Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: In I hereby certify that pursuant to a notice dated September 14, 2012, and duly published September 19, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Bear Tracker Energy, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0048, for Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, three (3) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. la Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, surrounding land uses, and referral agency responses, and entered the favorable recommendation of the Planning Commission into the record as written. He displayed maps and photographs of the site and surrounding area. Don Carroll, Department of Public Works, provided a brief overview of the roadway and access conditions, transportation plans, and stormwater and grading improvements requirements. He requested Condition of Approval #1.A.8 be deleted, due to the distance from the site to the local roadway, and he responded to questions from the Board regarding outstanding Public Works requirements. Cc: AU ) 41- 2012-2897 I�" AT-P- PL2186 HEARING CERTIFICATION - BEAR TRACKER ENERGY (USR12-0048) PAGE 2 IR Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions (portable toilets and bottled water), as well as the Dust and Waste Handling Plans. She also addressed questions from the Board regarding the Air Pollution Emissions Notice (APEN) requirement. ID Grant Burchell represented the applicant and provided a brief summary of the intended operations to compress and process the natural gas obtained from various well sites throughout the area. He responded to questions from the Board regarding the business plan to obtain contracts with various operators. IE No public testimony was offered concerning this matter. In response to Chair Conway, Mr. Burchell expressed agreement with the deletion of Condition of Approval #1.A.8. Mr. Yatabe clarified the property has been transferred from Kenyon Ayers and all references should be removed from the Resolution. El Commissioner Rademacher moved to approve the request of Bear Tracker Energy, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0048, for Oil and Gas Support and Service, including oil and gas processing facilities and related equipment, including, but not limited to, three (3) compressors associated with gas processing or which compress gas to enter a pipeline for transport to market in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included deleting Condition of Approval #1.A.8, as well as all references to Kenyon Ayers. The motion was seconded by Commissioner Garcia. Chair Conway commended the applicant for submitting a quality application which will benefit the community. There being no further discussion, the motion carried unanimously and the hearing was completed at 10:32 a.m. This Certification was approved on the 22nd day of October, 2012.
