Everist, Inc . , I will respond to the remaining adequacy review item that we did not address in your May 30 , 2012 adequacy review letter . That was a request for data and analysis of the monitoring well information of the existing well on the mine site listed under the heading Exhibit G - Water Information (Rule 6.4. 7) . The attached text , tables and graphs contain the information we have compiled from the raw data L.G. Everist, Inc . has collected since 2004 . The rest of the adequacy items were addressed in my response letter dated June 20 , 2012 and was also incorporated into the most recent revision to the Amendment when the Sandstead parcel was added in July 2012 . This should do it for the current adequacy responses we needed to complete . The public comment period on this most recent change ended on September 11 , 2012 so I have also attached copies of the Second - Proof of Publications and copies of the return receipts for the additional adjoining owner notices sent . Just in case I forgot to mail you a copy of the Office of the State Engineer Slurry Wall Certification for the eastern reservoir covering the stages called Meadows North Lake & Meadows South Lake then I have included a copy for your file ENVIRONMENT, INC. Fort Lupton Sand and Gravel Mine, M-1999-120 Adequacy Response September 2012 EXHIBIT G, WATER INFORMATION - ADDENDUM Groundwater Monitoring Data Analysis This Groundwater Monitoring Data Analysis is in response to the comments posed in Mr. Eric Scott' s permit amendment review letter, dated May 29, 2012 . Mr. Scott' s comments on Exhibit G are quoted in their entirety (underline added) for reference, below: EXHIBIT G-Water Information (Rule 6.4.7): DRMS agrees that groundwater issues are often complex interactions between a variety of factors; however, deviations from standard DBMS practice (such as the 2- foot trigger levels) must be based on defensible groundwater monitoring data and not speculation and/or circumstantial factors. The narrative provided also refers to wells such as "monitoring wells 9 and 10"but Figure G-2 does not identify any wells with these names. Please provide an updated Figure G-2 that depicts all existing and proposed monitoring well locations for this site with identifiers that correspond to the data collected from them. Well construction diagrams and a summary of historical data should also be provided for existing monitoring wells. When are the new monitoring wells going to be installed? This site is anticipated to, for all practical purposes;seal off approximately one mile of alluvial groundwater access to the west bank of the South Platte River. Relying on existing season surface water diversions to maintain groundwater levels at current elevations is not an acceptable solution, especially as the depths of these diversions relative to the existing ground surface has not been provided. The Division will require substantial monitoring of groundwater levels along the south, west and north borders of the site and a proposal to mitigate any groundwater mounding/shadowing observed - including detailed corrective measures such as the installation of control structures such as French drains/sumps. Please provide the Division with a more specific proposal to monitor and maintain the prevailing hydraulic conditions based on historic data for the site. The only remaining request from Mr. Scott' s letter to be addressed is the "summary of historical data for existing monitoring wells. " All of the other requests in Mr. Scott' s letter were previously addressed in the revised amendment application submittal of July-2012 . (This revised submittal included the Sandstead property. ) The Groundwater Monitoring Data Analysis, including the tables, and graphs were prepared using data collected by L.G. Everist, Inc . from May-2004 through June-2012 for 14 monitoring wells (piezometers) that surround the Fort Lupton Sand and Gravel Mine, including the Lupton Meadows Reservoir properties . Map Exhibit G-3, "Groundwater Monitoring Wells For Analysis of Data" is attached which shows only the locations of the piezometers listed in the tables and graphs in this Groundwater Monitoring Data Analysis . The wells are: MW 2 , MW 3 , MW 4, MW 5 , MW 6, MW 7, MW 8, MW 9, MW 10, MW 11, MW 12, MW 13 , MW 15, MW 16 . Data from monitoring wells MW 1 and MW 14 are not used because MW 1 (which was located along the northern boundary of the Funakoshi property) was destroyed when a gas/oil pipeline was placed in its path, and MW 14 was covered when a roadway was installed to the scalehouse. Monitoring Wells MW 2 through MW 7 are located up-gradient from the mining operations, generally located to the south and west side of the current mining operations . Monitoring Wells MW 8 through MW 12 and MW 15 are in the area that would be down-gradient from the mining operations, and are generally located to the north and east of the F L-D R MS-GroundwaterAnalys i s-Sep2012.do c L.G. Monitoring Wells MW 13 and MW 16 are between the South Platte River and the lined and sealed Golden Reservoir. Please see the attached Map Exhibit G-3 for exact well locations and waterways that cross and surround L.G. Everist' s mine site. In March 2012, an additional 27 monitoring wells were drilled around and within the new permit boundaries (including the amendment areas) . The data from these wells have not been included in this analysis because there are not enough points to establish any cyclic patterns. Many of the new wells were installed in the area up-gradient from the first round of slurry wall installations . Map Exhibit G-2 (in July- 2012 revised submittal) shows the locations of all the existing monitoring wells . L.G. Everist will continue to take readings from existing groundwater monitoring wells throughout the life of the mine to maintain a current record of data on any groundwater fluctuations . For more details on on-going monitoring and any mitigation measures, please see Exhibit G (in July-2012 revised submittal) . The Groundwater Elevations Table shows the data collected on a monthly basis converted to an elevation instead of a depth. The red numbers represent a break in the collection dates and are therefore interpolated for that month. This usually occurred when it was not possible to collect the data for that well . The interpolation was done by adding the two closest months for the monitoring well and then dividing by 2 for the sloped average. This is done to keep as much line continuity on the corresponding graphs as possible. The Three Month Averages Table was compiled by taking the raw data from the Groundwater Elevations Table, adding three (3) months of data together and dividing by the number of data points in those three (3) months to create the 3-month averages . This data analysis takes into account any missing collection dates, so in some cases there may be only one (1) or two (2) months of data for the 3-month average. The Groundwater Monitoring Well Graphs use the data from each monitoring well column in the Groundwater Elevations table. Each well has its own graph. The blue line is the actual well data points, and the vertical green lines separate the years . Each graph also has surface and bedrock elevation information for the well and additional relevant location and timing notes . Each graph also has labeled arrows showing when slurry walls within the mine complex were completed. These labeled arrows are for reference purposes only since the slurry walls may be so distant from the monitoring well as to have no impact on the groundwater levels within the wells . Groundwater Monitoring Data Analysis Summary In general, the data shows a cyclic or seasonal change of the groundwater table that is repeated yearly where the groundwater is lowest in May and highest in August. While groundwater level changes are different from well to well, the seasonal patterns are repeated in F L-D R MS-G rou ndwaterAna Iysi s-S ep2012.doc L.G. Everist, Inc. This cycle is created when multiple outside influences reach the monitoring wells, including: seasonal irrigation water and return flows used on up-gradient fields, yearly runoff/snowmelt increasing the volume of the South Platte River and groundwater flows, and ditch companies dumping excess water into Little Dry Creek/Slate Ditch. The cyclic high points generally have a 6-month lag from the beginning of irrigation season. The 3-month running average fluctuations in the current data are within the currently permitted 2-foot trigger point from month-to- month for the overwhelming majority of data. Review of the data in the Three Month Averages table shows there have been only fifteen (15) times when the 2-foot decrease have been exceeded over almost nine (9) years . Seven (7) of those excesses were in MW 8, which had the largest decrease of 4 . 87 feet. In all cases, the larger decreases have been isolated to one or two 3-month periods and correspond with some outside event particular to the immediate vicinity of the monitoring well . Although it is not part of our required trigger-monitoring, there were only twenty-three (23) instances of more than 2-foot increases . Many fluctuations took place during a time when the adjoining fields were being flood-irrigated for vegetables . In 2011, the 3-month-averages of April-May-June-2011 through September-October-November-2011, there were ten (10) instances of over 2-foot increases in various wells. This time period was during irrigation season, and there was also flooding in the South Platte River and Little Dry Creek/Slate Ditch. These outside influences made a large impact on the groundwater table. Monitoring Well MW 8 has had the largest decrease and increase of any of the monitoring wells . This well is at the northern boundary of the Swingle-North area, just the south side of CR 18 . The higher fluctuations in this well can be attributed to both the dewatering practices of the unlined aggregate pit and the irrigation return-flow ditches just on the north side of CR 18 . Conclusion With all the outside environmental influences - including all the waterways that cross and surround the mine, pumping/irrigation changes, and weather fluctuations from drought to flood - L.G. Everist can conclude through this groundwater monitoring data analysis that the mining operations and slurry walls have not made a significant (if any) impact on the groundwater levels of surrounding properties . The Fort Lupton mine is surrounded and divided by surface water corridors and planned groundwater corridors. The surface water corridors include the South Platte River, the Lupton Bottoms Ditch West Lateral, the Lupton Bottoms Ditch East Lateral, Little Dry Creek/Slate Ditch, and multiple irrigation return-flow ditches (see Map Exhibit G-3) . Additional groundwater corridors have been planned and are being created by L.G. Everist to maintain the groundwater balance throughout the entire area. Fort Lupton Sand and Gravel Mine, M-1999-120 Adequacy Response September 2012 gas easements, other utility easements, and undisturbed setback areas (see Exhibit F, Reclamation Plan Map in July-2012 revised submittal) . The monitoring data shows that groundwater levels in the monitoring wells are staying seasonally consistent over the years . The seasonal changes are cyclical and can be accounted for with irrigation and snow-melt flows . These seasonal cycles are seen in all up-gradient and down-gradient wells. As mentioned previously, L.G. Everist will continue to monitor groundwater levels on a monthly basis throughout the life of the mine. L.G. Everist would like to propose adjusting the trigger factor from a 2-foot decrease to a 4-foot decrease, since under normal cyclical conditions the natural fluctuations have sometimes been that high in a 3-month-average period.
