Subject: 2012 Severance Tax Withholding
To All interest owners :
Majority of our wells in Weld County, CO qualifies as stripper wells. Colorado law exempts these wells from severance tax
withholding. Therefore, you will notice that this tax has been reversed the beginning of 2012 distribution. No severance tax will be
withheld until the well no longer qualifies as a stripper well. For stripper wells, no DR21 Ws will be sent out next year (sent out
February 2013 for 2012). However, if at the end of this year it is determined that a presumed stripper well does not qualify, interest
owners will be provided a DR21 W even if no severance tax was withheld. Any balance due to the State of Colorado when you file
DR21 W for the current taxable year will be payable, by the interest owner, to the State of Colorado.
