SUBJECT: USR12-0045, Cunningham—C&H Excavation
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
WCR 33 is a collector road and requires an 80-foot right-of-way at full build out. There is presently a 60-
foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the
Weld County Zoning(23-1-90),the required setback is measured from the future right-of-way line.
The applicant will use the existing access to the property as approved by Access Permit#AP11-00133.
No additional accesses will be granted. Please show the existing access on the Plat and label it with the
Access Permit number.
The applicant estimates that there will be approximately 36 employees coming to the site each day and 6
delivery trucks of materials per week.
There shall be no parking or staging of vehicles on CR 70.
An Improvements and Road Maintenance Agreement is required for this site. Public Works will provide a
draft of the Agreement after the Board of County Commissioners hearing for this project. The
Improvements Agreement will include access improvements consisting of 60' turning radiuses to
accommodate turning trucks and double cattle guards across the access to prevent tracking of mud and
debris onto the paved roadway (alternately, the access could be surfaced with recycled asphalt). The
agreement and form of collateral (if collateral is required as a condition prior to recording the plat) shall be
reviewed by County Staff and accepted by the Board of County Commissioners prior to recording the Use
by Special Review plat.
A Water Quality Feature has been designed for this site and is acceptable. The Water Quality Area is
shown on the site plan. Please label the water quality area as'Water Quality—No Build or Storage Area"
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency(FEMA).
REQUIREMENTS:
1. Add the following conditions of approval to the plat:
a. Show and label the approved access points on the Plat(AP11-00133).
b. An Improvements and Road Maintenance Agreement is required for this site. Access
improvements shall include 60' turning radiuses and double cattle guards to prevent the
tracking of mud onto the County roadway. Additional improvements will be required if
tracking occurs or if trucking numbers increase. The agreement and form of collateral (if
collateral is required as a condition prior to recording the plat) shall be reviewed by

2. Add the following development standards to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. There shall be no parking or staging of vehicles on CR 70.

Environmental Health Services has reviewed this proposal for an oil and gas support
service business. The business manufactures equipment for use in oil and gas
operations, such as crossover stairs and water tanks. The application indicates that
there will be eighteen people per shift, two shifts, who will use the site for a total of 36
employees.
There is an existing individual sewage disposal system (Permit#G19820005) located
on the property. According to this Departments records, the septic system was sized for
6 persons. A new septic system will be designed and permitted to accommodate the
increase in hydraulic flow.
The site is currently served by an individual well (Permit#260453) and is limited to
drinking and sanitary uses for a commercial business.
The application states that office and employee waste will be stored in commercial
containers and serviced by Waste Management. Scrap metal will be taken to Anderson
Salvage. Painting will not occur on site but at the applicant's facility in Ault.
The dust abatement plan states the drive is recycled concrete. If dust is created the
applicant will either apply water or magnesium chloride.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. In the event the applicant intends to utilize the existing septic system for business
use, the septic system shall be reviewed by a Colorado Registered Professional
Engineer. The review shall consist of observation of the system and a technical
review describing the system's ability to handle the proposed hydraulic load. The
review shall be submitted to the Environmental Health Services Division of the
Weld County Department of Public Health and Environment. In the event the
system is found to be inadequately sized or constructed the system shall be
brought into compliance with current Regulations. Alternately, a new septic
system can be installed for business use.
We recommend that the following requirements be incorporated into the permit as
development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. This facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in Section 14-9-30 of the Weld County Code.
7. Any vehicle or equipment washing areas shall capture all effluent and prevent
discharges in accordance with the Rules and Regulations of the Water Quality
Control Commission, and the Environmental Protection Agency.
8. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
9. Adequate drinking, handwashing and toilet facilities shall be provided, at all
times.

10.Sewage disposal for the facility shall be by septic system. Any septic system
located on the property must comply with all provisions of the Weld County Code,
pertaining to Individual Sewage Disposal Systems.
11.A permanent, adequate water supply shall be provided for drinking and sanitary
purposes. (well permit 260453)
12.This application is proposing a well as its source of water. The applicant should
be made aware that while they may be able to obtain a well permit from the
Office of the State Engineer, Division of Water Resources, the quantity of water
available for usage may be limited to specific uses, i.e. inside commercial use
only, etc. Also, the applicant should be made aware that groundwater may not
meet all drinking water standards as defined by the Colorado Department of
Public Health and Environment. We strongly encourage the applicant to test
their drinking water prior to consumption and periodically test it over time.
13.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Subject: USR12-0045 Referral
Upon review of my case files and computer, an active Zoning Violation(ZCV11-00013)was noted. This
violation was initiated due to the operation of an oil & gas support services business without first
completing the necessary Weld County Zoning Permits. The applicant was made aware prior to his
occupancy of this property that a Use by Special Review (USR) permit would be required, see Pre-
Application minutes(PRE11-0064)from November of 2011 and assured staff that he would permit the site
prior to his occupancy; however, this did not occur. Since Mr. Simpson has ensured submittal of the
required applications(even though on multiple occasions at the last minute prior to the commencement of
legal action),this case has not been presented to the Weld County Court Magistrate through the Violation
Hearing process. However, since this is an active violation, an investigation fee is required.
Due to records release laws, staff no longer tracks complainant information. However,please be advised
that I have and continue to receive multiple complaints from various neighbors regarding this operation.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct the violation. If this application is denied,all commercial vehicles and associated activities and/or
storage shall be removed from the property within 30(thirty)days of denial or the violation will proceed in
court accordingly, for the sake of the neighbors, no additional extensions will be granted by staff.

After reviewing the application and documents submitted the Building Department has the following
comments:
A building permit will be required for any new construction, alteration, or addition to any buildings or
structures on the property. It is required that a code analysis be done on the project by a design
professional with experience in this area. A building permit application must be completed and two
complete sets of engineered plans including engineered foundation plans bearing the wet stamp of a
Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report
performed by a registered State of Colorado engineer shall be required or a open hole inspection..
The structures proposed to have changes uses will require commercial building permit for change of use.
A code analysis, floor plan a complete set of plans for any alteration and a structural analysis by a
professional engineer will be required.
Buildings and structures shall conform to the requirements of the various codes adopted at the time of
permit application. Currently the following has been adopted by Weld County: 2006 International Building
Code; 2006 International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy
Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility
Code and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

Dear Mr. Gathman:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the water
supply plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable water
supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
The applicant is proposing to use a 3.5-acre parcel as an equipment manufacturing facility to
fabricate oilfield equipment for existing oil and gas businesses. There will be approximately 18
employees at the site per shift, with two shifts per day. The proposed water supply for the site is an
existing well permitted under well permit no. 286516. Well permit no. 286516 authorizes the use of
ground water from the well in drinking and sanitary facilities for a commercial business. Water from this
well may not be used outside the business structure(s)for irrigation or any other purpose. The well
may withdraw up to 1/3 of an acre-foot (108,600 gallons) of water per year for commercial drinking and
sanitary purposes.
So long as the use of the existing well complies with the terms and conditions of permit no.
286516, this office has no objection to the subject proposal. Should you have any questions, please
