RE: APPROVE VACATION OF CONDITIONAL USE PERMIT, CUP-17 - JAMES AND
ELIZABETH MILLER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 17, 1976, the Board approved Conditional Use
Permit #17 for the construction of multi-family farm labor housing for on the following described
real estate, to-wit:
Part of the NE1/4 of Section 16, Township 7 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Board has received a request from James and Elizabeth Miller, property
owners, 39943 County Road 19, Fort Collins, Colorado 80524, to vacate said Conditional Use
Permit , CUP-17, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of
the Department of Planning Services staff and all of the exhibits and evidence presented in this
matter and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that Conditional Use Permit, CUP-17 be, and hereby is, vacated.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of December, A.D., 2012.

SUBJECT: Vacation of CUP-17

The Department of Planning Services has received the attached letter dated November
27, 2012 from Bettie Miller. Mrs. Miller is requesting that CUP-17 be vacated from her
parcel, 0705 16 000015 since the use of multi-family farm labor housing is no longer being
operated on the property.
Background information:
Legal Description: Lot B of RE-2549 being part of W2NE4 Section 16, T7N, R67W of
the 6th P.M., Weld County, CO.
Location: South of State Hwy 14 and east of and adjacent to County Road 19
CUP-17: CUP-17 was approved by the BOCC on May 12, 1976, for A
conditional use permit for the construction of multi-family farm labor
housing in the A (Agricultural) Zone District

This letter is to inform the county of Weld that we do not have anyone living in
any of the buildings that used to be considered a migrant camp. The address of
the camp was 39822 CR 19. There has not been anyone living at that address for
the last 15 years.
Please vacate CUP-17. We understand that it will be our responsibility to remove
all stoves and ovens from each unit.
