Conway, Chair Commissioner William F. Garcia, Pro-Tern Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Tom Parko Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: la I hereby certify that pursuant to a notice dated April 27, 2012, and duly published May 2, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of the Weld County Department of Public Works, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0008, for a 300-foot Telecommunication Antenna Tower in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. ID Tom Parko, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He stated staff did receive one letter of opposition prior to the Planning Commission hearing from Marty Matthews, marked Exhibit 1, as well as a telephone call from Mr. Matthews today at 8:45 a.m., expressing similar complaints regarding negative impacts to his view and health. Mr. Parko stated twelve referral agencies reviewed the proposal and five offered comments which have been addressed in the Conditions of Approval and Development Standards. He displayed photographs of the site and surrounding area, and in response to Chair Conway, Mr. Parko indicated the existing power lines pose a more significant impact to Mr. Matthews' line of sight than the proposed tower. He also displayed an aerial vicinity map depicting the fall zone, and explained the tower is designed to collapse, rather than topple sideways. Responding further to Chair Conway, Mr. Parko stated Mr. Matthews has cited his concerns based on internet research; however, he did not submit any formal documentation. C t CA, Pt, h, /,tz 7_/0-4a 2012-1425 PL2162 HEARING CERTIFICATION - WELD COUNTY DEPARTMENT OF PUBLIC WORKS (USR12-0008) PAGE 2 El Heidi Hansen, Department of Public Works, stated County Road (CR) 31 is classified as a collector status roadway which requires 80 feet of right-of-way at full buildout. She stated the average daily traffic count was approximately 860 vehicles, and staff has no traffic or water quality concerns with the proposed unmanned tower. ▪ Lauren Light, Department of Public Health and Environment, stated any employees that enter the site will have access to the restrooms in the nearby grader sheds or portable toilets. Regarding health impacts from communication towers and electrical lines, Ms. Light stated the health risk does decrease with distance; however, the World Health Organization findings indicate the use will not pose a health risk beyond what already exists with the power lines. ▪ Don Carroll, Department of Public Works, represented the applicant and stated the tower will be located on the site housing the Fort Lupton Grader Shed fueling station. He confirmed the County has gone through all of the standard requirements of review, and explained the tower will be located on four acres using an existing access, and the purpose is to enhance emergency services such as law enforcement, homeland security, and public services. He further stated there is a 200-foot fall zone; however, the tower is designed to collapse rather than fall over, and a fall zone easement has been signed by the adjacent property owner. Mr. Carroll stated the tower will comply with Federal Aviation Administration (FAA) and Federal Communications Commission (FCC) regulations; the site is not located within the Fort Lupton Intergovernmental Agreement area; and he did attempt to contact Mr. Matthews this morning and left a message. El In response to Commissioner Rademacher, Mr. Carroll confirmed there is a diesel generator in the equipment building, and the Fort Lupton Fire Protection District has requested "No Smoking" signs be posted. El No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Carroll stated he has reviewed, and the Department agrees to abide by, the Conditions of Approval and Development Standards, as proposed. El Commissioner Rademacher moved to approve the request of the Weld County Department of Public Works for a Site Specific Development Plan and Use by Special Review Permit, USR12-0008, a Site Specific Development Plan and Use By Special Review Permit for a 300-foot Telecommunication Antenna Tower in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously.
