CODE ORDINANCE 2012-13
IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, A PORTION OF
CHAPTER 2 ADMINISTRATION, AND CHAPTER 5 REVENUE AND FINANCE, OF THE WELD
COUNTY CODE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF
WELD, STATE OF COLORADO:
WHEREAS,the Board of County Commissioners of the County of Weld, State of Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority
of administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners, on December 28, 2000, adopted Weld
County Code Ordinance 2000-1,enacting a comprehensive Code for the County of Weld, including
the codification of all previously adopted ordinances of a general and permanent nature enacted on
or before said date of adoption, and
WHEREAS, the Weld County Code is in need of revision and clarification with regard to
procedures, terms, and requirements therein.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Commissioners of the
County of Weld, State of Colorado,that certain existing Chapters of the Weld County Code be, and
hereby are, repealed and re-enacted, with amendments, and the various Chapters are revised to
read as follows.
CHAPTER 2
ADMINISTRATION
Amend Sec. 2-1-120. Delegation of authority.
A through O - No Change
P. Delegation of authority concerning Standard Form for Child Protection Agreement for
Respite Care. The Board of County Commissioners, on March 17, 2004, by Resolution
#2004-0854, approved the standard form for Child Protection Agreement for Services for
Respite Care, and granted standing authority to the Chair of the Board to sign said
agreement, after review by the County Attorney to verify that it was completed in accordance
with the form approved by the Board. By Resolutions#2006-0524 and#2012-1120,the form
of the agreement was updated.

W. Delegation of authority concerning Standard Form for Addendum to Agreement to Purchase
Child Placement Agency Services. The Board of County Commissioners, on August 27,
2007, by Resolution#2007-2735, approved the Standard Form for Addendum to Purchase
Child Placement Agency Services, and granted standing authority to the Chair of the Board
to sign said agreement, after review by the County Attorney to verify that it was completed in
accordance with the form aooroverl by the Board. By Resolution #2008-2125, dated

X. Delegation of authority concerning Standard Forms for Addendum to Agreement to
Purchase Residential Child Care Facility Services, and Addendum to Agreement to
Purchase Out-of-State Residential Child Care Facility Services. The Board of County
Commissioners, on August 27, 2007, by Resolution #2007-2736, approved the Standard
Form for Addendum to Purchase Residential Child Care Facility Services, and granted
standing authority to the Chair of the Board to sign said agreement, after review by the
County Attorney to verify that it was completed in accordance with the form approved by the
Board. By Resolution #2008-2126, dated August 6, 2008, and by Resolution#2012-2088,
dated August 8, 2012, the form of the addendums were updated.
Y. Delegation of authority concerning Standard Form for Addendum to Agreement to Purchase
Specialized Group Home Care Services. The Board of County Commissioners, on
August 27, 2007, by Resolution#2007-2737, approved the Standard Form for Addendum to
Purchase Specialized Group Home Care Services, and granted standing authority to the
Chair of the Board to sign said agreement, after review by the County Attorney to verify that
it was completed in accordance with the form approved by the Board. By Resolution
#2008-2128, dated August 6, 2008, and by Resolution#2012-2088, dated August 8, 2012,
the form of the addendum was updated.
Z. Delegation of authority concerning Standard Form for Individual Provider Contract for
Purpose of Foster Care Services and Foster Care Facility Agreement,and the Addendum to
Individual Provider Contract for Purpose of Foster Care Services and Foster Care Facility
Agreement. The Board of County Commissioners, on August 6, 2008, by Resolution
#2008-2129, approved the Standard Form for Addendum to Individual Provider Contract for
Purpose of Foster Care Services and Foster Care Facility Agreement, and granted standing
authority to the Chair of the Board to sign said contract, after review by the County Attorney
to verify that it was completed in accordance with the form approved by the Board. By
Resolution#2012-2088, dated August 8, 2012, the form of the Contract was approved and
the addendum was updated,
AA through CC - No Change
DD. Delegation of authority concerning Form of Agreement and Addendums to Agreement to
Purchase Out-of-Home Placement Services. The Board of County Commissioners, on
June 28, 2010, by Resolution#2010-1375, approved the standard form for Addendums to
Agreement to Purchase Out-of-Home Placement Services and granted standing authority to
the Chair of the Board to sign said addendums, after review by the County Attorney to verify
that they were completed in accordance with the form approved by the Board. By Resolution
#2012-2088, dated August 8, 2012, the form of the Agreement and Addendums to
Agreement to Purchase Out-of-Home Placement Services was updated.
EE. Delegation of authority concerning Form of Agreement and Addendum to Agreement to
Purchase Group Home/Group Center Care Services. The Board of County Commissioners,
August 8, 2012, by Resolution#2012-2088, approved the standard form for Addendums to
Agreement to Purchase Group Home/Group Center Care Services and granted standing
authority to the Chair of the Board to sign said addendums, after review by the County
Attorney to verify that they were completed in accordance with the form approved by the
Board.

FF. Delegation of authority concerning Form of Intergovernmental Agreement for Payment of
Bonus Amounts for Certain Reported Oil and Gas Employees Residing within Municipal
Boundaries. The Board of County Commissioners, on January 4, 2012, by Resolution
#2012-0017, approved the standard form for Intergovernmental Agreement for Payment of
Bonus Amounts for Certain Reported Oil and Gas Employees Residing within Municipal
Boundaries and granted standing authority to the Chair of the Board to sign said
agreements, after review by the County Attorney to verify that they were completed in
accordance with the form approved by the Board.

BE IT FURTHER ORDAINED by the Board that the Clerk to the Board be, and hereby is,
directed to arrange for Colorado Code Publishing to supplement the Weld County Code with the
amendments contained herein, to coincide with chapters, articles, divisions, sections, and
sub sections as they currently exist within said Code; and to resolve any inconsistencies regarding
capitalization, grammar, and numbering or placement of chapters, articles, divisions, sections, and
sub-sections in said Code.
BE IT FURTHER ORDAINED by the Board if any section, subsection, paragraph, sentence,
clause, or phrase of this Ordinance is for any reason held or decided to be unconstitutional, such
decision shall not affect the validity of the remaining portions hereof. The Board of County
Commissioners hereby declares that it would have enacted this Ordinance in each and every
section, subsection, paragraph, sentence, clause, and phrase thereof irrespective of the fact that
any one or more sections, subsections, paragraphs, sentences, clauses, or phrases might be
declared to be unconstitutional or invalid.
