Dear Brad:
As you arc aware,the'1'own of Ault Is contemplating annexation of certain property in
Weld County per the above referenced application. The purpose of this letter is to formally
request waiver of the requirement under section 31-12-108.5 that an impact report be prepared.
We believe that the Town has already supplied all of the information required to be
• included in the impact report as set forth in the statute. The reason no report was prepared was
that the non-roadway acreage included in the proposed annexation is substantially less than the
ten acre threshold.
As you are aware, the hearing on the proposed annexation is scheduled for tomorrow
evening, so we respectfidly request a prompt response to this proposal. Thank you for your
attention to this matter.If the county wishes,a report could be prepared and filed,but we would
all need to extend the pending action dates.

Ault is considering a revised annexation plan,which my clients will oppose for a variety of reasons. 1 want to bring to
your attention an Impact Report,which has been prepared this time,as opposed to no report for the Initial plan. I
understand it was provide to the County on Friday or Monday,November 5,2012.
The point I want to make is that the Report indicates that NO Municipal services/utilities are being provided by the Town
of Ault.
Pursuant to Sec 19-13-60(B)of the Intergovernmental Agreement with Ault("The Auk Plan"),"The Municipality will not
annex properties located outside the Urban Growth Area[the property is outside]unless such property is both eligible
for annexation and is necessary to the Municipality for municipal purposes such as utilities."
The Intergovernmental Agreement is a contract between Weld County and the Town of Ault. I would request that Weld
County enforce the contract and inform the Town of Ault that it is violating the contract should it proceed with the

Cunningham Annexation#1 
Annexation Impact Report
November 2,2012
Introduction
Doris Cunningham has submitted a petition to annex her property consisting of approximately
3.5 acres into the Town of Ault. The property is currently developed and is currently zoned
Agriculture(A)in Weld County,but the current use is light industrial. The applicant is
requesting the Industrial zoning(I)in the Town of Ault.
The property is located on the east side of Weld County Road 33 approximately 1.5 miles north
of Colorado Highway 14. Annexation of this property will require annexing portions of
Colorado Highway 14 and Weld County Road 33 right-of-ways. In the appendix of this report is
a map showing the existing town boundary(Exhibit A)and the proposed town boundaries
(Exhibit B)as a result of this annexation.
Water
Ault receives potable water from North Weld County Water District through a master meter at
• 5th Street and Graefe Avenue. The water flows into an existing 0.50 million-gallon storage tank.
The tank is only 24 feet tall so the pressure must be boosted using pumps prior to entering the
distribution system. The pumping station has a capacity to pump approximately 1,600 gallons
per minute at a pressure of 67 psi. A map of the water system(Exhibit C)is included in the
appendix of this report.
The Cunningham property currently has a water well(Permit number 286516)permitted through
the State of Colorado. The site is allowed to use 108,600 gallons annually for commercial
drinking and sanitary purposes.
The property will continue to maintain the water well. It is not anticipated that any Town of Ault
waterlines will be extended with this annexation. The Town's water system may be extended in
the future as needed. It is the Town of Ault's policy to require development to pay for utility line
extensions.

The Town of Ault's wastewater is carried through the collection system and into the treatment
plant which is located at the south end of town and just west of 1"Avenue. The plant is a lagoon
system with a rated design capacity of 250,000 gallons per day(gpd). The current influent flow
to the plant averages approximately 90,000 gpd. A map of the sewer system(Exhibit D)is
included in the appendix of this report.

The Cunningham site currently utilizes an ISDS system to process sanitary waste water.No
commercial or industrial waste water is proposed to be processed in the ISDS system.The owner
assumes that the existing ISDS system may be inadequate for the proposed increased number and
duration of employees.
Baseline Engineering is in the process of performing a detailed design of a new ISDS system to
be submitted to and approved by the Weld County Department of Public Health and
Environment.The conceptual design assumes the need for a new vault and a new leach field with
the approximate dimension of 500 square feet.The new system is anticipated to be installed
south and west of the SW building corner,outside of vehicle traffic areas. The ISDS system will
also be inventoried with the State due to its capacity to serve 20 or more persons per day.
The Town of Ault does not anticipate the need to extend sewer service to the Cunningham
property with this annexation. At such time additional development in the area requires sewer
service,facilities will be extended. It is the Town of Ault's policy to require development to pay
for the extension of sewer lines.
Streets
This annexation will include bringing Weld County Road 33 into the Town of Ault from
Colorado Highway 14 to the Cunningham property which is located almost 1.5 miles to the
north. This will require the Town to take over maintenance of the street and the right-of-way of
CR 33 for 1.5 miles. The Town has completed a study that estimated the cost to maintain Weld
• County Road 33 over the next 20 years. It is anticipated that these costs will be offset by sales
tax revenues from the Ctmningham property annexation. The Town also anticipates additional
Highway User Tax Fund(HUFT)and Advancement for Surface Transportation&Economic
Recovery(FASTER)funds to help the additional maintenance costs associated with Weld
County Road 33.

Taxing districts within the Cunningham property include the following:
Weld County
Weld County School District RE9
Northern Colorado Water Conservancy
Ault/Pierce Fire
Aims Junior College
High Plains Library
West Greeley Soil Conservancy
RE9 School District
Annexation of this property into the Town of Ault should have no effect on Weld County RE9
School District. The property is currently developed and is already located within the RE9
District boundary.

withdrawn.
On Tuesday,December 4,2012 the Board of Trustees for the Town of Ault approved annexing the subject
property considered for the USR permit into Ault.The land use and zoning on the subject property are no
longer under the jurisdiction of Weld County.
