W ` -'004- ,soc,.00 y - .� i ` z (U (I) x /y Cdu c� J C� \\ Fs, --vi -.on i} I of I W J 3 �, i V WE& VW \ - / i g§c, , \,,,/ , , Pph a.II H in „,-- —1 6181 RESOLUTION WHEREAS, a hearing was held on June 9, 1975, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the purpose of hearing the petition of Otto Scheller, Route 1, Box 125, Ault, Colorado, requesting permission to locate a dairy operation on the fol- lowing described property, to-wit: A parcel of ground located in the Northeast Quarter (NE4) of Section 10, Township 7 North, Range 65 West of the 6th Principal Meridian, Weld County, Colorado, being more particularly described as follows: Beginning at the Northeast Corner of Section 10, and considering the East Line of the Northeast Quarter (NE4) of said Section 10, as bearing South 00°15'05" West with all other bearings contained herein being relative thereto; Thence South 00°15'05" West along the East Line of the Northeast Quarter (NEA) of said Section 10, 180. 0 + feet; thence North 88 51'31" West, 468. 0 + feet; thence North 00°15'05" East, 180.0+ feet to the North Line of the Northeast Quarter (NE4) of said Section 10; thence South 88°51'31" East along the East Line of the Northeast Quarter (NE4) of said Section 10, 468. 0 ± feet to the Point of Beginning. Said described parcel contains 1. 934 Acres, more or less, and WHEREAS, the petitioner was not present, and WHEREAS, there was no opposition to the request of petitioner to locate said dairy operation on the above described premises, and WHEREAS, the said requested dairy operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3(3) (c) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be autho- rized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testi- mony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, that the application of Otto Scheller, Route 1, Box 125, Ault, Colorado, to locate a dairy farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be PL0587 750187 approved by the State Health Department, 2. That petitioner shall proceed with due diligence to construct said dairy operation and shall have up to one (1) year from date hereof to begin construction of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 3. That petitioner shall obtain building permits prior to beginning any construction. 4. That when said dairy operation facility is completed, same shall be limited in pen size as shown on plans as submitted and as deter- mined by the Weld County Planning Commission. 5. That all applicable subdivision and zoning regulations shall be followed and complied with in accordance with the Zoning Resolutions of Weld County, Colorado, Dated this 11th day of June, A0D. ,D. , 1975. (b) Premiums for existing fire insurance have been pro-rated and adjusted. • (c) Purchasers agree to pay all general and special taxes and water assessments levied and assessed for the year 1975 and there- after and all insurance premiums for fire insurance with extended coverage covering the improvements promptly when due and before the same become delinquent. The land on which sugar beets were grown during the 1974 season has been rented as pasture to Robert W. Noffsinger who has the right to possession until February 1 , 1975, so possession of said portion of the above described property is reserved to Sellers. Sellers reserve the dwelling where they now reside and improvements surrounding the dwelling until February , r , 1975. Purchasers shall have possession of all of the remainder of the above described property upon the execution and delivery of this contract and payment of the down payment herein provided for together with the sum of $ S j ( - to compensate Sellers for the fall plowing of 82 acres of said land. MAINTENANCE 10. Time for payment of the purchase price together with taxes, insurance premiums, water assessments and other lawful assessments and charges are of the essence of this contract and failure of Purchasers to make such payments when due shall give the Sellers, at their option, the right to declare the entire unpaid balance of the purchase price due and payable after giving Purchasers 60 days ' written notice of intent to accelerate the due date. If within said 60 day period the default has not been remedied, then the entire unpaid balance of the purchase price shall be considered due and payable and non payment thereof shall render this contract null and void and of no further force and effect and Se_•lers shall be entitled to retain all payments made on account of the purchase price and to repossess the above described property as their first and former estate, or Sellers shall be entitled, at their option, to specific performance of this contract or any other remedy open to them by law or in equity. ALTERATIONS--ADDITIONS 12. M. , all in Weld County, 6olorado. The site you have described and that shown on the accompanying map is composed of Nunn soil. It consists of deep well drained soils formed in calcareous loamy sediments on terraces, fans and uplands. In a typical profile the surface layer is clay loam about 10" thick. It overlies loamy material that extends to 60" or more. As far as suitability for animal waste sewage disposal system goes , there are no severe limitation on such a use. However, the soil permeability is slow because of the clay loam tex- ture. This can be ovircome, however, by adding more leach line.to the septic tank filter field. The soil survey is made on the basis of 50-60" borings. This infor- mation should only be used for general planning and does not exclude the need for on-site investigation for specific engineering purposes. W.
