The Weld County Public Works Department reviewed the submitted application for critical items, including but not limited to Site Plan, Traffic Study, Preliminary Drainage Report, Geotechnical Soils Report, and Flood Hazard Development Permit. Comments made during this stage of the review process will not be all inclusive; as revised materials are submitted other concerns or issues may arise. All issues of concern and critical issues during further review must be resolved with the Public Works Department. COMMENTS: Weld County Functional Classification Map: (Revised Feb. 9, 2011 —Amended 10/2011) CR 25.5 is a local gravel road and requires a 60-foot right-of-way at full build out. There is presently a 60-foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Weld County Public Works has no average daily traffic count at this location. • REQUIREMENTS: Access improvements are required and shall include 60-foot radius to accommodate turning trucks and double cattle guard across the access to prevent the tracking of mud or debris on to the County roadway. An Improvements and Road Maintenance Agreement is required for this site. Public Works Department will provide a draft of the agreement after the Board of County Commissioner's hearing for this project. Weld County Public Works will work with the applicant on dust control adjacent to all homes within the designated haul route from the site, both north and south. Show and label the water quality feature area on the plat. It shall be located downstream of the parking and storage areas and labeled as (Water Quality-no build or storage area). Off-street parking spaces including the access drive shall be surfaced with gravel, asphalt, concrete or the equivalent and shall be graded to prevent drainage problems. Each parking space shall be equipped with wheel guards or curb blocks when necessary to prevent vehicles from extending beyond the boundary of the space and from coming into contact with other vehicles, walls, fences or plantings. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds. A Grading Permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit. A Weld County Road Access Permit Application Form is included in the packet. It will be required for all new roads, driveways or other means of providing ingress or egress to lands adjoining County rights-of-way. The application form shall be completed by the property owner to be accessed from a County road or his/her duly authorized agent as evidenced by written documentation. The applicant has supplied this document with pictures and a signature. A $75.00 fee shall be required for all new access points. Once the fee is received, your Access Permit will be processed. Show the approved access on the plat and label it with the approved access permit number (AP#). This will be provided when a revised application form is received. The property is currently vacant. There will be 2-4 full time employees and up to 30 employees accessing the site to pick up and drop off equipment and vehicles. An engineer designed commercial sewage disposal system will be installed for the proposed office and shop building. The applicant has submitted an application to the Colorado Division of Water Resources for a commercial well permit. The area is served • by Central Weld County Water District. The applicant submitted a letter from the District, dated March 13, 2012, indicating that they do not oppose the installation of any water well to serve land that is within their service area, as long as there is no direct impact from drilling of the well on the distribution of water from the District's water distribution system. The applicant submitted a dust abatement plan. Access drives and parking areas will be covered in gravel or road base, vehicles speeds will be controlled to minimize dust, and water or magnesium chloride will be applied to mitigate dust. Water will be supplied by an offsite source. The waste handling plan indicates that a dumpster will be provided and serviced by B&C Refuse of Platteville. According to the application, vehicle maintenance and repairs are not anticipated to be done on site, but if necessary, waste oils and antifreeze will be hauled offsite for recycling or disposal. In addition, shop floor drains will drain to a watertight vault. The applicant needs to include in the waste handling plan a list of wastes expected to be generated from maintenance and repair of the vehicles and equipment, including waste oils, antifreeze, batteries, scrap metal, tires and other scrap parts. In addition, the names, addresses and phone numbers of the waste handlers and disposal sites need to be provided. Also, include the contact information for the licensed waste hauler that will remove and dispose of the floor drain process wastewater. • • We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. In the event washing of vehicles will occur on site the applicant shall ensure that any vehicle washing areas shall capture all effluent and prevent discharges from the washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. Vehicle washing areas should be designated on the plat. 2. The applicant shall submit written evidence from the Colorado Division of Water Resources, demonstrating that the well is appropriately permitted for the commercial use. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: 1) A list of wastes which are expected to be generated on site (this should include expected volumes and types of waste generated). • 2) A list of the type and volume of chemicals expected to be stored on site. 3) The waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). We recommend that the following requirements be incorporated into the permit as conditions that must be met one month prior to construction activities: 1. The applicant shall submit evidence of a Colorado Discharge Permit System or CDPS permit from the Colorado Department of Public Health and Environment (CDPH&E), Water Quality Control Division, to cover stormwater discharges from construction sites (5 CCR-1002-61). Alternately, the applicant can provide evidence from CDPH&E that they are not subject to the CDPS requirements. We recommend that the following requirements be incorporated into the permit as conditions that must be met prior to the issuance of the Certificate of Occupancy: 2. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. • 2 • 3. The applicant shall submit evidence of an Underground Injection Control (UIC) Class V Injection Well permit from the Environmental Protection Agency (EPA) for any large-capacity septic system (a septic system with the capacity to serve 20 or more persons per day). Alternately, the applicant can provide evidence from the EPA that they are not subject to the EPA Class V requirements. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Any vehicle or equipment washing areas shall capture all effluent and prevent discharges from washing of vehicles in accordance with the Rules and Regulations of the Water Quality Control Commission, and the Environmental Protection Agency. 6. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement plan", at all times. 7. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 8. Adequate drinking, handwashing and toilet facilities shall be provided for employees and patrons of the facility, at all times. 9. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. • 3 • 10.A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 11.In the event the facility's water system serves more than 25 persons on a daily basis the water system shall comply with the Colorado Primary Drinking Water Regulations (5 CCR 1003-1). Evidence shall be provided to the Weld County Department of Public Health and Environment that the system complies with the Regulations. (25 people per day over a 60 day period) 12.Adequate toilet facilities (portable toilets) and hand washing units shall be provided during the construction of the facility. 13.Bottled water shall be utilized for drinking during construction of the project. 14.All potentially hazardous chemicals must be handled in a safe manner in accordance with product labeling and in a manner that minimizes the release of hazardous air pollutants (HAP's) and volatile organic compounds (VOC's). All chemicals must be stored secure, on an impervious surface, and in accordance with manufacturer's recommendations. 15. Process wastewater (such as floor drain wastes) shall be captured in a watertight vault and hauled off for proper disposal. Records of installation, maintenance, and proper disposal shall be retained. • 16.If applicable, the applicant shall obtain a stormwater discharge permit from the Colorado Department of Public Health & Environment, Water Quality Control Division. 17.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. Additionally, please note the following: 1. This application is proposing a well as its source of water. The applicant should be made aware that while they may be able to obtain a well permit from the Office of the State Engineer, Division of Water Resources, the quantity of water available for usage may be limited to specific uses, i.e. domestic use only, etc. Also, the applicant should be made aware that groundwater may not meet all drinking water standards as defined by the Colorado Department of Public Health and Environment. Structures that meet the definition of Ag-Exempt per Chapter 23 of the Weld County Code will require Certificate of Compliance application It are recommended that a code analysis be done on the project by a design professional with experience in this area. A building permit application must be completed and two complete sets of plans including engineered foundation plans bearing the wet stamp of a Colorado registered architect or engineer must be submitted for review. A geotechnical engineering report performed by a registered State of Colorado engineer shall be required. Buildings and structures shall conform to the requirements of the various codes adopted at the time of permit application. Currently the following has been adopted by Weld County: 2006 International Building Code; 2006 International Mechanical Code; 2006 International Plumbing Code: 2006 International Energy Code; 2006 International Fuel Gas Code; 2011 National Electrical Code; 2003 ANSI 117.1 Accessibility Code and Chapter 29 of the Weld County Code. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011 memorandums to county planning directors, this office will only perform a cursory review of the referral information and provide informal comments. The comments do not address the adequacy of the water supply plan for this project or the ability of the water supply plan to satisfy any County regulations or requirements. In addition, the comments provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the issuance of a well permit, or physical availability of water. • According to the submitted information, the proposal is use by special review and a site specific development plan for about 80 acres. Historically, the parcel was a poultry farm and the proposal is to convert it to a 15,000 head calf facility for raising dairy calves. The proposal includes equipment storage and maintenance and on-site employee housing. The proposal notes that the water supply will be provided by an existing water tap from CWCWD. There are two existing well permits on the property that were issued in the early 1960s. If the wells are still in existence and have been used within the last 10 years, the wells can continue to be used in compliance with the well permit conditions as follows: • 13914 — livestock use, located in the NE1/4 of the SE1/4 of Section 28. This well is limited to the watering of livestock on farms and ranches. Such wells cannot be used for the purposes of watering livestock within the proposed feedlot, as currently permitted. • 18692—domestic use, located in the SE1/4 of the SE1/4 of Section 28. A replacement well permit was issued for this well in 2003. However, no well completion information was ever submitted, and this office considers the replacement well permit expired.
