RESOLUTION
RE: APPROVAL OF THE MAINTENANCE AGREEMENT FOR THE DEPARTMENT
OF SOCIAL SERVICES AND AUTHORIZATION TO SIGN SAME.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Weld County Department of Social Services
has informed the Board of County Commissioners that it is
desirous of entering into an agreement with the Buildings and
Grounds Department in order to provide maintenance for the
Walton Building and its grounds , and
WHEREAS , as explained to the Board of County Commissioners,
payment to the Buildings and Grounds Department will amount to
$9 , 896. 00 for the term of the maintenance agreement which expires
December 31, 1978 , and
WHEREAS, after considering all the details set forth, the
Board of County Commissioners has determined that it would be
in the best interest of Weld County to approve the same.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the maintenance agree-
for the Walton Building and its grounds, by and between the
Weld County Department of Social Services and the Board of County
Commissioners for and on behalf of the Weld County Buildings
and Grounds Department, be, and hereby is , approved.
BE IT FURTHER RESOLVED that the Chairman of the Board of
County Commissioners be, and hereby is, authorized to sign the
same.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 22nd day of
February, A.D. , 1978.

MAINTENANCE AGREEMENT
Weld County
Department of Social Services
THIS AGREEMENT executed this 22nd day of February, 1978 and
effective as of January 1, 1978 by and between the Weld County Buildings and
Grounds Department (hereinafter "Buildings and Grounds") and the Weld County
Department of Social Services (hereinafter "Department") ;
WITNESSETH THAT
WHEREAS, the Department desires to enter into an agreement with the
Buildings and Grounds Department in order to provide for the maintenance of the
Walton Building and its grounds, and
WHEREAS, the Buildings and Grounds Department is desirous of entering
into such an agreement with the Department;
NOW THEREFORE, the Department and the Buildings and Grounds Department
in consideration of the promises and mutual covenants hereinafter contained
do hereby agree as follows:
1. Scope of Services
The Buildings and Grounds Department shall provide one employee to be
assigned to provide maintenance services for the Department at the Walton
Building, 315 North 11th Avenue. Said employee shall be under the direct
supervision of the Director of the Department. However, said employee shall
remain the employee of the Buildings and Grounds Department.
2. Duration of Program - Renewal
This agreement shall be in effect from January 1, 1978, through
December 31, 1978, and may be renewed upon the mutual agreement of the Department
and the Buildings and Grounds Department provided said renewal is reduced to
writing.
3. Payment - Schedule and Amount
A. Amount. Payment to the Buildings and Grounds Department will be
based upon and limited to the allocated budget of NINE THOUSAND EIGHT HUNDRED
NINETY-SIX DOLLARS AND 00/100 ($9896.00) for the term of this agreement as approved
by the Weld County Board of County Commissioners, provided that the Department or
Buildings and Grounds Department may cancel, revoke, annul or amend this Agree-
ment in accordance with paragraph 4.
B. Schedule. Payment by the Department to the Buildings and Grounds
Department will be made monthly upon the receipt of itemized billings for actual
expenditures incurred pursuant to this Agreement.
4. Cancellation, Termination and Amendment
This Agreement may be terminated, cancelled, revoked, or annulled by

either party upon written notice of at least thirty (30) days. This Agreement
may be amended in whole or in part by mutual consent, provided that said amend-
ment be reduced in writing, properly executed and made a part of this Agreement.
5. Non-Discrimination
In connection with the performance of service under this Agreement the
Buildings and Grounds Department agrees to comply with the provisions of the laws
of the State of Colorado and the Civil Rights Act of 1964, as amended, the
regulations of the Department of Health, Education and Welfare issued pursuant
to that act, the provisions of Executive Order 11246, Equal Employment Opportunity,
dated September 24, 1965, as amended.
6. Federal and State Laws and Regulations
This Agreement shall be performed in compliance with the Social Security
Act, as amended, the Federal Regulations and Amendments thereto which implement
the Social Security Act, and the rules and regulations of the Colorado State
Department of Social Services, as amended.
IN WITNESS WHEREOF
The Department and the Buildings and Grounds Department have caused
this Agreement to be executed by the respective officers duly authorized so to do.
