may or may not have a gleyed layer in the underlying material. 4 ; Most of these soils are subject to flooding. A watertahie is at or near the surface early in the spring and recedes to as deep as 48 inches by late fall in some years . These soils are used for rangeland and wildlife habitat. SOME small areas have been reclaimed by major drainage and leveling operations and is farmed to irrigated crops. The potential native vegetation on these soils is dominated by alkali sacaton, switchgrass and western wheatgrass. Saltgrass , sedge , rush and alkali bluegrass are also prominent. Potential production ranges from 3000 pounds per acre in favorable years to 2000 pounds per acre in unfavorable years . When range condition deteriorates , switchgrass , L, •7 i • c-/../ • r/%,-- • , :'<Jac alkali sacaton and western wheatgrass decrease and saltgrass , sedge • and rush increase. • Management of vegetation on this soil should be based on taking half and leaving half of the total annual production. Seeding on this site is difficult and costly since numerous tillage practices are required to eliminate the saltgrass sod . Switchgrass , western wheatgrass , alkali sacaton , tall wheatgrass and tall fescue are suitable for seeding. For successful seeding a clean, firm seedbed -- usually requires more than one year to eliminate the saltgrass sod -- and a grass drill should be used. Early spring seeding has proven most successful. Wetland wildlife , especially waterfowl , utilize these areas . The availability of moisture due to the wetness of this soil allows pro- duction of wetland plants that provide nesting and protective cover , as well as some food for waterfowl . The Juxtaposition of this soil to irrigated cropland areas where wildlife obtain much of their food , along with the cover provided , make this soil valuable to both wetland and openland wildlife. Openland wildlife , especially pheasants , use these areas for cover and • nesting, while they also provide excellent cover for deer when found in areas inhabited by deer. • Management for wildlife would include prevention of overgrazing by livestock, protection from unplanned fire, and prevention of drainage . Where livestock are present , these valuable wildlife areas should be ( "^•� fenced to prevent unwanted encroachment and overuse by livestock. /•7 0 J These soils have a good potential as a source of sand and gravel . Capability subclass Vlw Salt meadow range site • • • vy • 1.5- - Colby loam, 1 to 3 percent slopes • This is a; deep , well drained soil on uplands at elevations of 4850 to 5050 feet. It formed in calcareous rolian deposits. • Included in this unit are some areas which have traces of subsoil development,. Typically, the surface layer is pale brown loam about 12 inches thick. The upper underlying material is very pale brown' silt loam about 30 inches thick. The lower underlying material, to a depth of 60 inches , is a silt loam or very fine sandy loam. Permeability is moderate. Available water capacity is high. Effective M1'{ rooting depth is 60 inches or more. Surface runoff is medium and erosion • hazard is moderate. Where irrigated this soil is suited to all crops adapted to this area , Pt C. 8) including corn , sugar beets, beans , alfalfa, small grains , potatoes and onions. An example of a suitable cropping system is alfalfa 3 to 4 years followed by corn, corn for silage , sugar beets , small grain , beans and back to alfalfa. Some conservation practices such as land leveling, ditch lining and pipelines may be needed for proper water application. All methods of irrigation are suitable with furrow irrigation the most common type used. Barnyard manure and commercial fertilizers are needed for top yields along with maintaining good organic matter content. 75 • In nonirrigated areas this soil is suited to winter wheat , barley and O4141, o- pnc2:chca Cwinagt ncrt %doe. of 22 buei+ci sorghum. The potential native vegetation on this soil is dominated by blue grama. Several midgrasses such as western wheatgrass and needle-and-thread are also present. Potential production ranges from 1600 pounds per acre in favorable years to 1000 pounds per acre in unfavorable years . When range condition deteriorates , the midgrasses decrease , blue grama , buffalograss , snakeweed , yucca and fringed sage increase and production drops . The lower underlying material , to a depth of 60 inches , . is a silt loam, very fine sandy loam or sandy loam. �ttt �;.;( ; Permeability is moderate. Available water capacity is high. Effective . rooting depth is 60 inches or more . Surface runoff is rapid and erosion hazard is high. This soil is suited to limited cropping; intensive cropping is hazar- dous because of erosion. The cropping system should be limited to close grown crops such as alfalfa , wheat and barley. The soils also are adapted to irrigated pasture. A suitable cropping system would be alfalfa 3 to 4 years followed by corn and small grain for 2 years and alfalfa seeded with a nurse crop. Close grown crops may be irrigated from closely spaced contour ditches or sprinklers . Contour furrows or sprinklers should be used for new crops. Applications of nitrogen and phosphorous fertilizer will help maintain good production. �v� ` 1746- D ?+:' y The potential native vegetation on this soil is dominated by blue C'•� grama. Sideoats grama, little bluestem, western wheatgrass and sedge are also prominent. Potential production ranges from 1800 pounds per acre in favorable years to 1500 pounds per acre in unfavorable years . When range condition deteriorates , sidcoats grama and little bluestem • decrease , production drops and blue grama , buffalograss and several perennial forbs and shrubs increase. Undesirable weeds and annuals invade the site as condition becomes poorer. Management should be based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sideoats grama, little binestem, western wheatgrass and pubescent wheatgrass arc suitable for seeding. The grass selected a44 should meet the seasonal needs of livestock. This treeless soil is relatively unproductive for vegetation, especially in times of thought when production may gn as low as 300 pounds per acre per year. This soil is suited to limited cropping; intensive cropping is hazardous because of erosion. The cropping system should be limited to close grown crops such as alfalfa, wheat and barley. The soils also are adapted to irrigated pasture. A suitable cropping system would be alfalfa 3 to 4 years followed by corn and small grain for 2 years and alfalfa seeded with a nurse crop. Close grown crops may be irrigated from closely spaced contour ditches or sprinklers. Contour furrows or sprinklers should be used for new crops. .Application of commercial fertilizer gill help maintain good production. , • 61/3 • Ci) /girt The potential native vegetation on this soil is dominated by blue grama. - Several mid grasses such as western whentgras:: and needle and thread arc also present. Potential production ranges from 1600 pounds per acre in favorable years to 1000 pounds per acre in unfavorable years. When range • condition deteriorates, the midgrasses decrease, blue grama, huffalograss, snakeweed, yucca and fringed sage increase and production drops. Undesirable weeds and annuals invade the site as range condition becomes poorer. Management of vegetation on this soil should be 'based on taking half and leaving half of the total annual production. Seeding is advisable if range is in poor condition. Sideoats grama, little bluestem, western wheat- grass, blue grama, pubscent wheatgrass and crested wheatgrass are suitable for seeding. The grass selected should meet the seasonal requirements : of livestock. For successful seeding, a clean, firm, sorghum stubble-- prepared the growing season prior to seeding--or a firm, prepared seedbed and grass drill should be used. Early spring seeding has proven most successful. Windbreak and environmental plantings are generally not suited to this soil. On-site investigation is needed to determine if plantings are feasible. Rangeland wildlife, such as antelope, cottontail and coyote are best adapted for life on this soil. Forage production is typically low and proper livestock grazing management is necessary if livestock and wildlife share the range. Livestock watering facilities are also important and arc `11 utilized by various wildlife species . In cropland areas, habitat favorable for pheasants, mourning doves and many non-game species can be developed by establishing wildlife areas ,for nesting and escape cover. V3 _ cv • =r.
