RE: APPROVAL OF LOT SIZE VARIANCE NO. 65 - JOHN AND NORMA PROPP.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners has determined
at a public hearing held on the 5th day of June, 1978, in the
Chambers of the Board of County Commissioners of Weld County,
Colorado, that a certain tract of land is owned by John and Norma
Propp, which land is more particularly described as follows:
A tract of land situated inthe NA of the NE1 of Sec. 9,
Township 1 North, Range 68 West 6th P.M., County of Weld,
State of Colorado, more particularly described as follows:
Commencing at the NW Corner of the NWT NE1 of Sec. 9;
Thence east along the north line of the NWT NE1 of Sec. 9
227.33 feet to a point. Said point being the true point
of beginning; Thence South 1149.69 feet; thence S77°35'E
168.35 feet; thence N16°54'W 70.00 feet; thence N35°51'E
150.26 feet; thence North 998.08 feet to a point on the
North line of the NWT NE1 of Sec. 9; thence West along
said North line 231.85 feet to the true point of beginning.
The above described tract contains 6.00 acres more or less.
except the North 30.00 feet thereof for Roadway.
WHEREAS, the owner of said tract of land desires to obtain a
variance from the minimum lot size requirement so that said
applicants may make application to the Board of County Commissioners
for a recorded exemption, as set forth in Section 9-4 .A. (6) of
the Subdivision Regulations, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, based upon the recommendations of the Department of
Planning Services, feels that the applicants have shown good cause
for granting a lot size variance under Section 9-4.A. (6) of the
Weld County Subdivision Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that a variance from lot
size requirements, be and hereby is, granted to John and Norma
Propp for the above described parcel of land.

RE : Lot Size Variance #65 and Recorded Exemption #323
Dear Commissioners:
The attached application, plat and related items are in reference to a
request by John and Norma Propp for a lot size variance and a recorded
exemption. The parcel of land in question is described as Pt . of the
NW* of the NE4 of Section 9, T1N, R68W of the 6th p.m. , Weld County,
Colorado. The property contains six acres of Class II irrigated soils.
The request is to split the property into two parcels each being three
acres in size. This property is located two miles northeast of Erie.
The Propp ' s have indicated in the submitted materials that they wish to
sell the existing improvements located on the proposed Lot A and build
a new home for themselves on the proposed Lot B which currently has no
improvements.
Based upon the information submitted and the adopted policies in the county,
the Department of Planning Services staff recommends the request be
approved for the following reasons :
1. The proposed split conforms with the intent clause of the recorded
exemption procedure (Section 9-2 of the Weld County Subdivision
Regulations) and the Weld County Comprehensive Plan. The six acre
parcel under consideration has a low utility for agricultural use
due to the small acreage of the property. The proposed use would
be compatible with the surrounding land uses which is residential
in character.
2. The Town of Erie Planning Commission has no objections to this
request.
