HEARING CERTIFICATION DOCKET NO. 2012-32 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR12-0015, FOR AN AGRICULTURAL SERVICE ESTABLISHMENT PRIMARILY ENGAGED IN PERFORMING AGRICULTURAL, ANIMAL HUSBANDRY OR HORTICULTURAL SERVICES ON A FEE OR CONTRACT BASIS, INCLUDING FARM EQUIPMENT SALES, REPAIR AND INSTALLATION FACILITIES AND USES SIMILAR TO THE USES LISTED AS USES BY SPECIAL REVIEW (MANUFACTURING OF SPECIALIZED GOOSENECK HITCHES) AS LONG AS THE USE COMPLIES WITH THE GENERAL INTENT OF THE A (AGRICULTURAL) ZONE DISTRICT — DEWEY AND DOROTHY MARCY A public hearing was conducted on May 16, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair - EXCUSED Commissioner William F. Garcia, Pro-Tern Commissioner Barbara Kirkmeyer- EXCUSED Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Heidi Hansen Health Department representative, Lauren Light The following business was transacted: El I hereby certify that pursuant to a notice dated April 13, 2012, and duly published April 18, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Dewey and Dorothy Marcy, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0015, for an Agricultural Service Establishment primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including farm equipment sales, repair and installation facilities and uses similar to the uses listed as uses by special review (manufacturing of specialized gooseneck hitches) as long as the use complies with the general intent of the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. El Chair Pro-Tem Garcia advised Dewey Marcy, applicant, that he has the option of continuing this matter to a date when the full Board will be present. However, if he decides to proceed today, it will require three affirmative votes, or be deemed denied. Mr. Marcy indicated he would like to proceed today. Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and entered the favorable recommendation of the Planning Commission into the record as written. He reviewed the surrounding land uses and stated six of the 16 referral agencies 2012-1238 PL2160 HEARING CERTIFICATION - DEWEY AND DOROTHY MARCY (USR12-0015) PAGE 2 offered comments, which have been addressed in the Conditions of Approval and Development Standards. Mr. Ogle stated this case was initiated as a result of a Zoning Violation; however, if approved and the plat recorded, the case will be closed. If denied, the applicant will have 30 days to remove the business. Mr. Ogle displayed a vicinity map, floodplain map, and photographs of the site. El Heidi Hansen, Department of Public Works, stated the site is currently accessed from County Road (CR) 60.5, which is classified as a collector roadway. She stated the average daily traffic count, taken in August, 2010, was approximately 2,988 vehicles, and the proposed use will have a minimal traffic impact. Ms. Hansen stated the application materials indicate the site will be accessed each day by three employee vehicles and one weekly delivery truck. She further stated they will be using an existing low point for water quality and the standard floodplain notes are included within the Development Standards. Lauren Light, Department of Public Health and Environment, stated the site is serviced by a commercial well which is permitted for inside sanitary uses; however, staff is requiring an engineer's review due to the increased use. She further stated the Conditions of Approval require submittal of Dust Abatement and Waste Handling Plans, and Condition of Approval #1.D.3 addresses an air quality permit, if necessary. El Dewey Marcy, applicant, stated he builds hitches and has no plans for commercial sales from the building. e No public testimony was offered concerning this matter. Responding to Commissioner Rademacher, Mr. Marcy stated agreement with the hours of operation; however, he does conduct farm operations after hours, and the Board agreed to delete Development Standard #30. Following discussion regarding the number of employees, Mr. Dewey stated he is satisfied with the current request of seven employees. Mr. Ogle confirmed a Screening Plan will only be required if there is outside storage, and the Board agreed to delete Condition of Approval #1.A.11. In response to Chair Pro-Tem Garcia, Mr. Marcy stated he has reviewed, and agrees to abide by, the Conditions of Approval and Development Standards, as proposed and modified. ID Commissioner Long moved to approve the request of Dewey and Dorothy Marcy for a Site Specific Development Plan and Use by Special Review Permit, USR12-0015, for an Agricultural Service Establishment primarily engaged in performing agricultural, animal husbandry or horticultural services on a fee or contract basis, including farm equipment sales, repair and installation facilities and uses similar to the uses listed as uses by special review (manufacturing of specialized gooseneck hitches) as long as the use complies with the general intent of the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting Conditions of Approval #1.A.11, #1.B, and #1.C, and Development Standard #30, with the appropriate renumbering and re-lettering. The motion was seconded by Commissioner Rademacher, and it carried unanimously.
