WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract of
land, being the property of Dena A. Powell, Weld County, Colorado,
and more particulary described as follows, to-wit:
A tract of land located in the East one-half
(El) of the Southeast Quarter (SE4) of Section
18, in Township 2 North (T2N), Range 68
West (R68W) of the 6th Principal Meridian, in
Weld County, Colorado, and being more parti-
cularly described as follows:
Beginning at the East Quarter Corner of said
Section 18, from whence the West Quarter
Corner of said Section 18 bears S88°33'41" W
with all other bearings herein relative thereto,
thence S00°01'27" W along the East line of the
abovementioned SE 4 2607. 06 feet to the South-
east Corner of said SE4-; thence 588°05'18" W,
1319. 92 feet to the Southwest Corner of the
abovementioned EZ, SE4, Section 18; thence N
00°07'15" E, 2618. 07 feet to the Northwest
Corner of said Et, SE4, Section 18; thence
N88°33'41" E, 1315. 18 feet along the North line
of said EZ, SE4-, Section 18 to the Point of
Beginning; thus described tract containing 78. 984
acres, more or less,
does not come within the purview of the definition of the terms "subdivision"
and "subdivided land" as set forth in CRS 106-2-33 (a) and (b) 1963, as
amended, and
WHEREAS, the Board of County Commissioners of the County of
Weld, State of Colorado, desires to exempt this particular division of
land upon the recommendation of the Weld County Zoning Administrator
for reasons as stated and pursuant to its authority under CRS 106-2-33
(d), 1963, as amended,
NOW, THEREFORE, BE IT RESOLVED, that the hereinabove
described tract of land owned by Dena A. Powell, be exempt from the
terms "subdivision" and "subdivided land" as provided for in the new
Weld County Subdivision Regulations at Section 2-1, A. , (3) adopted
August 30, 1972.
The above and foregoing Resolution was, on motion duly made and
seconded, adopted by the following vote on the 11th day of February, A.D.,
1975.

Dear Sirs:
The attached plat, application, and other items are in reference to a
request, by Dena A. Powell , for a recorded exemption. The parcel in
question contains approximately 79-acres of irrigated agricultural land.
The request is to split 1 acre with improvements from the property.
Based upon the information submitted and Weld County Regulations, the
Planning staff recommends approval for the following reasons:
1 . The proposed split conforms with the intent clause, Section 9-2,
of the Weld County Subdivision Regulations for recorded exemption
in that the proposed use is a higher use and is compatible with
surrounding agricultural uses.
2. The proposed split complies with the Comprehensive Plan in-as-much
as it promotes agricultural use.
3. All items for application have been completed.
