Tri-State Generation and Transmission Association
The Weld County Public Works Department reviewed the submitted application for critical items,
including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical
Soils Report, and Flood Hazard Development Permit. A detailed review of these items was not
completed at this step in the process. Comments made during this stage of the review process
will not be all inclusive; as revised materials are submitted, other concerns or issues may arise.
All issues of concern and critical issues during further review must be resolved with the Public
Works Department.
COMMENTS:
Tri-State Generation and Transmission Association is proposing a 115-kV substation and an
approximately 1.5 mile long 115-kV transmission line to connect the XCEL Hudson—Fort Lupton
transmission line into the proposed substation.
Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011)
CR 22 is an arterial road, which requires a 140-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured
from the future right-of-way line. The applicant shall delineate or dedicate an additional 40-foot
of right-of-way parallel to the CR 22 right-of-way for full build-out.
REQUIREMENTS:
Access: Access shall be shared with the Lancaster Plant site located off of CR 22.
Show the approved shared access point on the plat and label it with the approved access permit
number (AP#).
Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt,
recycled asphalt, concrete or the equivalent and shall be graded to prevent drainage problems.
The applicant shall indicate specifically on the plat the type of right-of-way/easement and
indicate whether it is dedicated, private, or deeded to provide adequate access to the parcel.

1. In the event that 1 or more acres are disturbed during the construction and development
of this site, the applicant shall obtain a stormwater discharge permit from the Water
Quality Control Division of the Colorado Department of Public Health and Environment.
2. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start
of construction. The grading permit application must contain: an erosion and sediment
control plan, a grading plan, installation details of all BMPs to be utilized, typical
installation and maintenance notes for all BMPs to be utilized, and a copy of the
approved CDPHE stormwater permit.
3. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
4. The applicant must take into consideration storm water capture/quantity and provide
accordingly for best management practices.
5. Weld County shall not be responsible for the maintenance of on-site drainage related
features.
Transmission Line Easement: The right-of-way agreement includes 100-foot easements
purchased from landowners along the transmission alignment. Only a small portion of the
transmission line right-of-way would be disturbed for structures, installation, and vehicle access.
This right-of-way is privately maintained, non County maintenance.
Traffic: All parking and vehicle storage shall be provided on site; parking shall not be permitted
within any public right-of-way. An adequate parking area shall be provided to meet the parking
needs of employees, company vehicles, visitors and customers.
Additional parking and storage would occur immediately north of the proposed Davis Substation
between the County road and the substation yard within the parcel of land to be purchased by
United Power.
During construction, all vehicles will park within the designated parking areas adjacent to the
Davis Substation.
Drainage: The applicant has supplied a historical drainage flow for the proposed Davis
Substation site. The stormwater runoff from the substation is proposed to drain into an
extended detention pond that has been constructed by Tri-State to service their existing facility
that is adjacent to the proposed site. The detention pond has been shown in past calculations
to have excess volume. Therefore, the proposed drainage plan is acceptable to Public Works.
Flood Hazard Development Standards: This area IS NOT in a Special Flood Hazard Area
(SFHA) as determined by the Federal Emergency Management Agency (FEMA).

SUBJECT: USR12-0033 Tri-State Generation
Environmental Health Services has reviewed this proposal for a major facility of a public utility to
construct an electrical substation and a 1.5 mile transmission line. As no employees will be located at
the site, permanent water and sewer is not required. Portable toilets, hand washing units and bottled
water will be utilized during construction. Enclosed containers will be provided for trash and
transported to an approved disposal facility. A water truck will be utilized for dust suppression during
construction, if necessary. Access to the substation will be paved and native vegetation will be
replanted in disturbed areas.
We have no objections to the proposal; however, we recommend that the following requirements be
incorporated into the permit as development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner
that protects against surface and groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include
those wastes specifically excluded from the definition of a solid waste in the Solid Wastes
Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
fugitive particulate emissions, blowing debris, and other potential nuisance conditions.
4. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
5. This facility shall adhere to the maximum permissible noise levels allowed in the Industrial
Zone as delineated in Section 14-9-30 of the Weld County Code.
6. Appendix B: Environmental Protection Measures for Construction Projects, as included in the
application, shall be adhered to.
7. Adequate drinking (bottled water), toilet facilities (portable toilets) and hand washing units shall
be provided during construction of the facility.
8. The applicant shall obtain a Colorado Discharge Permit System or CDPS permit from the
Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control
Division, as applicable.
9. The operation shall comply with all applicable rules and regulations of State and Federal
agencies and the Weld County Code.

A building permit will be required for the booster pump station structures and
associated equipment. A building permit application must be completed and two
complete sets of engineered plans including foundation plans bearing the wet stamp of
a Colorado registered architect or engineer must be submitted for review. A
geotechnical engineering report performed by a registered State of Colorado engineer
shall be required.
Buildings and structures shall conform to the requirements of the various codes adopted at the
time of permit application. Currently the folding has been adopted by Weld County: 2006
International Building Code; 2006 International Mechanical Code; 2006 International Plumbing
Code: 2006 International Energy Code; 2006 International Fuel Gas Code; 2011 National
Electrical Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code.
A plan review shall be approved and a permit must be issued prior to the start of construction.

1) In accordance with the 2003 IFC :
503.2.1 Dimensions.
Fire apparatus access roads shall have an unobstructed width of not less than 20
feet(6096 mm),except for approved security gates in accordance with Section
503.6,and an unobstructed vertical clearance of not less than 13 feet 6 inches
(4115 mm).
2) In accordance with the 2003 IFC :
503.2.3 Surface.
Fire apparatus access roads shall be designed and maintained to support the
imposed loads of fire apparatus and shall be surfaced so as to provide all-weather
driving capabilities.
3) The address must be placed on the business and in a position that is clearly visible
from the street fronting the business.Address numbers need to be a minimum of 4
inches high,have a 3 inch stoke, and they need to be on a contrasting backboard.
In the case of utilizing the same address as another business, a suite#or at least
the business name needs to be posted on the structure along with the address.
4) Fire extinguishers must be located inside all occupied buildings. Extinguisher size
and type need to meet the requirements of NFPA 10.

Dear Kim,
Colorado Parks and Wildlife(CPW) has reviewed the Site Specific Development Plan and Special Review
permit for a Booster Pump Station for an existing natural gas liquids pipeline— 'Buckingham Compressor
Station'. District Wildlife Manager Troy Florian made a site visit to the parcel. In this letter you will find
our comments concerning the proposal.
The site is located in Section 9,Township 7 N,Range 57 W,within a quarter mile west of WCR 139,and
north of and adjacent to WCR 82. The area where the development is proposed is representative of
vegetation and topography typically found in short grass prairie ecosystems.
If a Natural Gas Compressor Station is to be developed on the proposed site,CPW recommends that:
Ground-breaking construction occurs between August 15 and April 1 to prevent the destruction of
nesting wildlife.
Noxious weed and re-vegetation management plans are developed and implemented in areas
where there will be ground disturbance due to construction activities.
Any fence building on site are constructed with a wildlife friendly design.
Ground-breaking Construction. The short grass prairie is a desirable nesting habitat and contains a large
number of different species of small birds. Most species of small birds are primarily ground nesting birds,
although some species nest in trees or bushes. Some of these species are permanent residents while others
are migrants or summer(breeding)residents. All of the ground—nesting birds in this area could be subject
to habitat loss,displacement and disturbance from future construction or development. It is possible that
human activities around nest sites during critical nesting periods can have significant negative impacts. In
regards to ground-nesting birds in the area,it is recommended that any ground breaking construction that
takes place on the proposed area occurs before April 1 and after August 15 to minimize any impacts that
human activity may have on these ground nesting birds. USFWS staff recommends this as well as a way of
avoiding violation of the Migratory Bird Treaty Act. If construction processes cannot be completed outside
of the critical nesting periods,CPW recommends that the developer conducts nest clearance surveys for
tree and ground nesting birds prior to ground-breaking activities to insure that nests and/or young are not
disturbed or destroyed as a result of construction activities.
Noxious Weed and Native Vegetation Reclamation Plans. With new ground-disturbing construction
taking place and machinery being transported from one site to another,it is important to take adequate

measures to prevent the spread of noxious weeds. Therefore,CPW recommends that a noxious weed and
re-vegetation management plan should be developed and implemented until all disturbed areas are properly
re-vegetated with native species representative of the surrounding site. In addition to actively eradicating
noxious weeds within the project area,part of the weed management plan should include measures such as
cleaning construction and maintenance equipment when moving from site to site to prevent the spread of
noxious weeds. When developing a native species re-vegetation plan,CPW recommends that the
developer use a success standard of 80%coverage of native vegetation as a measure of successful
reclamation.
Fencing. CPW recommends that fencing is limited to that needed to protect the project and fulfill MSHA
requirements. Where needed,CPW encourages the developer to use wildlife friendly fence to ensure
wildlife access to essential habitat,avoid creation of movement barriers,and prevent wildlife injury/death
caused by fencing. Fencing plans should avoid woven wire designs that will trap or prevent movement of
wildlife,unless specifically used to exclude humans and/or wildlife for facility safety or security. If barbed
wire fencing is used,CPW recommends the use of three/four strand fencing with a bottom strand height of
17 inches and a maximum top strand height of 42 inches,along with installation of double stays between
posts.
