RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 281 - EDWIN ANDERSON. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter , is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board of County Commissioners has determined at a public meeting held on the 7th day of November, 1977, in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land, being the property of Edwin Anderson, located on a parcel of land described as Part of Section 32 , Township 2 North, Range 68 West of the 6th P.M. , Weld County, Colorado, and more particularly described on Exhibit "A" , a copy of which is attached hereto and incorporated herein by reference, and does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and Section 2-1A (3) of the Weld County Subdivision Regulations. The parcel of land in question is described as Pt. of Section 32, T2N, R68W of the 6th P.M. , Weld County, Colorado. Said property is located 1 mile east and 3 miles north of Erie. The subject property contains approximately 270 acres of Class I , II , and III irrigated soils. The request is to split the property into parcels of 243. 768 acres and 26.232 acres. The 243. 768 acre parcel contains an existing set of residential improvements as well as several out buildings including a labor house. As indicated in a letter submitted from Mr. Anderson the 26. 232 acre parcel is proposed to he severed from the remainder of the property and utilized as a new homesite for Mr. and Mrs. Albert Walker who have been farm tenants for Mr. Anderson. As indicated in that letter, the 26.232 acre parcel is separated from the rest of the farm by the Boulder and Weld Ditch. Further, the 26. 232 acre parcel is irrigated by a different ditch (the Lower Boulder Ditch) and therefore, it does not logically fit in with the farming of the rest of the property. Based upon the information submitted and the adopted policies in the County, the Department of Planning Services staff recommends the request be approved for the following reasons : 1. The proposed split conforms with the intent clause of the Recorded Exemp- tion procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural District (Section 3 . 3a of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan in that the use would be compatible with the surrounding agricultural uses. 2. The request complies with the provisions of Section 9-4(a) of the Weld County Subdivision Regulations. 3.
