RE: GRANT OF CHANGE OF ZONE FROM E (ESTATE DISTRICT) TO
A (AGRICULTURAL DISTRICT) FOR COAKLEY COWHERD.
WHEREAS, a public hearing was held on July 28, 1976
in the Chambers of the Board of County Commissioners, Weld
County, Colorado, for the purpose of hearing the petition of
Coakley Cowherd, Route 1, Box 53, Greeley, Colorado,
requesting a change of Zone from E (Estate District) to A
(Agricultural District) for a tract of land located in the
Southwest Quarter of Section 28, Township 6 North, Range 65
West of the 6th P.M. , Weld County, Colorado, more particularly
described as follows :
Beginning at the SW Corner of said section,
thence North 870 ' (more or less) ; Thence
East 660 ' (more or less) ; Thence South 870 '
(more or less) ; Thence West 660 ' (more or
less) to the Point of Beginning. Said
tract contains approximately 13 . 18 acres
more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of the
petitioner for a change of Zone upon the aforementioned tract
of land, and
WHEREAS, Sections8. 2 and 8. 3 of the Weld County Zoning
Resolution authorize the Board of County Commissioners to grant
a change of Zone upon a showing by the petitioner of certain
facts , and
WHEREAS, the Board of County Commissioners heard all
the testimony and statements of those present, has studied
the request of the petitioner, and the recommendations of the
Weld County Planning Commission, and having been fully informed
and satisfied that the requested rezoning complies with the
Weld County Comprehensive Plan and the conditions set out in
Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolution;

NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, twat the petition of
Coakley Cowherd for a change of Zone from E (Estate District)
to A (Agricultural District) on the above described tract of
land, be, and hereby -is, granted.
The above and foregoing resolution was, on motion duly
made and seconded, adopted by the following vote this 4th
day of August, A.D. , 19-76.

I hereby certify that pursuant to a notice dated June 21, 1976,
duly published June 25, 1976 and July 16, 1976 in the Greeley Booster ,
a public hearing was held on the request for a Change of Zone, E to A,
by Coakley Cowherd, at the time and place so specified in said notice.
All five commissioners were present and heard the testimony presented.
Commissioner Carlson made a motion and Commissioner Moser seconded it
to approve the request. Motion carrie unanimously.

Dear Gary:
The City Planning Commission at their June 8 meeting reviewed -the following
three referrals from your office :
The first referral is the rezoning and subdivision plat of Ken-Wil
Acres. The Planning Commission approved a motion that the
recommendations made at their May 27, 1975, meeting are still in
effect. I am attaching a copy of the letter which I forwarded
to you at the time the Planning Commission reviewed it.
The second item was the rezoning request from Mr. Coakley _Cowherd.
The -Planning Commission recommends the r-ezoning request be
approved; in -addition that, since more of the property located
north of the particular request is also zoned estate, a con-
sideration be made toward rezoning that area to agricultural
as well . It would appear that some incompatible 1-and uses would
exist if portions of the property remain r-esidenti-al and the
balance be agricultural .
The third r-eferral was a subdivision exemption for Mr. John Rayburn.
The Planning Commission has tabled this request at this time since
Mr. Rayburn indicated an amendment to his exemption application
would he forthcoming. This amendment would be required by the

III. REFERRAL FROM WELD COUNTY: APPLICATION FOR REZONING,
ESTATE TO AGRICULTURAL
Location: County Roads 41 and 64, Section 28 (1/2 mile north
and east of the city limits of Greeley)
Mr. Neal commented that the applicant in this case has applied for a down
zoning of property from estate to agriculture in an area approximately
13. 2 acres in size which would be on the northeast corner of the inter-
section of County Roads 64 and 41 . The purpose of the rezoning is to
build an onion storage building for onions which are raised on the
surrounding farm land. Such a facility would he compatible with the
agricultural use of this land. Word from County Planning staff members
had indicated that the County' s estate zone would not allow for the
construction of such an agriculturally related facility, and a down -
zoning of this land from estate to agriculture would be necessary to
accommodate the building. A down-zoning as such was seen as being very
supportable by Planning staff members.
