Comments made during this stage of the review process will not be all inclusive as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 27 is a local paved road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. REQUIREMENTS: Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. All vegetation, other than grasses, needs to be maintained at a maximum height of 12 inches until the area is completely developed. Weld County Road Access Permit Form: Show the approved access on the plat and label it with the approved access permit number (AP#). This will be provided when a revised application form is received. Flood Hazard Development Standards: This area IS/IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency Management Agency (FEMA). Department of Public Health and Environment CASE NO.: PUDZ12-0002 NAME: Podtburg Sons Dairy The Weld County Health Department has reviewed this proposal. The applicant proposes to amend outlot 3 of Sierra Acres PUD to allow a residence to be constructed. The outlot is 23 .7 acres and will be served by North Weld County Water District and an individual sewage disposal system. The application has satisfied Chapter 27 of the Weld County Code in regard to water service. North Weld County Water District has provided a commitment to serve letter. The application has satisfied Chapter 27 of the Weld County Code in regard to sewer service. Sewer will be provided by an individual sewage disposal system. Percolation data is required when an application for a septic system is submitted. This Department is not requiring a septic system envelope due to the large lot size. This Department recommends that language for the preservation and/or protection of the absorption field envelope shall be placed as a note on the change of zone and the final plat. The note should state that activities such as landscaping (i.e. planting of trees and shrubs) and construction (i.e. auxiliary structures, dirt mounds, etc.) activities are expressly prohibited in the designated absorption field site. The environmental impact plan (section 27-6-40) adequately addresses all environmental impacts. The Department recommends approval with the following conditions, which should appear as notes on the change of zone and final plats: 1 . Water service shall be obtained from North Weld County Water District. 2. This subdivision is in rural WeldCounty and is not served by a municipalsanitary sewer system. Sewage disposal shall be by septic systems designed in accordance with the regulations of the Colorado Department of Public Health and Environment, Water Quality Control Division and the Weld County Code in effect at the time of construction, repair, replacement, or modification of the system. 3. During development of the site, all land disturbances stae conducted so that nuisance conditions are not created. If dust emissions createnuisance conditi ons, at the request of the Weld County Health Department, a fugitive dust control plan must be submitted. 4. In accordance with the Regulations of the Colorado Air Quality Control Commission any development that disturbs more than 5 acres of land must incorporate all available and practical methods that are technologically feasible and economically reasonable in order to minimize dust emissions. 5. If land development creates more than a 25-acre contiguous disturbance, or exceeds 6 months in duration, the responsible party shall prepare a fugitive dust control plan, submit an air pollution emissions notice, and apply for a permit from the Colorado Department of Public Health and Environment. 6. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County Code shall be placed on any recorded plat. 7. A stormwater discharge permit may be required for a development/redevelopment /construction site where a contiguous or non-contiguous land disturbance is greater than or equal to one acre in area. Case Number: PUDZ12-0002 Parcel Number: 080519101012 After reviewing the application and documents submitted to allow a single-family residence to be built on Lot 3 of Sierra Acres PUD A building permit will be required for any new construction, alteration, or addition to any building on the property. A building permit application must be completed and two complete sets of plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnibangineering report performed by a registered State of Colorado engineer or a open hole inspection shall be required. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Residential Building Code; 2006 International Energy Code; 2006 International 2011 National Electrical Code; and Chapter 29 of the Weld County Code.
