SUBJECT: USR12- 0036, Sterling Energy Investments (Compressor
Site)
A Use by Special Review Permit for an Oil and Gas Support Facility; a compressor station for
gas processing in the A (Agricultural) Zone District.
The Weld County Public Works Department has reviewed this proposal. This project falls under
the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4,
Section 23. Staff comments made during this phase of the Use by Special Review process may
not be all-inclusive, as other issues may arise during the remaining application process. All
issues of concern and critical issues during further review must be resolved with the Public
Works Department.
Weld County Road Classification Plan:
WCR 111 is a local gravel road and requires a 60-foot right-of-way at full build out. There is
presently a 60-foot right-of-way. These roads are maintained by Weld County. Pursuant to the
definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured
from the future right-of-way line.
WCR 109 section line access has 60 feet of unmaintained County right-of-way.
Sterling plans to use the pipeline right-of-way to access the pumping station, entering on to
the public right-of-way off from WCR 111.
Traffic: After construction, the site will be unmanned. Proposed traffic includes one or two
employees visiting the site each day.
Access/Roadway:
The applicant is utilizing the approved access point on to WCR 111.
Please show and label on the Site Plan, the proposed access width (minimum 20' for
emergency vehicles) and the turning radiuses into the site (45'-60' radiuses required to
accommodate trucks).
Tracking control is required to prevent tracking of mud and debris on to the County roadway.
Please show and label a cattle guard (cattle guard placed to allow for a full rotation of truck
tires) at the access. Place the cattle guard far enough back from the County roadway to
allow a tractor trailer to completely pull off the main roadway before crossing the cattle
guard.
Contact the Permitting/Inspection Coordinator for Weld County Public Works, at (970) 304-6496
ext. 3764 for a Right-of-Way permit for any work that may be required in the right-of-way. A

special transport permit will be required for any oversized or overweight vehicles that may
access the site and may be obtained by contacting the coordinator as well.
Weld County Road Access Permit Form:
Weld County Road Access Permit Application Form is included in the packet. It will be required
for all new roads, driveways or other means of providing ingress or egress to lands adjoining
County rights-of-way. The application form shall be completed by the property owner to be
accessed from a County road or his/her duly authorized agent as evidenced by written
documentation.
a. Access pictures will be required from the left, right and into the access.
b. A signature and date will be required to deem the application acceptable and compete.
c. The FEE is $ 75.00 for your new access points.
Site:
Please place the following notes on the Plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious
weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the
noxious weeds.
b. Show WQCF location, label no buildings or storage. Weld County will not
maintain drainage related areas.
Stormwater:
Please provide a revised drainage design for water quality capture only.
The water quality calculation in the submitted drainage report uses an WQCV drain time of
12 hours, please revise this calculation to use a drain time of 40 hours (a=1).
Please place the following notes on the Plat:
a) The historical flow patterns and run-off amounts will be maintained on site in
such a manner that it will reasonably preserve the natural character of the area
and prevent property damage of the type generally attributed to run-off rate and
velocity increases, diversions, concentration and/or unplanned ponding of storm
run-off.
b) The applicant must take into consideration storm water capture/quantity and
provide accordingly for best management practices.
c. Weld County is not responsible for the maintenance of onsite drainage related
features.

Environmental Health Services has reviewed this proposal for a mineral resource
development facility for natural gas products. As there will be no permanent employees
located at the site, permanent water and sewer is not required. A portable toilet is
acceptable in accordance with Environmental Health Policy 2.2.K.
On site dust will be controlled by having travel lanes and parking surfaces graveled.
The waste handling section of the application indicates a Spill Prevention, Control and
Countermeasure Plan (SPCC Plan) will be developed for this site. A copy of the plan
shall be kept on the site at all times and be provided to the Department of Public Health
& Environment. The waste handling section also states that Waste Management has
been contracted for trash service.
Noise may be regulated by the Colorado Oil and Gas Conservation Commission. The
use of berms, sound walls and enclosing equipment in a sound proof building could be
utilized to limit noise impacts if necessary.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1. The applicant shall submit evidence of an Air Pollution Emission Notice
(A.P.E.N.) and Emissions Permit application from the Air Pollution Control
Division, Colorado Department of Health and Environment to Environmental
Health Services Division of the Weld County Department of Public Health &
Environment. Alternately, the applicant can provide evidence from the APCD that
they are not subject to these requirements.
2. A signed copy of the Spill Prevention, Control and Countermeasure Plan shall be
provided to Environmental Health Services Division of the Weld County
Department of Public Health & Environment.
We recommend that the following requirements be incorporated into the permit as
development standards.
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.,
as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, blowing debris, and other potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
6. Adequate drinking, handwashing and toilet facilities shall be provided for
employees and patrons of the facility, at all times. Portable toilets and bottled
water are allowed in accordance with Environmental Health Policy 2.2.K. as
attached.
7. This facility shall adhere to the maximum permissible noise levels allowed in the
Industrial Zone as delineated in Section 14-9-30 of the Weld County Code, or
with all applicable State noise statutes and/or regulations.
8. The operation shall comply with all applicable rules and policies regulated by the
Colorado Oil and Gas Conservation Commission.
9. All potentially hazardous chemicals must be handled in a safe manner in
accordance with product labeling and in a manner that minimizes the release of
hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All
chemicals must be stored secure, on an impervious surface, and in accordance
with manufacturer's recommendations.
10.The Spill Prevention, Control and Countermeasure Plan shall be available on
site, at all times.

11.The applicant shall comply with all provisions of the State Underground and
Above Ground Storage Tank Regulations.
12.The applicant shall obtain a Colorado Discharge Permit System or CDPS permit
from the Colorado Department of Public Health and Environment (CDPH&E),
Water Quality Control Division, as applicable.
13.The operation shall comply with all applicable rules and regulations of State and
Federal agencies and the Weld County Code.

Use of portable toilets and bottled water (revised 5/8/12)

Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Policy: Portable toilets are allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:

Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.

Kim,
I have reviewed all the documents connected with the application for USR12-0036. As shown in said
documents, it appears to me that all impacts would be on lands other than the Pawnee National Grassland.
Also, it seems that by virtue of the setback shown from the Forest Service land boundary and the 2' X 5'
earthen berm on the south side of the compressor site, any surface runoff and hazardous material or other spills
or leaks should be contained on the site. We will be monitoring our side of the fence, so to speak, and will
discuss any future concerns in this regard with Sterling, should they arise.
I would appreciate it if Sterling would notify me that construction is scheduled to begin. I merely wish to
observe the construction phase from time to time since it's so close to Forest Service land.
The US Forest Service has no other concerns or comments on this project at this time. Should any changes to
the application be made, please let me know.
