HomeMy WebLinkAbout20120223.tiff RESOLUTION RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY • SPECIAL REVIEW PERMIT#1764 - RODNEY AND KAREN STEELY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on February 9, 2011, the Board approved the application of Rodney and Karen Steely, 20759 State Highway 392, Greeley, Colorado 80631, for a Site Specific Development Plan and Use by Special Review Permit#1764 for an Oil and Gas Support and Service (including parking and maintenance for a tank service company) in the A (Agricultural) Zone District, on the following described real estate, being more particularly described as follows: Lot A of Recorded Exemption #3779; being part of the SE1/4 of Section 16, Township 6 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services notified the applicant of outstanding Conditions of Approval and items to be completed prior to recording the plat, by letters dated August 5, September 27, and December 22, 2011, and WHEREAS, on the 23rd day of January, 2012, an Initial Hearing was held before the Board to consider granting additional time to meet all of the conditions/requirements of approval and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special Review Permit #1764 and Deny the application, and WHEREAS, at said hearing, Rodney and Karen Steely were not present, and WHEREAS, after hearing all testimony presented, the Board deemed it advisable to refer the matter back to the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the applicant has demonstrated a willingness and ability to complete the process and record the plat and the matter be, and hereby is, referred back to the Department of Planning Services staff. I received confirmation that all of the Health Department items have been completed. There was one item in regards to parking of vehicles and building permits: Your letter dated 8/1/2011 indicated that you would like to park trucks in the shop building on occasion. I spoke to our Building Inspector—Frank Piacentino—about this. He indicated that parking of vehicles associated with this business in the shop building would require a change-in-use building permit. Obviously no building permit would be required if you park the vehicles outside. I will shoot for having the plat ready by Friday or Monday. The plan is to have the plat ready for you to sign by Friday. If not, I will recommend that the Board of County Commissioners refer your case back to Planning staff which would mean no follow up hearings before the Board would be required. Here are my comments: Condition 1.A. regarding dust abatement has been met. Condition 1.B. regarding vehicle washing onsite, according to the applicant, the commercial vehicles are washed off-site at a commercial carwash; therefore, this condition has been met. Condition 1.C. regarding evaluating the existing septic system for the residence, which is permitted for up to 10 persons (5 bedrooms), the applicant stated that there are no office employees, and there are only 3 persons living in the house. In addition, there are up to 6 drivers that come to the site on a daily basis who must have access to sewer and water. Since there will be a maximum of 9 persons at the site on a daily basis, and the system is designed for up to 10 persons, the existing septic system does not need to be evaluated by a professional engineer at this time. Therefore, this condition has been met. (/Condition 1.D. regarding documentation from the North Weld County Water District indicating that there is sufficient capacity to serve the business, no documentation has been submitted to date. Therefore, this condition has not been met. (K. Condition 1.E. regarding waste handling plan. The waste handling plan needs to address clean up, removal and disposal of spilled chemicals (oils and other fluids, etc.).
