RE: ACTION OF BOARD AT INITIAL HEARING CONCERNING RESCINDING USE BY
SPECIAL REVIEW PERMIT#1648 - RICHARD AND CYNTHIA STALCUP
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 4, 2008, the Board approved the application of Richard and
Cynthia Stalcup, 10475 County Road 19, Fort Lupton, Colorado 80621, for a Site Specific
Development Plan and Use by Special Review Permit #1648 for a Use Permitted as a Use by
Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts
(tree trimming business and truck parking) in the A (Agricultural) Zone District, on the following
described real estate, being more particularly described as follows:
Two parcels located in part of the SE1/4 of Section
9, Township 2 North, Range 67 West of the 6th
P.M., Weld County, Colorado
WHEREAS, the Department of Planning Services notified the applicant of outstanding
Conditions of Approval and items to be completed prior to recording the plat, by letters dated
January 28, 2009, and September 21, October 16, and December 12, 2012, and
WHEREAS, on the 25th day of January, 2012, an Initial Hearing was held before the
Board to consider granting additional time to meet all of the conditions/requirements of approval
and record the plat, or set a Final Determination Hearing to Rescind approval of Use by Special
Review Permit#1648 and Deny the application, and
WHEREAS, at said hearing, Richard (deceased) and Cynthia Stalcup were not present,
and
WHEREAS, after hearing all testimony presented, the Board deemed it advisable to
accept the applicant's request to Withdraw the application and refer the matter back the
Department of Planning Services staff.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of
Weld County, Colorado, that the applicant has demonstrated a willingness and ability to bring
the property into compliance by removing the commercial vehicles, and that the matter be, and
hereby is, referred back to the Department of Planning Services staff.

Remaining Outstanding Conditions of Approval:
There are a number of outstanding conditions associated with this USR that are still pending (Sign plan,
written request to vacate USR-1120, improvements agreement, landscape and screening plan, Satisfy any
Town of Firestone access permit requirements).
Staff Recommendation:
The applicant, Cynthia Stalcup, is requesting vacation of this USR. Her husband (who operated the
business has since passed away). This USR was originally initiated due to the operation of a commercial
tree trimming operation and associated commercial storage without obtaining necessary zoning permits
(ZCV07-01079). Ms. Stalcup has indicated that she does not intend to operate the business and is in the
process of listing and selling off the commercial equipment associated with this business. It should be
noted if the USR is vacated (because it is a zoning violation)—it goes back into the violation process.
Code Compliance indicated that it could give the applicant 60-90 days to bring the property into
compliance (remove the commercial equipment). Staff has spoken to Ms. Stalcup and she stated that she
intends to sell off the remaining vehicles (with the exception of one truck&trailer—which is allowed as a
use by right in the (A)Agricultural Zone District) and believes that the 60-90 day timeframe will be
sufficient. Staff is therefore in support of this request.

Dear Applicant:
The Planning Department is working through our historical case files in an effort to resolve unrecorded
and outstanding land use permits. You are receiving this letter because you have applied for a Use by
Special Review (USR) permit with Weld County but have never followed through the steps to complete
the process. You should have received another letter from me in September, 2011 and October, 2011,
concerning the same topic.
On June 4, 2008, your application for a Use by Special Review was approved by the Weld County Board
of County Commissioners with specific Conditions of Approval. At this time the conditions of approval
have not been satisfied and a Mylar Plat has not been recorded with Weld County Clerk and Recorder.
One of the required Conditions of Approval in the Board of County Commissioners resolution grants the
applicants thirty (30) days days to submit a Mylar Plat, and provide written evidence that all conditions
outlined in the resolution have been completed. Should you choose not to complete the Use by Special
Review process and provide the required Mylar Plat, the Department of Planning Services requests
written notification of your decision to withdraw the application and that the use is not active on the
property.
If you are unable to meet the Conditions of Approval and record the plat by January 25, 2012 an initial
hearing is scheduled with the Board of County Commissioners. The hearing will take place at the Weld
County Administration Building, located at 1150 O Street, at 9:00 am on January 25, 2012. It is strongly
encouraged that you attend this hearing. At this hearing the Board of County Commissioners has the
authority to grant additional time to meet all the conditions/requirements of approval and record the plat or
schedule a final determination hearing to rescind approval of Use by Special Review, USR-lan and

WCR 19, Ft. Lupton, Colorado has applied for a Weld County Special Use Permit to enable my wife and I
to carry on our family business of tree trimming and removal. Our home and property will be used for
equipment storage and wood storage. We have been through a couple of meetings with county officials
and one of their requirements of us is to make sure mineral right owners are notified and have the
opportunity to write back with any concerns about this permit change from agriculture to both
agriculture and D and C Tree Service use.

Concerning access to the property, the only access
to the property is the north driveway.
Storm drainage has never been a problem in such a
sandy type of soil that we have on the premises. Usually
the drainage soaks into the ground reasonably fast

Weld County Department Health and Environment's
response dated 2-25-08
With our tree trimming and removal business, we
generate many chips from tree limbs. The chips seem to
hold the dust down and keep it from being too muddy.
Our dust abatement plan would be the spreading of
these chips in places where the blowing dust is a
problem.
As far as truck washing, this will be done at nearby
truck washing bays located at Del Camino, Firestone, or
Ft. Lupton.
Vehicle repairs will be done by qualified mechanics
on their premises. Maintainence of vehicles such as oil
changes, etc. will be done with careful regard to
capturing waste oil. The waste oil will be stored in 55
gallon drums before taken to a waste oil recycling
business or a business or residence that has a waste oil
burning furnace.
The following is a list of wastes expected to be
generated on our business property.
1. Waste motor oil-55 gallon drums.
2. No chemicals shall be stored on our
sight except the usual household
chemicals.
3. Waste Management disposes of our
household wastes two times per month
collected in a dumpster.
As far as noise is concerned, there will be minor
noise from a minimal log splitting operation.
Our septic system is up to date as we have a 1200
gallon tank with a newer leach field. Care will be taken to
not park on our septic system. Existing water will be used
from Central Weld Water.
