Said described parcel contains 1. 934 Acres, more or less, and WHEREAS, the petitioner was not present, and WHEREAS, there was no opposition to the request of petitioner to locate said dairy operation on the above described premises, and WHEREAS, the said requested dairy operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) (c) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be autho- rized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Otto Scheller, Route 1, Box 125, Ault, Colorado, to locate a dairy farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be PL0587 750187 approved by the State Health Department, 2. That petitioner shall proceed with due diligence to construct said dairy operation and shall have up to one (1) year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That petitioner shall obtain building permits prior to beginning any construction. 4. That when said dairy operation facility is completed, same shall be limited in pen size as shown on plans as submitted and as deter- mined by the Weld County Planning Commission. 5. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado, Dated this 11th day of June, A0D. ,D. , 1975. ESCROW 6. If no notice of objection to the marketability of title is given within such 30 day period then title shall be deemed to have been accepted by Purchasers. Sellers shall not be obligated to correct defects of title created by Purchasers or anyone claiming by, through or under them. - TAXES, INSURANCE,' WATER ASSESSMENTS (a) Sellers shall pay the taxes and water assessments -for the year 1974. (b) Premiums for existing fire insurance have been pro-rated and adjusted. • (c) Purchasers agree to pay all general and special taxes and water assessments levied and assessed for the year 1975 and there- after and all insurance premiums for fire insurance with extended coverage covering the improvements promptly when due and before the same become delinquent. Said insurance shall he made payable in the event of loss to the Sellers and Purchasers herein as their interests may appear and shall contain mortgage endorsements protecting the Federal Land Bank. A copy of said policy and en- dorsements thereto and all renewals thereof shall be furnished Sellers. The amount of insurance coverage shall be no less than that now carried by Sellers. - • -5- POSSESSION 9 . The land on which sugar beets were grown during the 1974 season has been rented as pasture to Robert W. Noffsinger who has the right to possession until February 1 , 1975, so possession of said portion of the above described property is reserved to Sellers. Sellers reserve the dwelling where they now reside and improvements surrounding the dwelling until February , r , 1975. Purchasers shall have possession of all of the remainder of the above described property upon the execution and delivery of this contract and payment of the down payment herein provided for together with the sum of $ S j ( - to compensate Sellers for the fall plowing of 82 acres of said land. MAINTENANCE 10. Purchasers agree to keep the improvements on the premises above described in good condition and repair throughout the term of this contract and in the event of a default causing forfeiture of this contract to re-deliver possession of the above described property and improvements to Sellers in as good condition and repair as the same now are, ordinary wear excepted. In the event Purchasers fail, refuse or neglect to pay the taxes, insurance premiums, water assessments and any other lawful assessments and charges against said property, Sellers may pay such taxes, insurance premiums, water assessments and other lawful assessments and charges and the cost thereof to the Sellers , together with interest thereon at 12 per cent per annum from the -6- date paid by Sellers shall become so much additional indebted- ness due and payable from the Purchasers to the Sellers before Purchasers become entitled to delivery of the deeds and abstracts of title as herein provided. DEFAULT 11. Time for payment of the purchase price together with taxes, insurance premiums, water assessments and other lawful assessments and charges are of the essence of this contract and failure of Purchasers to make such payments when due shall give the Sellers, at their option, the right to declare the entire unpaid balance of the purchase price due and payable after giving Purchasers 60 days ' written notice of intent to accelerate the due date. If within said 60 day period the default has not been remedied, then the entire unpaid balance of the purchase price shall be considered due and payable and non payment thereof shall render this contract null and void and of no further force and effect and Se_•lers shall be entitled to retain all payments made on account of the purchase price and to repossess the above described property as their first and former estate, or Sellers shall be entitled, at their option, to specific performance of this contract or any other remedy open to them by law or in equity. ALTERATIONS--ADDITIONS 12. Purchasers shall not make any alterations or additions to the improvements on the premises above described without the written consent of the Sellers first had and obtained, which consent shall not be unreasonably withheld. -7-- Purchasers shall not cause or permit or suffer any mechanic' s or materialmen' s liens to attach to the above described premises for non payment of costs of alterations or additions to the im- provements thereon. In the event any such liens are filed as a result of improvements or alterations made by Purchasers , Purchasers agree to have such liens released at their cost and expense upon demand of Sellers. ASSIGNMENT 13. Purchasers may not sell , assign or transfer this contract or any of their rights and privileges hereunder without the written consent of the Sellers first had and obtained. M. , all in Weld County, 6olorado. The site you have described and that shown on the accompanying map is composed of Nunn soil. It consists of deep well drained soils formed in calcareous loamy sediments on terraces, fans and uplands. In a typical profile the surface layer is clay loam about 10" thick. It overlies loamy material that extends to 60" or more. As far as suitability for animal waste sewage disposal system goes , there are no severe limitation on such a use. However, the soil permeability is slow because of the clay loam tex- ture. This can be ovircome, however, by adding more leach line.to the septic tank filter field. The soil survey is made on the basis of 50-60" borings. This infor- mation should only be used for general planning and does not exclude the need for on-site investigation for specific engineering purposes. W.
