RE: GRANT CHANGE OF ZONE FROM A - AGRICULTURAL DISTRICT TO R -
RESIDENTIAL DISTRICT FOR EAST GREELEY LAND COMPANY, 1212

WHEREAS, the Board of County Commissioners of Weld County,
in Colorado, pursuant to Colorado statute and the Weld. County Home

Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and

cN WHEREAS, a public hearing was held on the 3rd day of May,
u 1978 at 2 : 00 o 'clock p.m. , for the purpose of hearing the petition
of East Greeley Land Company, 1212 8th Avenue, Greeley, Colorado.rc
80631, requesting a change of zone from A-Agricultural District to
R-Residential District for the following described parcel of land,
to-wit:
Beginning at the Southwest Corner of Section 10, Township
5 North, Range 66 West and considering the South line of
the Southwest Quarter (SWa) of said Section 10 to bear
North 88°08'30" East with all bearings contained herein
relative thereto. Thence North 61°53'04" East, 113.02
feet; Thence North 46°05'43" West, 69.71 feet; Thence
North 00°20'38" West, 1,222.48 feet to the True Point of
Beginning.

WHEREAS , representatives of the petitioner were present and
presented evidence on its behalf, and
WHEREAS, there was no opposition to the request of the
petitioner for a change of zone upon the aforementioned tract of
land, and
WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning
Resolution authorizes the Board of County Commissioners to grant
a change of zone upon the showing of the petitioner of certain
facts, and

I hereby certify that pursuant to a notice dated March 27, 1978
duly published March 30, 1978 and April 20, 1978 in the Fort
Lupton Press, a heating was held on the request of East Greeley
Land Company, C/0 Scott Realty Company, for a Change of Zone from
A-Agricultural to S-Scientific, Change of Zone from A-Agricultural to H-
High Density Residential, Change of Zone from S-Scientific to R-
Residential, A-Agricultural to R-Residential, and Preliminary Plan
for Hiland Knolls Subdivision. The applicant was represented by
Tom Norton. After discussion Commissioner Steinmark made a motion
to approve the Change of Zone from A to S on a parcel of land
containing 5.917 acres. Commissioner Roe seconded the motion and
it carried unanimously. Commissioner Steinmark made a motion to
approve the Change of Zone from A to H on a parcel of land
containing 3.743 acres. Commissioner Roe seconded the motion
and it carried unanimously. Commissioner Jacobucci made a motion
to approve the CRange of Zone from A to R on a parcel of land
containing 19.668 acres. Commissioner Carlson seconded the motion
and it carried unanimously. Mr. Norton reviewed and answered
questions regarding the Preliminary Plan for Hiland Knolls
Subdivision. After review Commissioner Steinmark made a motion
to accept the Planning Commissions favorable recommendation and
to approve said request. Commissioner Roe seconded the motion
and it carried unanimously.

1 . It is the opinion of the Planning Commission that the applicant
has complied with Section 8. 3 of the Weld County Zoning Resolution
which states : "Request for rezoning of tracts within Weld County
should be supported by detailed and substantial evidence that such
rezoning is necessary. Recent findings and oral statements by
petitioners should show very clearly that either the original
zoning was faulty or that changing conditions in the area now
justify a new classification . Without the presentation of such
supporting documentation , the County Planning Commission should
not recommend a change of zoning. " It is the opinion of the
Planning Commission that the applicant has demonstrated that
changing conditions in the area now justify a new zoning class-
ification . This determination is based , in part , on the fact that

since the approval of the original county zoning in May , 1962 ,
for this property and two subsequent zone changes in June
and December, 1968, conditions in the area have changed and
will continue to change as the City of Greeley ' s growth pattern
continues in a westerly direction toward this property . Sub-
stantial developments which have occurred in the immediate
area include Aims Community College located to the east of this
property and more recently construction has begun on the Greeley
Sports Center building directly south of this property.
2. The rezoning agrees with the policies contained within the
Weld County Comprehensive Plan in that the request is in com-
pliance with the City of Greeley ' s Comprehensive Plan .
{ 3. The City of Greeley Planning Commission has indicated they have
no objections to the proposed rezoning requests . The City
anticipates annexation of the area as soon as it becomes
eligible following the annexation of Aims Community College.
4. The Weld County Engineering Department has indicated there are
no engineering problems anticipated with this request .
5. The Weld County Health Department has indicated they have no
problems with this request if the applicant complies with the
stipulations as indicated in their letter dated March 8, 1978.
6 . The Western Hills Fire Protection District indicated they have
no objections to this request .

ANSWERS TO ZONING QUESTIONS
1 . It is impossible to develop the land according to current
agricultural zoning. Therefore , the request for zoning for
residential, high density, and scientific is required to
meet the development standards of Weld County.
2 . The proposed rezoning would benefit the County by allowing
additional residential development close to the City of
Greeley. The rezoned property, in fact, will be annexed
to the City of Greeley as soon as the Aims College property
is annexed allowing the necessary contiguous area require-
ment. Such a development could be developed in other parts
of the County. However, this one is in the present growth
pattern of the City of Greeley and the County.
3 . The proposed zoning would benefit adjoining lands because it
is the same as adjacent properties to the south and will
increase the value of the property to the west and north .
The development which would result from the zoning change
will provide additional housing close to the Aims College
Campus .
4 . The features that make it logical to rezone this tract are :
A . Easy access from 20th Street and 59th Avenue .
B. Development fits within the growth pattern of the City
of Greeley.
C . The tract has available City water and sewer service .
D . It might be logical to rezone similar properties sur-
rounding this property at some time in the future .
5 . The developer believes that even though other areas in the
County are already rezoned for residential use , additional
residential housing is necessary. There are no other
Scientific-zoned properties within the County. Therefore ,
the additional Scientific zoning is needed . Also, there
is very little High Density zoning within the County which
shows the need for this zoning in addition to the transi-
tional zoning from Scientific to Residential .
6 . The original zoning was not faulty, but the growth of the
City of Greeley to the west makes it desirable to change
this zoning from Agricultural to Residential, High Density,
and Scientific at this time to facilitate Greeley ' s growth.

SUMMARY STATEMENT OF HILAND KNOLLS DEVELOPMENT
The proposed development is located in the Southwest Quarter
(SW±) of Section 10, Township 5 North, Range 66 West, and
consists of 54 .953 acres of which 20 .427 will be Residential
zoned ; 3 .743 will be High Density zoned ; leaving 30 . 783 acres
Scientific zoned . The zoning request and preliminary plat
and utility plan are included as a part of the application .
The drainage plan for the development will be to provide
surface drainage in the High Density and Residential areas to
a holding facility on the center-west side of the property
for slow release to a natural drainage which will eventually
outlet to sheep draw in the Poudre River. Preliminary
drainage calculations are attached and show the amount of
holding capacity required in accordance with City of Greeley
standards . The drainage plan for the Scientific area is to
require retainage of onsite drainage for each lot as developed
and in accordance with the type of land cover and size of
building which will be constructed on these lots . The onsite
retained water will be released through the street plan or
drainage easements to the holding pond designated for the
Residential and High Density areas .
Water and sewer facilities will be provided from the City of
Greeley with the exception of the necessary distribution and
collection lines which will be the developer' s responsibility.
In addition, a lift station will be required to provide
sewage service to the lower part of the property in Blocks 1
and 6 .
The water use is estimated as an average daily use to be
38 , 850 gallons per day Residential ; 28, 000 gallons per day
High Density; 82 , 600 gallons per day Scientific . The sewer
flows have been estimated as an average daily flow of 25 , 900
gallons per day Residential ; 19 , 200 gallons per day High
Density; 41 , 325 gallons per day Scientific .
The other utilities which are anticipated on this development
are Greeley Gas Company, Home Light & Power Company, and
Mountain Bell . It should also be pointed out that the sewer
service for the City of Greeley will be through the Highland
Hills Sanitation District and the lift station owned by this
District, which is located in the Scientific-zoned area, and
their force main and outfall line will be utilized to the
point where it connects with the present Greeley system.
The proposed number of lots is 74 Residential ; 8 High Density ;
and 8 Scientific . The summary of lot locations and proposed

areas is shown on the preliminary plat. The developer is
requesting that the density of eight units per lot be allowed
on the High Density/Residential area. A variation from the
County standards which is requested is that a five foot side
yard be allowed in the Residential area as opposed to the ten
foot requirement of the County. This request is due to the
fact that a five foot side yard is allowed in the City of
Greeley and is in accordance with their standards . This
property will be annexed to the City of Greeley within one to
two years, so it would seem logical to allow this variation.
A detailed soils and geology report is submitted as part of
this application and should answer any questions which arise
in that regard . Also, an Administrative Review has been con-
ducted by the City of Greeley and we are attaching a copy of
that review for your information.

Staff reviewed the rezoning and subdivision plans at a previous
A . R .T. meeting and Mr . Norton had incorporated the suggestions
at that time into the plans now on referral from the County .
Max Karner commented that the drainage reports arc acceptable ,
and that the plans show the requested drainage easement of 20
feet located in the northeast corner of the property . Mr . Karner
also noted that the City will not accept the drainage pond until
annexation . Max Karner also commented that the soils report.
shows some conditions that would suggest that streets he designed
with a capacity for heavy loads , associated with uses permitted
in the scientific zone . He said that his office would supply
design criteria and estimated traffic loads . Darryl Alleman
commented that the project would be on the Highland Hills Sanita-
tion District . He suggested that the two lift stations proposed
for the development he consolidated into one station to be located
at 59th Avenue . This lift station would he designed and located
to fit in with the master plan for the area .
Mr . Norton commented that a total right -of-way dedication on
20th Street and 59th Avenue of 59 feet has already been made .

John Given , Planning Department , asked whether Mr . Norton felt
that the lot depth for the high. density lots , which buffer the
scientific none from the residential zone , arc adequate . lie
noted other situations where R- 3 lots having minimum depths of
80- 95 feet did not provide adequate space for building setback
and parking . The effect of this could he two and three story
❑partment huildin+'s located 20 feet from the hack fence of single
family lots . Mr . Norton explained that he had recognized the
problem and that the lots had been widened as much as possible .
He also noted that the eight units per lot requested in the
zoning_ application would most likely apply as a maximum density for
only a couple of the proposed lots . He noted that it is likely
that many of the lots will he developed with densities no greater
than two or three units per lot .

Tom Norton presented plans for zoning and subdivision of property
located in the County west of Aims College and north of 20th Street .
The large portion of the property located at 20th Street and 59th
Avenue is currently zoned scientific , and the proposal would he to
add 5 - 10 acres of additional scientific zoning* to the north of
the existin" area . .1n east-west street intersecting 59th Avenue
would then senarate the scientific zone from the proposed R- 3 zone
approximately one lot in denth and then an R- 1 zone for the remain-
ing Portion of the nronerty . The residential zoning would rewire
a change from the existing agricultural zone . The development of
this scientific zone is largely undetermined ; however , it would he
governed by restrictions that are more restrictive than commercial
zones in the County.
Typically , the scientific zone ,nermits recreation facilities and
manufacturing operations which are completely enclosed . The Greeley
Sporting Center is planned For a Parcel in the scientific zone and
an casement of approximately 88 feet running north- south through
both the residential and scientific zones . •There are two water lines ,
a sewer line , and a gas line .
Max Rayner noted thar the proposed detention facility in the north-
west corner of the scientific zone would have to he dedicated to the
nublie . He requested that Plans he -deael , ncd to transport water
from the northeast corner of the residential area to the pond on
the Highland Hills Golf Course .
Tom Norton commented that this could he accommodated in the nronosed
street which runs from the northeast corner southward to 20th Street .
In a discussion of streets , Tom .Norton noted that the outer boundary
of the proposed development includes the 5(l foot dedication at 20th
Street and 59th Avenue for arterial development .
Max Earner commented that he sees no severe site distance problems ,
with access onto 20th Street approximately 335 feet from the crest
of the hill .
Sam Sasaki rcuuested that the street that is promised to run parallel
to 59th Avenue IIirourli the si icutI Iic and residential areas he
reconsidered. Potentially this street Could run parallel all the way

Tenth Street and would provide an alternative route through
residential neighborhoods for non- local traffic . It was decided
that that portion of the street that runs through the scientific
zone could he eliminated and this would relieve any notential
Problems .
The Planning Staff suggested that multi - family zoning he considered
for all of those lots fronting on the street which hullers
the scientific from the residential zones . These would include
Lots 9 , 10 , 10 of Block 6 ; 9 F, 10 of Block 5 ; 6 , 7 , 8 , 9 , ; 10
of Block 3 , and possibly lots located in Block 2 .
