HomeMy WebLinkAbout20122260.tiff HEARING CERTIFICATION DOCKET NO. 2012-58 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR12-0036, FOR A MINERAL RESOURCE DEVELOPMENT FACILITY, INCLUDING AN OIL AND GAS SUPPORT AND SERVICES FACILITY (TWO COMPRESSORS AND ASSOCIATED EQUIPMENT AND STRUCTURES) IN THE A (AGRICULTURAL) ZONE DISTRICT - ROBERT AND MARIANNE ROHN, CIO STERLING ENERGY INVESTMENTS, LLC A public hearing was conducted on August 29, 2012, at 10:00 a.m., with the following present: Commissioner Sean P. Conway, Chair - EXCUSED Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer- EXCUSED Commissioner David E. Long Commissioner Douglas Rademacher Also present: Acting Clerk to the Board, Esther Gesick Assistant County Attorney, Brad Yatabe Planning Department representative, Kim Ogle Public Works representative, Don Carroll Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated July 20, 2012, and duly published July 25, 2012, in the Fort Lupton Press, a public hearing was conducted to consider the request of Robert and Marianne Rohn, c/o Sterling Energy Investments, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0036, for a Mineral Resource Development Facility, including an Oil and Gas Support and Services Facility (two compressors and associated equipment and structures) in the A (Agricultural) Zone District. Brad Yatabe, Assistant County Attorney, made this a matter of record. ID Chair Pro-Tem Garcia advised Dickie Smith and Cheyne Winslow, applicant's representatives, that they have the option of continuing this matter to a date when the full Board will be present. However, if they decide to proceed today, it will require three affirmative votes, or the matter will be deemed denied. Mr. Smith indicated he would like to proceed today. ID Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and stated staff received no inquiries regarding the application. He entered the favorable recommendation of the Planning Commission into the record as written and displayed an aerial site map and photographs of the site and surrounding properties. Don Carroll, Department of Public Works, provided a brief overview of the transportation plans and improvements, access, and stormwater requirements. t 01, Pt, P u-, 4L 2012-2260 G - O- PL2176 HEARING CERTIFICATION - ROBERT AND MARIANNE ROHN, CIO STERLING ENERGY INVESTMENTS, LLC (USR12-0036) PAGE 2 e Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions. Since there will be no employees on the site, Ms. Light requested the last sentence of Development Standard #8 be modified to state, "Portable toilets and bottled water are allowed for employees and contractors who are on the site for less than two (2) consecutive hours per day." She also reviewed the typical requirements for this type of facility. El Mr. Smith explained the purpose of the application is to expand an existing system which was constructed last year. F] No public testimony was offered concerning this matter. Mr. Winslow commended staff for their assistance through the project. Mr. Smith indicated agreement with the proposed revision to Development Standard #8, which Ms. Light reviewed. Mr. Carroll explained the intent of Development Standard #23 is to control the height of noxious weeds. Responding to Chair Pro-Tern Garcia, Mr. Smith and Mr. Winslow stated they and the applicant have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as proposed and modified. El Commissioner Long moved to approve the request of Robert and Marianne Rohn, do Sterling Energy Investments, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR12-0036, for a Mineral Resource Development Facility, including an Oil and Gas Support and Services Facility (two compressors and associated equipment and structures), in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards as entered into the record. His motion included an amendment to the last sentence of Development #8 to state, "Portable toilets and bottled water are allowed for employees and contractors who are on the site for less than two (2) consecutive hours per day.". The motion was seconded by Commissioner Rademacher, and it carried unanimously.
