RE: ACTION OF THE BOARD CONCERNING NONEXCLUSIVE LICENSE AGREEMENT
CONCERNING INSTALLATION OF SIX-INCH NATURAL GAS PIPELINE ALONG
COUNTY ROAD 61 AND AUTHORIZE CHAIR TO SIGN - DCP MIDSTREAM, LP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 4, 2012, the Board was presented with a Nonexclusive License
Agreement Concerning the Installation of a Six-inch Natural Gas Pipeline Along County
Road 61 between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Public Works, and DCP
Midstream, LP, 3026 4th Avenue, Greeley, Colorado 80631, with terms and conditions being as
stated in said agreement, and
WHEREAS, after review, the Board deemed it advisable to continue said agreement to
June 11, 2012, to allow staff adequate time to contact the applicant and address questions from
the Commissioners and conduct a work session, and
WHEREAS, on June 11, 2012, after review, the Board deemed it advisable to continue
consideration of said agreement to June 18, 2012, to allow adequate time to review the matter
in a work session.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the Nonexclusive License Agreement Concerning the Installation
of a Six-inch Natural Gas Pipeline Along County Road 61 between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, and DCP Midstream, LP, be and hereby is, continued to June 18,
2012.

SUBJECT: Agenda Item-Nonexclusive License Agreement
Please submit the enclosed items for the next agenda:
Nonexclusive License Agreement with DCP Midstream,LP,for the installation of a 6"natural
gas line along CR 61.
DCP is requesting to utilize the right of way for a portion of this pipeline as attempts for securing
private easement were unsuccessful.
The original documents are being hand delivered.
