The Weld County Council met in regular session in full conformity with the Weld County
OMM
Home Rule Charter, Monday, October 15, 2012, 6:30 p.m. at the C Se
n0 Colorado.
ROLL CALL: The meeting was called to order by President Charles Tucker and on roll
call the following members were present, constituting a quorum of members thereof:

Also present: Trevor Jiricek, Director Weld County General Services and Environmental
Health Services, Tom Parko, Director Weld County Planning Services and Karleen
Watson, Council Secretary.
APPROVAL OF AGENDA: Councilwoman Buck made a motion to approve the
October 15, 2012 agenda. The motion was seconded by Councilwoman Buczek and
carried.
APPROVAL OF MINUTES: Councilwoman Buczek made a motion to approve the
September 17, 2012 minutes. The motion was seconded by Councilwoman Buck and
carried.
PUBLIC COMMENT: There was no public comment.
PROGRAM REVIEW:
Mr. Jiricek discussed changes in personnel within the Department. His new duties
include airport coordination, coroner, judicial services, purchasing and special projects.
Tom Parko has been appointed the new Director of Planning and Monika Mica has
additional duties that have been added to her current position. There will be a three to
six month transfer/phase out period for all three employees.
Mr. Jiricek addressed free water testing available in the County and said that a typical
report shows 62 compounds that are looked for and 57 other similar carbon-based
compounds. Weld County via the Board formed the Federal Mineral Lease Organization
consisting of three representatives; two from the industry and one from the Board which
resulted in additional dollars that came to the County due to oil and gas impacts and
was then used on the impacts of the oil and gas industry. Roads have taken the
majority of impact from oil and gas. Testing the water was a way to help mitigate oil and
gas impacts. The Board purchased a Gas Chromatograph Maspectrometer to be used
for water testing. It is one month into the testing and they have collected 19 samples
and have 17 scheduled to test. The turnaround time for testing is a couple of weeks
and is collected by department employees which are trained by the EPA. Verbal
requests are made to the Health Department. People can have water tested if known
that activity would be in the future and then retest after the fact in order to have a

baseline. The process is to give people comfort and information regarding their water.
No positives have come back on testing yet. Effects of coal mining could show up in
water as well as any past activity in the area. Reasons for requests have been media
driven but mostly concern the impact of fracking on water.
Dave Bower was appointed Director of Public Works and Toby Taylor is now Director of
Buildings and Grounds.
Tom Parko discussed the functions of the Department of Planning Services which
include land use cases, zoning cases and applications from developers. The
Department has been quite busy over the last three years. Mr. Parko provided a hand-
out with figures updated to the third quarter of 2012. Page two shows revenues that
reflect Planning and the Department of Building Services. The trend is going back up
for annual planning deposit totals. Oil and gas is about 60% of cases.
Subdivisions have been stagnant and the Department has met with developers to get
residential activity going. Planning cases for this year will exceed last year's due to oil
and gas. Walk-ins are up this year as well. Pre-Application Requests are at 182
through September of this year which was the total for 2012 but 196 as of today. Land
Use Case History shows the mix of cases the department has. Page 8 shows the
Current Planning Cases by Case Type. Approved subdivisions in unincorporated Weld
County are divided into lots with lot size determined by the developer and have gone
through the final plat process and are shown on page 9. The Recorded Exemption Lots
(RE's) created annually peaked in 2005 with 709 then in 2010 a code was passed which
limited splits to 35 acres. For 2012 the RE's are up to 144 through September. Weld
County is unique because it has a minimum lot size of 80 acres.
Building permit numbers by type are through September and show 711 permits for oil
and gas. Oil and gas permits are done by the COGC which are use-by-right permits.
The number of average inspections are up and the building side of the equation is
shown as total valuation at 200 million. The 2010 valuation is up due to the BP wind
farm. However, taking out the wind farm numbers, the County is still doing well. Zoning
compliance in the county is complaint-driven versus trying to go out and find problems.
The reflection of the number of complaints looks like it has dropped off but has not; the
process has changed from sending out a letter first then going out to verify more work is
being done because they are verifying first. They are trying to be more customer-
friendly. Population of Weld County is growing and will continue to grow. Weld County
all unincorporated and municipalities is a population of 264,528. Unincorporated alone
is around 50,000. Building permits are coming from urban areas mostly. Percentage-
wise the County is growing fast in smaller areas. The department has four building
inspectors two of which are sent north and two are sent south. The area is still going
through foreclosures; there were 32 last week. Transload facilities have been approved
in the County.
Dairy sites have picked up with Leprino's phase one and phase two is set to be
completed in March. There are a number of uses-by-right being utilized since the code
is 10 cows per acre so there is no review required. There has been a trend for the
transition from old turkey farms to dairies due to the benefits of there being no change in
water usage.

Water transfer facilities are being repermitted and utilized from existing wells. Previously
they were agriculture wells and they have been converted to commercial wells used for
hydrofracking.
PUBLIC COMMENT: None.
PAYMENT OF BILLS: Councilwoman Buczek made a motion to pay bills as listed
below with the change to Marge Klein's mileage to be $10.19:

The motion was seconded by Councilman Mueller and passed.
NEW BUSINESS:
Invitations: Department Heads/Elected Officials Luncheon 10/22/12 12:00 to
1:30 pm. All Council members attending except Ginny Buczek. Secretary will make
sure all RSVPs are in.
