WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public hearing held on the 22nd day of February, 1978 , in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land is owned by Marvin Manning, which land is more particularly described as follows : Tract 12, Aristocrat Ranchettes, Second Filing, a subdivision of Weld County, Colorado. WHEREAS, the owners of said tract of land desire to obtain a variance from the minimum lot size requirement so that said applicants may make application to the Board of County Commissioners to apply for a recorded exemption, as set forth in Section 9-4 .A. (6) of the Subdivision Regulations , and WHEREAS, the Board of County Commissioners of Weld County Colorado, based upon the recommendations of the Department of Planning Services, feels that the applicant has shown good cause for granting a lot size variance under Section 9-4 .A. (6) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado, that a variance from lot size requirements, be, and hereby is , granted to Marvin Manning for the above-described parcel of land, subject to the stipu- lation that when the recorded exemption is submitted, the accesses to both parcels be on Good Avenue and Coleman Avenue and not on County Road No. 31. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 22nd day of 780407 February, A.D. , 1978. The subject property is described as Tract 12 , Aristocrat Ranch- ettes, Second Filing, a subdivision of Weld County, Colorado. This property is located 1 mile east and 1 mile north of Ft . Lupton. The property in question contains approximately 2. 25 acres more or less. The request is to obtain a variance from the minimum lot size requirement , Section 9-4A. (6) , so that they may make application to apply for a Recorded Exemption . Section 9-4A. (6) states : "That the original tract or parcel of land to be divided under this section meets the minimum lot size require- ments established by the Weld County Zoning Resolution ; variance from this requirement being allowed only upon good cause being shown to the Board of County Commis- sioners or where said tract or parcel of land lies within the Comprehensive Plan area of an existing incor- porated town of Weld County. (Revised 4-17-74) . " If this lot size variance is granted, Mr. Manning, etal . will proceed with their application for a recorded exemption to divide the property into two lots. Both lots are proposed to contain approximately a little over one acre . Mr. Manning and his brother desire to construct a residence on each lot for their families. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services Staff recommends this request be approved for the following reasons : 1 . The request complies with the intent clause of the Recorded Exemption procedure in that non-productive agricultural land (Agricultural Zoned Subdivision) is proposed to be developed for residential uses which would be compatible with the Board of County Commissioners LSV-59, Marvin Manning, etal . The 24 acre parcel in question is part of an existing platted subdivision which has low utility for agricultural use due to the amount of acreage and the intent for residential develop- ment within the subdivision. 3.
