HomeMy WebLinkAbout20120631 RESOLUTION RE: GRANT PERMIT FOR TEMPORARY ASSEMBLY TO DAWN SCENA, NORMAN LAW, AND GLENN SHARP- MARCH 31, THROUGH APRIL 1, 2012 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Dawn Scena and Norman Law, 9264 County Road 55, Keenesburg, Colorado 80643, and Glenn Sharp, P.O. Box 771, Platteville, Colorado 80651, have presented to the Board of County Commissioners an application for a Permit for Temporary Assembly on land within the unincorporated portion of the County of Weld, State of Colorado, to be held from 8:00a.m., until dusk, on March 31, through April 1, 2012, on property described as follows: 9264 County Road 55, Keenesburg, Colorado 80643; being further described as Lot A of Recorded Exemption #3083 (.46R); being a part of the N1/2 SW1/4 of Section 15, Township 2 North, Range 64 West of the 6th P.M., Weld County, Colorado WHEREAS, said applicant has paid Weld County the sum of ONE-HUNDRED DOLLARS ($100.00) for said Weld County Permit for Temporary Assembly, and WHEREAS, having examined said application, the Board deems it appropriate to grant a Weld County Permit for Temporary Assembly to Dawn Scena, Norman Law, and Glenn Sharp, and WHEREAS, said permit shall be issued subject to compliance with the terms and conditions as set forth in the application materials; upon the express condition and agreement that the temporary assemblage will be conducted in strict conformity to all laws of the State of Colorado and the Weld County Code, and that the applicants submit the Incident Action Plan and Traffic Control Plan, for review and approval by staff, prior to the event, and WHEREAS, any violation to said terms and conditions shall be cause for revocation of said permit and forfeiture of bond. 2012-0631 C 1, SC, IA pp I. As used herein, the term event means an assembly or anticipated assembly which is scheduled to last for three (3) consecutive days or less. THIS CONTRACT is made by & between Glen Sharp, d.b.a RevLimits Promotions, hereinafter called "Promoter" and, Colorado Motocross Medics, LLC, 729 Remington Street,Ft. Promoter agrees to purchase and Contractor agrees to provide quick response team offering on-track rescue assistance to any downed or injured motocross racer, initial care, track-side triage and/or coordination of transport to a medical facility. 4. This contract does not guarantee any work nor does it create an exclusive contract for services. 5. The parties agree that the Contractor's relationship to the Promoter is that of an independent contractor. 6. The parties agree that payment pursuant to this Contract is subject to and contingent upon the continuing availability of funds for the purpose thereof. 7. Promoter agrees: a) To notify Contractor of SRAC, RMXA and all National AMA Motocross, Supercross, Arenacross and Endurocross events. b) To monitor the provision of contracted service. c) To pay Contractor after receipt of billing statements for services rendered satisfactorily and in accordance with this Contract within 14 days of receipt of invoice. d) Pay hourly rate of$135.00. 8. Illegal Aliens: Public Contracts for Services A. The Contractor certifies that the Contractor shall comply with the provisions of C.R.S. 8- 17.5-101, et. seq. The Contractor shall not knowingly employ or contract with an illegal alien to perform work under this contract or enter into a Contract with a subcontractor that fails to certify to the Contractor that the subcontractor shall not knowingly employ or contract with an illegal alien to perform work under this contract. B. The Contractor represents, warrants, and agrees that it (a) has verified that it does not employ any illegal aliens, through participation in a program approved under C.R.S. 8- 17.5-102. 1) If the Contractor elects to participate in the State of Colorado Department program pursuant to C.R.S. 8-17.5-102, the Contractor must provide the Promoter a copy of their completed Notice of Participation Form. 2) If the Contractor hires a new employee who performs work under this public contract, the Contractor must provide the Promoter affirmation as required by C.R.S. 8-17.5-102(5)(c)(II). If the Contractor fails to comply with any requirement of this provision or C.R.S. 8-17.5-101, et. seq., the Promoter may terminate this Contract for breach of contract, and the Contractor shall be liable for actual and consequential damages to the Promoter. D. The Contractor shall not use the programs approved under C.R.S. 8-17.5-102 to undertake pre-employment screening of job applicants while this Contract is being performed. E. If the Contractor obtains actual knowledge that a subcontractor performing work under this Contract knowingly employs or contracts with an illegal alien, the contractor shall: 1) Notify the subcontractor and the Promoter within three days that the Contract has actual knowledge that the subcontractor is employing or contracting with an illegal alien; and 2) Terminate the subcontract with the subcontractor if within three days of receiving the notice required pursuant to sub-paragraph "a" above, the subcontractor does not stop employing or contracting with the illegal alien, unless the subcontractor provides information to establish that the subcontractor has not knowingly employed or contracted with an illegal alien. F. If applicable, the Contractor shall verify in accordance with Section 24-76.5-103 C.R.S. the lawful presence in the United States of each natural person eighteen years of age or older who applies for and receives the benefits being provided by the Promoter under the terms of this Contract. Upon Promoter's request, Contractor shall provide to Promoter evidence of such verification. 9. Contractor agrees: a) To provide quick response team offering on-track rescue assistance to any downed or injured motocross racer, initial care, track-side triage and/or coordination of transport to a medical facility. b) Not to assign any provision of this Contract to a subcontractor. c) Not to charge riders any fees related to services provided under this Contract. d) To hold the necessary license(s) and/or registration in state database and provide documentation which permits the performance of the service to be purchased, and/or to meet applicable Colorado Department of Health qualification requirements. e) Staff/volunteers: The Contractor is responsible for performing background checks on all staff/volunteers, family members of staff/volunteers, interns, mentors and any others who will have rider contact. f) To safeguard information and confidentiality of the rider and the child's family in accordance with rules of the Colorado Department of Health. It is also agreed that, during and after the term of this Agreement, all parties shall comply with the rules and regulations of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the Federal Alcohol and Drug Confidentiality Regulation regarding all clinical records and financial information related to Covered Persons, as well as to all statistical data, reports and standards. The parties shall utilize their best efforts to implement appropriate physical, technical and administrative safeguards to prevent and protect such information from unauthorized disclosure. Notwithstanding the foregoing, the parties shall allow access by Covered Persons to their own clinical information, subject to Applicable Law. After reviewing the application, the following is the recommendation made by this Department: 1) Temporary hand washing stations should be located outside the portable toilets. We recommend that there be one hand washing station for every two portable toilets (provided the toilets are in close proximity to one another). If the portable toilets are spread throughout the facility we recommend one hand washing facility per toilet. 2) The application stated that there would be 6 portable toilets available at the event. Based on the hours of the event and number of possible patrons, the Department recommends that at least 8 portable toilets are available for patrons. It was not noted in the application, but the Department would recommend that 2 of the portable toilets be handicap accessible. A conversation was held with Dawn Scena on February 22,2012, in which it was decided that Dan Joseph would send Ms. Scena an email listing her options for providing food service at her event.
