RESOLUTION RE: APPROVE FOUR LOT RECORDED EXEMPTION #4972 - BRAD AND ROBIN GUTKNECHT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on November 20, 2009, the Department of Planning Services administratively approved the request of Brad and Robin Gutknecht, 11105 west Center Avenue, Lakewood, Colorado 80226, for Four Lot Recorded Exemption #4972, to divide the property into parcels estimated to be approximately 152 acres, 2.6 acres, 2.6 acres, and 2.6 acres,for property which is located on the following described real estate, to-wit: Lot C of Recorded Exemption#2773, being a part of the NE1/4 of Section 9, Township 1 North, Range 65 West of the 6th P.M., Weld County, Colorado WHEREAS, the Department of Planning Services staff notified the applicant, by certified letters dated April 4, and May 5, 2011, that certain outstanding Conditions of Approval had not been completed and that the matter would be scheduled for a hearing before the Board of Weld County Commissioners unless written documentation was received requesting a withdrawal of the case,or the outstanding items were completed and the mylar plat recorded, and WHEREAS, after reviewing Department of Planning Service's concerns and hearing the testimony presented, the Board determined that said request shall be continued from June 13,2011, until July 18, 2011, from July 18, 2011, until February 6, 2012, from February 6, 2012, until March 12, 2012, and then from March 12, 2012, until April 11, 2012, to allow the applicant additional time to complete the remaining Conditions of Approval and record the mylar plat. WHEREAS, after reviewing the matter and hearing the testimony presented on April 11, 2012, the Board determined that the matter shall be referred back to staff, to allow the applicant additional time to complete the remaining Conditions of Approval and record the mylar plat. (The legal description is Part NE4 Section 9, T1 N, R65 of the 6th P.M.; Situs Address is 20864 CR 12) Background Information: The applicant has applied for a 4-lot Recorded Exemption on the subject property and has not been completed, including the recording the plat. The pipe welding fabrication business, tentatively identified as a Roust-a-bout operation, including the field fabrication of gas pipe, predominately. The property owner believes there are up to 12 employees on site with 5 employees being permanently on site during the day. The remaining employees will come and go throughout the day. The work is done in a self-contained welding truck. There is an unpermitted —GE Modular construction trailer type, mobile home used as an office. Building Department A building permit will be required for the mobile home. Health Department Water is provided by the Town of Hudson. The applicant would like to use portable toilets; however according to Department policy portable toilets are allowed for temporary use, six months or less. Staff directed the applicant to visit with the Health Department regarding further requirements. A Waste Handling Plan is required. A narrative estimating the number of vehicles per day as well as a description of the vehicles accessing the site will be required. The site is not located in a designated FEMA floodplain. No Drainage Report is required; however the applicant shall provide a short description of the historic stormwater flows across the property and how their application will affect those flows. The description shall include but not be limited to: 1) where the water originates if it flows onto the property from an offsite source, 2)where it flows to as it leaves the property, 3)the direction of flow across the property, and 4) if there have been previous drainage problems with the property. The application shall also provide flow arrows on the map showing where the stormwater starts, how it goes across the property, and where it leaves the property. The applicant will still be responsible for providing a water quality feature that conforms to the methodology outlined in Volume 3, Section 4.4.2 of the Urban Storm Drainage Criteria manual. Planning Department The existing office trailer will need a land use permit in addition to the building permit. Additional impact fees will be applied at time of building permit such as Road Impact, County Facilities, and Drainage fees. Weld County has an Intergovernmental Agreement (IGA) with the Town of Hudson. A Notice of Inquiry will be completed and delivered to the Town of Hudson. Outdoor storage is required to be screened from adjacent property and public right-of-ways. A 6 foot minimum high opaque fence is required. The USR boundary is required to meet property lines. An option was to move one of the proposed RE lots to this site and then the USR boundary would only encumber this property. Staff urged the applicant to contact staff for any questions: Planner On Call available Monday through Friday 7:30 a.m. to 4:30 p.m. The USR application fee is$2500. Staff explained the USR process. The applicant shall submit 4 packets for a 7 day completeness review. After the 7 day completeness review the applicant will be informed of what items are still required to make the application complete. Staff requested that the applicant submit the remaining material in electronic form. Upon submittal of a completed application it will be sent out for referral for 28 days. The applicant will then meet with their Planner to discuss the referrals and address as many of the referrals as possible. At that meeting the Planning Commission hearing will be scheduled. The Board of County Commissioners hearing typically follows approximately 3 weeks after the Planning Commission hearing. The above notes are provided as a courtesy to the applicant. (Ordinance 2002-11) 11) Effective August 1, 2005, Building permits issued on the subject site will be required to adhere to the fee structure of the Capital Expansion Impact Fee and the Stormwater/Drainage Impact Fee. (Ordinance 2005-8 Section 5-8-40) 12) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive agricultural counties in the United States, typically ranking in the top ten counties in the country in total market value of agricultural products sold. The rural areas of Weld County may be open and spacious, but they are intensively used for agriculture. Persons moving into a rural area must recognize and accept there are drawbacks, including conflicts with long-standing agricultural practices and a lower level of services than in town. Along with the drawbacks come the incentives which attract urban dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise and congestion, and the rural atmosphere and way of life. Without neighboring farms, those features which attract urban dwellers to rural Weld County would quickly be gone forever. Agricultural users of the land should not be expected to change their long- established agricultural practices to accommodate the intrusions of urban users into a rural area. Well-run agricultural activities will generate off-site impacts, including noise from tractors and equipment; slow-moving farm vehicles on rural roads; dust from animal pens, field work, harvest and gravel roads; odor from animal confinement, silage and manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides and fertilizers in the fields, including the use of aerial spraying. It is common practice for agricultural producers to utilize an accumulation of agricultural machinery and supplies to assist in their agricultural operations. A concentration of miscellaneous agricultural materials often produces a visual disparity between rural and urban areas of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall not be found to be a public or private nuisance if the agricultural operation alleged to be a nuisance employs methods or practices that are commonly or reasonably associated with agricultural production. Water has been, and continues to be, the lifeline for the agricultural community. It is unrealistic to assume that ditches and reservoirs may simply be moved "out of the way" of residential development. When moving to the County, property owners and residents must realize they cannot take water from irrigation ditches, lakes, or other structures, unless they have an adjudicated right to the water. Weld County covers a land area of approximately four thousand (4,000) square miles in size (twice the size of the State of Delaware) with more than three 5 401 thousand seven hundred (3,700) miles of state and County roads outside of municipalities. The sheer magnitude of the area to be served stretches available resources. Law enforcement is based on responses to complaints more than on patrols of the County, and the distances which must be traveled may delay all emergency responses, including law enforcement, ambulance, and fire. Fire protection is usually provided by volunteers who must leave their jobs and families to respond to emergencies. County gravel roads, no matter how often they are bladed, will not provide the same kind of surface expected from a paved road. Snow removal priorities mean that roads from subdivisions to arterials may not be cleared for several days after a major snowstorm. Services in rural areas, in many cases, will not be equivalent to municipal services. Rural dwellers must, by necessity, be more self-sufficient than urban dwellers. People are exposed to different hazards in the County than in an urban or suburban setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical power for pumps and center pivot operations, high speed traffic, sand burs, puncture vines, territorial farm dogs and livestock, and open burning present real threats. Controlling children's activities is important, not only for their safety, but also for the protection of the farmer's livelihood. 4. The applicant shall submit three (3) paper copies of the plat for preliminary approval to the Weld County Department of Planning Services. Upon approval of the paper copies the applicant shall submit a Mylar plat along with all other documentation required as conditions of approval. The Mylar plat shall be recorded in the office of the Weld County Clerk and Recorder by Department of Planning Services Staff. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County Code. Proposed Lots A, B and C will each be 2.55 acres in size, proposed lot D will be 152 acres in size. There are existing residences on proposed Lots A, B and C which are served by Town of Hudson water and individual sewage disposal systems. This office has septic permits on file for one mobile home (SE-0000078) and a brick house (SE-0000079). There is not a permit on file for the second mobile home. The applicant shall provide a drawing indicating the correct lot identification (lots A, B, C and D) and the associated septic permit for each lot. Any existing septic system which is not currently permitted through the Weld County Department of Public Health & Environment will require an I.S.D.S. Evaluation prior to the issuance of the required septic permit. In the event the system is found to be inadequate, the system must be brought into compliance with current I.S.D.S. regulations. Proposed Lot D contains the Hudson Nursery; however it is not clear from the application if there are sanitary facilities located on site for employees. This Department does have a septic permit for a commercial office (G19860009) which indicates there is an individual well associated with the office. A water bill was submitted which indicates the Town of Hudson does provide water for Hudson Nursery. There was not any documentation provided that indicates the other three lots can be provided water from the Town of Hudson. The following conditions are recommended to be part of any approval: 1. A Weld County Septic Permit is required for any proposed homes septic systems and shall be installed according to the Weld County Individual Sewage Disposal Regulations. Please note, the lot owners shall verify with the nearest Town/City or Sanitation District to determine the location of the nearest sewer line. In accordance with the Weld County Code, if a sewer line exists within 400 feet of the property and the sewer provider is willing to serve the proposed structure, a septic permit cannot be granted by the Weld County Department of Public Health and Environment. 2. All septic systems located on the property shall have appropriate permits from the Weld County Department of Public Health & Environment. The Weld County Department of Public Health & Environment was unable to locate a septic permit for one of the mobile homes. The applicant shall identify which mobile home is not permitted. The applicant, Brad Gutknecht, was in attendance. The referral is for a 4-lot recorded exemption for property located within the Town's growth management area. Although recorded exemptions are specifically exempted from the annexation referral terms of our growth management IGA, there are specific concerns that we ask the County to consider in its review of this case. The four structures on this property are served by the municipal water system through a 2"water line in Main Street (CR12). There is a single water meter, although they are billed for 4 services. Dividing the property would make it eligible for sale of individual lots. This would trigger the need for individual water services, meters, tap fees and water rights dedications. Providing additional water taps outside of the town boundaries is considered by the Town on a case-by-case basis. There is no assurance that the Town would continue to provide service to separate owners. And the 2" line to this property is not sufficient to provide for fire protection in the event that there is additional development on the property. One of the new 2.5 acre lots appears to be landlocked, and does not adjoin a public street. Haphazard division of land within the Town's growth area only presents difficulty in the future for providing municipal services and hampers the ability to develop property in a reasonable manner. Although recorded exemptions, individually,represent a small increment of the total housing stock,the cumulative effect of several such approvals is exerting a considerable negative effect upon the school district's ability to provide adequate educational opportunities for the resulting students. Additionally, the substantial separation of these units from other more densely populated areas increases school transportation costs,further eroding the amount of funds that can be applied in the classroom toward educating the students. If approved,it is requested that this amount be paid to the school district as a cash-in-lieu of land dedication for each new unit allowed(Lot C). Recommendations The Board of Education remains very concerned about the recent trend toward accelerated residential activity throughout the district and the ensuing enrollment that will follow,as well as the district's physical and financial ability to serve that growth. Approval of additional residential development without a ready and identified means of providing appropriate infrastructure would not demonstrate good stewardship of the public trust. As stated before, cash-in-lieu of land of S 1,232.00 is requested for each single-family housing unit. Therefore, the total due to Weld County School District RE-3J is$1,232.00 for Lot C. Without such mitigation, the district will recommend that the application be denied.
