RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 304 - WILLIS AND IMOGENE KRAMER. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public hearing held on the 27th day of February, 1978, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 304, being the property of Willis and Imogene Kramer, described as Part of the S2 of the NWa of Section 15, Township 5 North, Range 65 West of the 6th P.M. , Weld County, Colorado, containing approx- imately 40 acres, more or less, and being more particularly described as follows: All that part of Lots one (1) and Two (2) of the Southeast Quarter (SEa) of the Northwest Quarter (NWa) and Lots One (1) and Two (2) of the Southwest Quarter (SW1) of the Northwest Quarter (NWa) ; also described as the South Half (Sa) of the Northwest Quarter (NWa) of Section Fifteen (15) , T5N, R65W, of the 6th P.M., according to the sub- division of lands by Union Colony of Colorado, Lying North of the canal of the Greeley Irrigation Canpany as now constructed over and across said lands. Said tract of land contains 40 Acres more or less according to the records on file in the Weld County Accessors office and recorded in the Weld County Clerk and Recorders office under Reception No. 1709876, does not come within the purview of the definition of the terms , "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that the particular division of land is not within the purposes of the Weld County Subdivision Regulations ;' '���� 780811 and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A (3) of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the hereinabove described parcel of land owned by Willis and Imogene Kramer, be, and hereby is, exempt from the definition of the teams , "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, subject to the condition that a minimum setback of 70 feet on the north along 22nd Street and a minimum setback of 40 feet on the west along Cherry Avenue be included on the plat before re- cordation. The parcel of land in question is described as Pt . S*NW4 Section 15 , T5N, R65W of the 6th P.M. , Weld County, Colorado. This property is located approxi- mately z mile south of East 18th Street (U. The staff has noted that the general area may undergo extensive industrial develonment , resulting from proximity to the U. S . 34 interchange , major water and sewer facilities , and from a City policy encouraging indus- trial development in the southeast . A Comprehensive Plan amendment is under consideration. In a meeting with City staff the applicant was cautioned to consider possible long term land use conflicts . In addition building setbacks were recommended to provide both buffer areas and areas for future street dedication along Cherry Avenue and 22nd Street. Honn, Zoning Administrator Weld County Department of Planning Services 915 10th Street Greeley, CO 80631 Re: Availability of water for Kramer Exemption (Section 15, T5N, R65W) Dear Mr. Honn: We have examined the information presented for the above referenced parcel. Our Ground Water Section has indicated that if the owner intends to utilize water from the shallow alluvial aquifer, a well permit would be granted for a household use only well which would not allow any use of water for irrigation or livestock watering. The owner may elect to utilize water from the deeper Laramie-Fox Hills Aquifer. If an application is made for a well permit in this aquifer, a thorough evaluation will be made by our Ground Water Section to determine whether or not the water contained in the aquifer is tributary. A well utilizing tributary ground water would be restricted to household use only. If the ground water is not determined to be tributary, a domestic well permit would be issued. This type of permit would allow for irrigation of up to one acre of lawn or garden and the watering of domestic livestock. We hope that these comments will be of use to the county in the decision making process. If you have additional questions, please feel free to contact this office.
