RE: APPROVAL OF RECORDED EXEMPTION NO. 300 - RICHARD PROUTY
AND SAM SHEPHERD.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing
held on the 16th day of January, 1978 , in the Chambers of the
Board of County Commissioners of Weld County, Colorado, that the
division into two parcels of a certain parcel of land, as shown on
the plat known as Recorded Exemption No. 300, being the property
of Richard Prouty and Sam Shepherd, located on a parcel of land
in Part of the NWa of Section 32, Township 6 North, Range 65 West
of the 6th P.M. , Weld County, Colorado and more particularly
described as follows:
Canmening at the Northwest Corner (NW Cor) of said
Section 32, Township 6 North, Range 65 West of the Sixth
Principal Meridian and considering the West line of the
Northwest Quarter (NA) to bear South 00°15'40" West with
all bearings contained herein relative thereto;
Thence South 00°15'40" West along said West line of the
Northwest Quarter (NWa) of Section 32, 1018.90 feet to the
True Point of Beginning of said parcel; Thence North
88°56'05" East, 724.32 feet to the Westerly Right-of-Way line
of U.S. Highway No. 85;
Thence South 07°27'30" East along said Westerly Right-of-Way
line of U.S. Highway No. 85, 373.11 feet;
Thence North 82°51'00" West, 70.50 feet;
Thence South 21°11'24" West, 169.93 feet;
Thence North 86°10'20" West, 355.77 feet;
Thence North 89°58'20" West, 288.47 feet to a point on said
West line of the Northwest Quarter (NWa) of Section 32;
Thence North 00°15'40" East along said West line of the
Northwest Quarter (NNWa) of Section 32, 482.27 feet to the
True Point of Beginning.
Said parcel of land contains 8.299 acres more or less and is
subject to any rights-of-way or other easements as recorded
by instruments of record or as now existing on said described
parcel of land.

under Section 30-28-101 (10) (d) , CRS 1973, as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations

and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973,
as amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove de-
scribed parcel of land owned by the Proutys and the Shepherds,
be exempt from the definition of the terms, "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-101
(10) (d) , subject to an additional 20 ft. right-of-way on 11th Avenue in Greeley.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 16th day of
January, A.D. , 1978.

RE: Recorded Exemption #300
Dear Commissioners :
The attached application, plat , and related items are in
reference to a request by Mr. & Mrs . Richard Prouty and Mr.
& Mrs. Sam Shepherd for a recorded exemption. The parcel of
land in question is described as Pt . of NWl Section 32 , T6N,
R65W of the 6th P.M. , Weld County , Colorado. Said property
is located approximately * mile north of the existing city
limits of Greeley on the east of side of North 11th Avenue.
The subject property contains 8 .299 acres of Commercially
Zoned property. The request is to split the property into
parcels of 2 . 196 acres and 6 . 103 acres .
As indicated in a letter submitted by Mr. Shepherd, Mr . Shep-
herd proposes to locate a warehousing facility for the dis-
tribution of fresh, frozen, and canned food products on the
2. 196 acres . The 6. 103 acre parcel has an existing residential
use and improvements located on it .
Based upon the information submitted and the adopted policies
in the County , the Department of Planning Services Staff recom-
mends the request be approved for the following reasons :
1 . The Greeley Planning Commission has indicated the
requested split complies with their Comprehensive
Plan and recommends the recorded exemption be ap-
proved subject to acquiring a 20 foot additional
right-of-way dedication for 11th Avenue, an arter-
ial street .
2 . The proposed split conforms with the recorded exemp-
tion intent clause and the Weld County Comprehensive
Plan. The use would be compatible with surrounding
land uses.

3. The request complies with the provisions of Section 9-4(A)
of the Weld County Subdivision Regulations.
The Department of Planning Services Staff further recommend that
the recorded exemption plat be amended to reflect the additional
20 foot right-of-way requested by the City of Greeley for North
11th Avenue, an arterial street, prior to recording the recorded
exemption plat .

Purpose:
To Locate and use a building 100 ft.
by 200 ft. for a warehouse and facility
to distribute fresh, frozen, and canned
food products.
Reason:
This building will replace the building
currently in use at 300 north 11th avenue.
We have expanded to the point where we must
have more storage and working area.
We receive numerous truckload lots of
merchandise and this has been creating a
problem with traffic during the time spent
unloading at the current location.
This location is outside the city limits;
therefore our trucks will not be on the city
streets as much as the current location.
The entry to the new location would be off
hi-way 85 by pass on the north end of city.

The requested exemption is on an 8 . 2 acre parcel zoned commercially.
A lot split of 6 . 1 and 2 . 1 acres is requested. On the 2 . 1 acre
site , it is proposed that a storage warehouse he constructed for
Sam' s Produce , a business now located on 11th Avenue inside the
City. The existing residential use on the 6 . 1 acre narcel would
continue .
It was noted that an additional 20 foot right-of-way dedication
is needed for an arterial street along 11th Avenue . The Compre-
hensive Plan indicates light industrial uses for the area .
The proposed use would comply. Staff found no problems with the

County Commissioners' Hearing Room, First Floor , Weld County

any questions the Board might have with respect to your appli-
