David, Weld County Attorney Subject: Legal Opinion, Davis Subdivision Roads You have requested an opinion as to whether or not Weld County should accept into the Weld County Road System, a certain access road in to what is termed the "Davis Subdivision", all being a part of the Southwest Quarter (SWa) of Section 26, Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado. My investigation reveals that no subdivision has been approved by the County, and/or recorded with the Clerk and Recorder of Weld County, Colorado, and consequently there has been no dedication of this particular road to Weld County. The deed records (Reception No. 1610917) reveal that James J. Davis and Eva Dell Davis conveyed to "the present owners of adjacent property, their heirs, assessors and assigns" a right of access for ingress and egress over and across a strip of land sixty (60) feet wide, the centerline of which is described as follows: Beginning at the Southwest Corner of Section 26, Township 7 North, Range 65 West of the 6th P.M. , Weld County, Colorado, thence N 00°13'20" East 2283.80 feet to the POINT OF BEGINNING, thence South 85°09'21" East 2262 feet. Accordingly, it is my recommendation that the owners of this property, James J. Davis and Eva Dell Davis, be notified that this road cannot be accepted into the Weld County Road System, or maintained by Weld County, in as much as Weld County has neither fee title to this real estate, nor any other legal interest in this road. Olson Tom Honn ^ ` f^ ' aaG/94 -- Dear Commisioners of Weld County: We the undersigned wish to petition the County of Weld to accept official title to the access road to the Jim Davis Subdivision located four (4) miles East and one and, one half (l)6) miles North of Eaton Stop Light. We wish this action taken to ensure school bus service and mail delivery to our private drive ways. Currently six (6) children nse the school bus, with three (3) more anticipated in the near future. This represents three(3) households at this time with one (1) anticipated being built in the near future and the possibility of still one (1) more to complete the subdivision as filed.
