RESOLUTION RE: APPROVE AGREEMENT FOR PROVISION OF WATER AND SEWER SERVICE IN EXCHANGE FOR REAL PROPERTY AND IMPROVEMENTS AND AUTHORIZE CHAIR TO SIGN -TOWN OF GROVER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the Town of Grover, 315 Chatoga Avenue, Box 57, Grover, Colorado 80729, commencing upon full execution, with further terms and conditions being as stated in said agreement, and WHEREAS, pursuant to said agreement, the Town of Grover will provide water and sewer service to a Weld County grader shed located on property described as: Lot B of Recorded Exemption, RE-4158; being part of the SW1/4 of Section 32, Township 11 North, Range 61 West, in exchange for real property and improvements owned by Weld County located at 117 South Crook Street, Grover, Colorado 80729, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for the provision of water and sewer service in exchange for real property and improvements between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, and the Town of Grover be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. RECITALS WHEREAS, the County is the owner of certain real property (hereinafter "Property A") described as Lot B of Recorded Exemption RE-4158, part of the SW1/4, Section 32, Township 11 North, Range 61 West, and located west of the Town limits; and WHEREAS, the County intends to construct a grader shed on Property A; and WHEREAS, the County is the owner of certain real property and improvements thereon, namely a grader shed, located at 117 South Crook Street (hereinafter "Property B") within the Town limits; and WHEREAS, the County's proposed grader shed on Property A requires water and sewer connections; and WHEREAS, the Town is willing and able to provide such water and sewer connections to Property A in exchange for Property B, the existing improvements thereon, and a ten-thousand dollar payment from the County; and WHEREAS, the County desires to begin construction of the proposed grader shed on Property A as soon as practicable; and WHEREAS, the County will need to utilize the existing grader shed facility located on Property B until the proposed grader shed on Property A is fully functional. NOW THEREFORE, in consideration of the above recitals and the mutual covenants of the parties, the Town agrees to provide water and sewer connections to Property A in association with the proposed grader shed in exchange for the County transferring ownership of Property B, and all existing improvements thereon, and a payment of ten-thousand dollars pursuant to the following terms: 1. For purposes of this Agreement, the parties agree that the cost for the Town to extend water and sewer lines to Property A is thirty-one thousand dollars. Additionally, the cost for installation of water and sewer taps by the Town is three-thousand dollars. The parties further agree that Property B and the improvements thereon are valued at twenty- four thousand dollars. 3. Construction Of Water and Sewer Connections. Upon execution of this Agreement by both parties, the Town agrees to extend water and sewer lines and install water and sewer taps to service Property A as soon as practicable. Such extension and installation shall be in consultation with the Weld County Department of Buildings and Grounds and/or the Weld County Public Works Department. 4. Ten-Thousand Dollar Payment. Upon satisfactory, as determined by the County in consultation with the Town, extension of the water and sewer lines and the installation of water and sewer taps by the Town, the County shall pay ten-thousand dollars in the form of a Weld County warrant to the Town. 5. Transfer of Property B, Existing Grader Shed. The County shall continue to utilize the existing grader shed on Property B until such time that the grader shed facility on Property A is fully operational. The County shall notify the Town in writing of its intent to transfer Property B to the Town least sixty days prior to such transfer. In such written notice, the County shall specify a date certain (hereinafter the "Closing Date") upon which a general warranty deed transferring Property B shall be delivered to the Town transferring all of the County's interest in Property B, and the improvements thereon, to the Town. The Town shall be obligated to accept title and ownership of Property B upon the Closing Date unless the Town is relieved of such obligation pursuant to subparagraphs (c) or (d) below. a. Transfer of Improvements and Fixtures. The transfer of Property B shall include all of the improvements, namely the grader shed facility, existing upon Property B at the time the County vacates Property B. Existing grader shed fixtures existing upon Property B at the time the County vacates Property B, including but not limited to the fuel tanks, shall also be transferred to the Town. b. Property B Transferred "As Is." Property B and the improvements thereon shall be transferred to the Town in "as is" condition and the County shall have no obligation whatsoever to make repairs to or replace any improvements or parts thereof. Furthermore, upon transfer of Property B, the County shall have no obligation to correct environmental or other existing hazards or conditions unless mutually agreed upon by the parties prior to the Closing Date in writing pursuant to subsection (c) below. c. Right To Inspect. Upon receiving notice of the Closing Date, the Town or its designee shall have the right, at its sole cost, to inspect Property B and any improvements thereon. Written notice of material unsatisfactory conditions indicated by any inspection shall be received by the County prior to the Closing Date or the physical condition of Property B shall be deemed satisfactory to the Town. If such notice is received by the County prior to the Closing Date, and if both the County and the Town have not agreed in writing to a settlement thereof prior to the Closing Date, the Town shall not be obligated to accept title to Property B unless the Town waives in writing objection to any material unsatisfactory condition. If the Town is relieved of the obligation of accepting title to Property B, the Town shall be entitled to a payment of twenty-four thousand dollars from the County as the Town's sole remedy in lieu of such property transfer. d. Title Insurance. If so desired by the Town, obtaining title insurance for Property B shall be at the Town's sole obligation and cost. Should, after best efforts to do so, the title company chosen by the Town is unable to unconditionally and irrevocably commit to issuing a title insurance policy for Property B prior to the Closing Date, the Town shall not be obligated to accept title to Property B and shall be entitled to a payment of twenty-four thousand dollars from the County as the Town's sole remedy in lieu of such property transfer. e. Disclosure of Matters Not of Public Record. The County shall disclose to the Town any easements, liens, or other title matters not shown by the public records of which the County has actual knowledge at least thirty days prior to the Closing Date. This disclosure obligation on the part of the County is ongoing from the date of the initial disclosure up until the Closing Date. f. Payment Of Encumbrances. Any encumbrance required to be paid on Property B shall be paid by the County prior to the Closing Date. 6. Additional Provisions. a. Notice. Notice provided for in this Agreement shall be in writing and deemed effective upon receipt by the intended party. b. Entire Agreement. This Agreement constitutes the entire Agreement between the parties relating to the subject hereof, and any prior agreements pertaining thereto, whether oral or written, have been merged and integrated into this Agreement. No subsequent modification of any of the terms of this Agreement shall be valid, binding upon the parties, or enforceable unless made in writing and signed by the parties. c. Not Assignable. This Agreement shall not be assignable by the Town without the County's prior written consent. No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties as governmental entities, including their officers, employees, or agents may possess pursuant to the Colorado Governmental Immunity Act §524-10-101 C.R.S., et seq. e. No Third Party Beneficiary Enforcement. It is expressly understood and agreed that the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. f. Severability If any clause, provision, subsection, section or article of this Agreement shall be held to be invalid, illegal or unenforceable for any reason, the invalidity, illegality or enforceability of such clause, provision, subsection, section or article shall not affect any of the remaining provisions of this Agreement. Co. 1.0 EXECUTIVE SUMMARY This report documents MEC Inc's findings from our Phase I Environmental Site Assessment of the property located at 117 S. Crook St., Grover, Colorado. MEC Inc. has attempted to perform a Phase 1 Environmental Site Assessment in conformance with the scope and limitations of ASTM Standard Practice E 1527-0. of the 117 S. CROOK ST., Greeley, Colorado location. This assessment reviewed the readily available information for issues that may be considered current and historical recognized environmental conditions associated with hazardous materials/wastes or petroleum materials in connection with the Subject Site and also some non-Rec conditions. Any exceptions to, or deletions from, the standard practice are described within Section 2.0 of this report. This assessment did not identify current or historical recognized environmental conditions associated with hazardous materials/wastes or petroleum materials in connection with the Subject Site. Listed below and discussed within the report are potential non-Rec or non-ASTM conditions that may be associated with the property. General EPA AM Rule Requirement The EPA AAI Rule requires that the property owners (both existing and tenure owners) to operate in a manner not cause adverse impact to the environment. In addition. the property (miters are responsible for monitoring the environmental conditions of offsite properties that may impact the subject site. 'therefore. best management environmental practices are recommended for the future use of the site. This notice is included in the findings to inform all parties invol‘ed in the property transaction. Non Scope ASTM Issues (Dc Minimis Conditions) It is beyond the scope of this report to provide a detailed evaluation of non-scope issues such as asbestos. lead paint. radon. or drinking water quality, etc. It is recommended that any future activities that may disturb the building materials comply with applicable regulations pertaining to potential: asbestos containing building materials, lead based paint. mold, radon, and lead in drinking tx,ater. Note. there are other non-ASTM issues that may influence potential environmental conditions. therefore. it is suggested that property management comply with applicable regulations and guidelines. Current Site Activities Based on current site activities. the possible environmental management practices that may be applicable to future site use include: I) establish procedures to limit the potential for a release associated with the AST: 2) do not dispose of chemicals in any drains on the property: 3) follow all applicable regulations pertaining to zoning_ requirements: and 4) provide secondary containment for hulk chemicals fuels. lubricant storage and waste materials on the site. These suggestions are considered as examples. the actual environmental best management practices will depend on the site activities and use. The current site activity uses two bulk diesel fuel AST. No records of release was reported in the regulatory records. MEC Inc. -2012.157 3 117 S. Crook St.. Grover. Co. 2.0 INTRODUCTION 2.1 General MEC Inc. was retained by Weld County Government, to prepare a Phase I Environmental Site Assessment, in conformance with the American Society for Testing and Materials (ASTM) Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process El 527-05, on the Subject in accordance with the submitted proposal and scope of work. 2.2 Purpose and Scope 2.2.1 Purpose The purpose of this report is to identify Recognized Environmental Conditions in connection with the property, using the methodology recommended by the American Society for Testing and Materials (ASTM) in order to qualify for the innocent landowner defense to CERCLA liability and/or to help understand potential environmental conditions that could materially impact the operation of the business associated with the Subject. Specifically. this methodology is referred to as Standard Practice for Environmental.Sae Assessments: Phase 1 Environmental Sae Assessment Process Designation: 1: 15_27-t15. The term Recognized Environmental Conditions is defined by the American Society for Testing and Materials (ASTM) Standard F 1527-05 as "...the presence or likely presence of any hazardous substances or petroleum products on a property under conditions that indicate an existing release. a past release, or a material threat ofa release of any hazardous substances or petroleum products into structures on the property or into the ground. ground water, or surface water of the property. The term includes hazardous substances or petroleum products even under conditions in compliance with laws. The term is not intended to include de nzinimis conditions that generally do not present a material risk of harm to public health or the environment and that generally would not be the subject of an enforcement action if brought to the attention of appropriate governmental agencies.- 2.2.2 Scope In general. the scope of this assessment consisted of reviewing readily available information and environmental data relating to the property; interviewing readily available persons knowledgeable about the site: reviewing readily available maps. aerial photographs and records maintained by federal. state, and local regulatory agencies: and conducting a site visit. Of importance, the client is advised that federal, state, and local laws may impose environmental assessment obligations beyond the scope of this practice. The client is also notified that there are likely to be other legal obligations with regard to hazardous \IEL Inc 2012.15` 4 117 S. Crook St., Grover, Co. substances or petroleum products discovered on the Subject that are not addressed in this practice and that may pose risks of civil and/or criminal sanctions tin non-compliance. The specific scope of this assignment included the following: 2.2.2.1 Performing a site recomtaissance to characterize on-site conditions and assess the site's location with respect to surrounding property uses and natural surface features. In addition, MEC Inc. conducted a reconnaissance of the surrounding roads and readily accessible adjacent properties to identify obvious potential environmental conditions on neighboring properties. Photographs taken as part of the site reconnaissance are provided in Appendix A. The site was visited by Mr. John Mahoney representing MEC Inc. on July 6, 2012. It was clear and the temperature was approximately 95° F at the time of the site visits. MEC Inc. conducted the site reconnaissance of the property in a systematic manner focusing initially on the exterior, which was surveyed in a grid pattern. MEC Inc. also surveyed all accessible interior portions of the buildings in a systematic manner. Inaccessible portions of the property will he noted in the report. 2.2.2.2 Interviewing persons familiar with the property to obtain inlormation on present and previous on-site activities potentially resulting in the environmental degradation of the site or adjoining properties. MIX Inc. provided a Pre-survey Questionnaire to representatives of the buyers and selling parties involved in this property transaction. Copies or the completed questionnaires are included in the appendices. Crook St., Grover, Co. 2.2.2.5 Reviewing readily available environmental databases maintained by federal, state, and local agencies within the approximate minimum search distances as described within the Regulatory Review Section 5.0 of this report. A copy of the Computerized Environmental Report. provided by Environmental First Search, is included in Appendix D. 2.2.2.6 Non-ASTM issues are characterized as issues that do not involve hazardous materials (chemicals and wastes). or petroleum materials which are not included in the Phase I assessment in detail. MEC Inc. will briefly discuss non-ASTM issues (as listed below) in the report. 2.2 Data Gaps According to § 3.3.20 of ASTM Standard F 1527-05 a data gap is a lack of or inability to obtain information required by the ASTM Standard despite good faith efforts to gather same. Data gaps may result from incompleteness in any of the activities required by the by the ASTM Standard. Crook Si, Grover, Co., at the intersection of Crook Street and Stoney Avenue. The local tax maps illustrating the subject location is included in the Appendix C. The Site Plan is also included in Appendix A. 4.2 Surrounding Land Use The property is located in an urban setting characterized by residential, commercial and industrial developments. Based on the vicinity site reconnaissance, no visual indications of environmental concerns\+'ere identified associated with adjacent properties or other properties in the ieinitV. Additional information pertaining to the current and historic regulatory status of offsite locations in the vicinity are discussed in Section 6.0. \'IEC Inc. 2012.15' 117 S. Crook St.. Grover. Co. 4.3 Physical Site Setting 4.3.1 Size and Shape of Parcel The subject property includes approximately 0.241 acres and is rectangular in shape. The site boundaries and location are illustrated on the site figures in Appendix A and the assessor records in Appendix C. 4.3.2 'topography The site is essentially level with a slight easterly slope. The topography of the area is best described as having a regional slope to the east. According to the United States Geological Survey (USGS) South Grover, Co. 7.5 Minute Series topographic map, the Subject's topographic elevation is approximately 5068' above mean sea level mist). 4.3.3 Surface Waters and Wetlands Surface Waters No surWcc water features are present on the subject parcel. As illustrated on the local topographic maps are a few intermittent pond features to the south and cast. within one mile of the subject site. Wetlands MK' Inc. did not observe any areas suspected to be wetlands on-site. No wetlands maps were found on the subject site according to the National Wetlands Inventory. US Department of the Interior. Fish and Wildlife Service records. Based on this review, MEC Inc. did not identify any federally regulated wetlands located on or adjacent to the subject properly. .Additionally. MEC Inc. did not observe vegetation characteristic of wetlands on the subject site. According to FEMA Flood Plain Maps reviewed at the Weld County Public Works Department, the subject property is not located within the 100-year flood plain area. 4.3.4 Soils, Geology and Groundwater Geology The subject site and vicinity is situated in the High Plains physiographic province. The subject site area is characterized by gently rolling to relatively flat topographic features. The regional surface geology in the subject site vicinity according to the State of \IFC Inc. 2012.157 9 117 S. Crook St., Grover, Co. Colorado Geologic Map (1979), is characterized by Quaternary — Eolium deposits (Map Id 'Qe') consisting of wind blown sand, silt, clay deposits. The geologic map does not illustrate the presence of faults or other geologic features of potential concern. Groundwater According to regional groundwater information obtained from the State of Colorado Engineers office the depth to water in the vicinity is greater than 30 feet below grade. Natural Resources Natural resources such as sand/gravel, or petroleum are or have been commonly exploited in the vicinity within one mile from the subject site. 4.4 Site Improvements 4.4.1 Utilities the Subject is served with the following utilities: Water. Sanitary Sewer, Electric. and Natural Gas. Public drinking water quality pertains to the water supplied to the property. It does not include water quality associated kith on-site plumbing fixtures, pipes, and sodder. Stormwater management in the area is provided by the local municipality. On site storm cater controls include parking lot drains and a curb cut outlall on the northeast corner of the property. 4.4.2 Building and Property Description Building the subject property is developed ccith a metal frame structure. The building has a concrete floor and is not equipped with a basement. The ceiling and walls are insulated kith batt insulation. The building is equipped with an overhead garage door on the east side. The exterior portion of the property is has an earthen/gravel surface. On the north side of the building. are two fuel aboveground storage tank located within a concrete secondary containment structure. \If( Inc. 2012.157 10 117 S. Crook St., Grover. Co. 4.5 Current Property Use At the time of the site visit, the onsite Weld County representative indicated that the county moved the building to the site (from Ault) circa 1963. Prior to that time the property had been undeveloped. The property is used as a base of operation for the snow plow and grader trucks used by the county for road maintenance. Truck service and repairs are performed offsite or onsite by a mobile service vehicle. Vehicle lubrication is the common type of vehicles service performed on the site. In addition, the addition oil, windshield wash, hydraulic oils are performed. The maps were originally created to assist insurance underwriters in understanding the potential fire risk of structures requiring insurance: how ever. they are also useful in determining the previous uses of a property. Sanborn 'daps often contain information relating to uses of individual structures. location of certain petroleum and chemical storage tanks. and the storage of other potentially toxic substances. The subject site and the vicinity were not covered in the Sanborn Map collection. from 1927 through 1969, reviewed at the Denver County I listorical library. 5.4 Aerial Photographs Aerial photographs frequently provide visual documentation of site conditions at the time of the photographs. MEC' Inc. reviewed historic aerial photographs provided by the Denver County History Museum, the USDA Weld County Soil Survey,and Mapcard Services Website. The assessor records indicate that the current property owner of the 117 S. Crook St. property is Weld County. 5.6 Previous Reports MEC Inc. requested any available environmental documentation pertaining to the subject site. No prior environmental reports for the site were provided. 5.7 City Directories Historical Weld County directories were reviewed at the Denver County History Museum for the years: 1989, 1988, 1985, 1982, 1979. 1976, 1972, 1969. 1961, 1947. No listings were found for the subject address I property / or the Town ofGrover. Copies of directories from the 1980's are included in Appendix C. 5.8 Building Plans and Permits MEC Inc. was not provided plans or permits. 5.9 County Assessor's and County Clerk Records The county assessor records. as reported for the subject site address (1 17 S. Crook St). identified the site parcel number as 029105117003. MEC Inc. reviewed the county clerks computer records for historic ownership documentation and environmental liens/covenants. This review is not considered a certified chain of title or environmental lien search. The accessible county clerk computer records cover from 1981 to the present. MEC Inc. reviewed the database for known former tenants or owners. No records of environmental liens or covenants. The C'ler'k and Assessor records indicate that the current site ownership as Weld County. 5.10 Interviews MIX Inc. interviewed Mr. Toby Taylor, Weld County representative. prior to going to the site. Mr. Taylor indicated that the county constructed the building more than 20 years ago. To his knowledge the property had been undeveloped prior to the current development. The property is used as a base of operation for the snow plow and grader trucks used by the county for road maintenance. Truck service and repairs are performed offsite or onsite by a mobile service vehicle. Vehicle lubrication is the common type of vehicles service perforated on the site. A limited amount of lubrication and other vehicle fluids are stored on the site. Mr. Taylor indicated that he was not aware of any environmental concerns associated with the property. Mr. Steve Harrier, Weld County employee. has worked at the location for more than 30 years. Ile indicated that the building on the subject property was moved to the property circa 1963, from Ault. Colorado. It is his understanding that the property was undeveloped prior to the constnution/moving of the existing building. Mr. Harrier indicated that prior to the construction of the existing building the county had operated out of a structure that was located immediately across Crook St. The two fuel ASTs were placed on the property circa 1994. Mr. Harrier was not aware of any environmental concerns associated with the property. He also recalls the removal of the USTs at the former gas station located one block to the north. Mr. Han-icr confirmed that aside from lubricating the equipment on the site, all vehicle service is done offsite or by a mobile service vehicle that comes to the site. In most cases used vchicle fluids such as used oil is removed from the site by the service vehicle. 5.11 Vicinity Historical Developments No definitive environmental concerns were identified associated with current or historical vicinity activities. Environmental regulatory database information for the subject site and the vicinity is reviewed in Section 6.0. Sites of potential environmental concern are noticed in the report. MEC Inc. attempted to locate these sites via a review of street maps, vehicular reconnaissance and/or interviews with people familiar with the area. The information pertaining to the other"Orphan Listings" are not considered a potential concern based on the information provided or they are situated outside the respective database search radius. These sites are discussed as necessary within the respective database listings. A description of the databases reviewed by MEC Inc. and an analysis of sites identified within the prescribed search area are presented below. 6.1 Federal Databases NP1. The NFL database is a listing of the most serious uncontrolled or abandoned hazardous waste sites identified for possible long-term remedial action under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or"Superfund"). A site must be on the NPL to receive money from the Trust Fund for Remedial Action. Analysis/Comment: The CFR did not identify NFL sites within a one-mile radius of the Subject. Delisted NPL. Site List The EPA may delete a final NPL. site if it determines that no further response is required to protect human health or the environment. Under Section 300.425(e) of the National Contingency Plan (55 FR 8845. March 8. 1990). Sites that have been deleted from the NFL. remain eligible for further Superfund-financed remedial action in the unlikely event that conditions in the future warrant such action. Partial deletions can also be conducted at NPL sites. Analysis/Comment: The CER did not identify any Delisted NPL sites NN thin a one-mile radius of the Subject. CERCLIS CERCLIS is the I:SEP/Vs system for tracking potential hazardous-waste sites within the Superfund program. A site's presence on CERCLIS does not imply a level of federal activity or progress at a site. nor does it indicate that hazardous conditions necessarily exist at the location. A\Ahin one year of being entered into CIRCUS. the USEPA performs a preliminary assessment of a site. Based upon the results of the preliminary assessment. the USEPA may conduct additional investigation. which could lead to a site being listed on the NPL. Annit'sis/Comment: The C'ER did not identify the subject site on the CERCLA database. Also, no CERCLA site scere identified within the one-mile radius of the Subject. \IEC Inc. 2012.157 I o 117 S. NFRAP sites may be sites where, following an initial investigation, no contamination was found, contamination was removed quickly without the need for the site to be placed on the NPL, or the contamination was not serious enough to warrant Federal Superfund Action or NPL. consideration. Analysis/Counnent: No CERCLA NFRAP sites were identified in the CER within the prescribed radius. RCRIS TSD The RCRIS TSD contains information pertaining to those facilities that treat, store. or dispose of hazardous waste. While these facilities represent some form of hazardous waste activity. they are most significant if determined to be out of compliance or to have violations. Analysis/Comment: No RCRIS TSD thcilities was identified in the CER within the prescribed search radius. RCRIS Generators MEC' Inc. reviewed the list of sites, which have tiled notification with the USEPA in accordance with RCRA requirements. These sites include generators of hazardous waste regulated under RCRA. Under RCRA. hazardous waste generators are classified by the quantity of hazardous waste generated in a calendar month into the following categories: Large Quantity Generator, greater than 1.000 kilograms (kg); Small Quantity Generator, 100 to 1.000 kg: and Conditionally-Exempt Small Quantity Generator CFSQG), less than 100 kg. RCRA Generators, while they represent some form of hazardous waste activity. are most significant if they are determined to have Class I Violations or to be non- compliant. This section also includes RCRA sites that are No Longer Reporting (RCRA NL.R). Analysis/Comment: The subject site and no other locations were indent ified on the RCRA and RCRA NLR databases within the specified search radius. Corrective Action Tracking System (CORRACTS) CORRACTS is a list of facilities that are found to have had hazardous waste releases and require RCRA corrective action activity. which can range from site investigations to remedtation. Analysis/Comment: No CORRACTS sites were identified in the CER within the prescribed radius. ERNS The ERNS is a database of notifications of oil discharges and hazardous substance releases made to the Federal government. These notifications are used by "On-Scene ?IEC Inc. '012.1;7 1 I7 S. Crook St., Grover. Co. Coordinators" to determine an emergency response and release prevention. When a call is made to the National Response Center or one of the 10 USEPA Regions, a report is created containing all of the release information that the caller provided. This report is transferred to an appropriate agency to evaluate the need for a response and the records are electronically transferred to the ERNS database. As such, if a reported release of oil or a hazardous substance is deemed to require a response, it should also be listed in the appropriate federal or state environmental database such as CERCLIS, state equivalent CERCLIS. or state leaking underground storage tank or spills lists. Analysis/Comment The Subject site and no other sites were not listed on the ERNS database. Federal Institutional ControUEngineering Control Registries These Federal registries contain listings of those sites which have either engineering and/or institutional controls in place. Engineering controls include various physical control devices such as fences. caps. building slabs, paved areas. liners and treatment methods to eliminate pathways for regulated substances to enter the environment or effect human health. Institutional controls include administrative measures. such as ground hcater use restrictions. construction restrictions, property use restrictions and post remediation care requirements intended to prevent exposure to contaminants remaining on site. Deed restrictions (Activity and Use Limitations) are generally required as part of institutional controls. Analysis/Comment the CER did not identify the Subject on the Federal Institutional or Engineering Control registries. 6.2 Colorado Department of Public Health and Environment Databases Colorado and Tribal NPL. Equivalent Hazardous Waste Sites (HWS) Colorado does not generate its own list of NPL Equivalent Hazardous Waste Sites (HWS) site list. The state of Colorado uses the US EPA listing of NPL or CERCLIS I lazardous Waste sites. The Tribal NPL Equivalent HWS list is an inventory of toxic sites listed by Tribal Lm ironmental and Health Authorities. These sites are either under remediation, or are currently under evaluation for further action. if necessary. Analysis/Comment: Therefore, the review of the NPL or CERCLIS I lazardous Waste Sites within the vicinity of the subject site is.are discussed above in the respective NPL or CERCLIS sections. Colorado and/or Tribal Solid Waste Facilities (SWF) List The SWF list is an inventory of landfills, incinerators, transfer stations, and other sites that manage solid vpastes. .Innlrcis/Conrnrent: No confirmed SWF sites were identified within the prescribed search radius. Colorado Registered Underground Storage Tanks Facility List and/or Tribal Registered Storage Tanks (RST) Facility List The source of the Colorado Registered Underground (UST) and Aboveground Storage Tanks(ASTs) Facility List is the Colorado Department of Labor and Employment, Oil Inspection Division. The storage tank facility list is an inventory of registered petroleum storage facilities. Inclusion ofa site on the UST or AST list does not necessarily constitute an environmental condition but instead merely indicates the presence of registered underground storage tanks (USTs) or aboveground storage tanks (ASTs). The RST facility list is an inventory of registered liquid bulk storage tanks maintained by Tribal Authorities. Inclusion ofa site on the RST list does not necessarily constitute environmental contamination, but instead merely indicates the presence of registered bulk storage tanks. Analysis/Comment: The C'FR database review identified I UST/ASTs within the prescribed search radius. including the subject site. The COSTIS records indicate that the 1000 gallon AST was placed in Temporary Closure in 2007 as part of an enforcement action, ID # 36795. The former tanks at the service station one block to the north were not listed in the database research. Based on the available information, it does not appear that the subject site has been impacted by the listed UST sites. Colorado Leaking Underground Storage Tanks (LUST) and Emergency Response Notification System (ERNS) Lists and the Tribal Leaking Underground Storage Tanks (LUST) List The LUST list is an inventory of reported spills and leaks, both active and inactive. The Statute emphasizes that cleanup and program participation are purely on a voluntary basis. There are two possible modes of participation: the applicant can request a No Action Determination. provided that he can show that the site is virtually clean or that the likelihood of exposure to the contamination is low or. in the case of contaminated groundwater. that the pollutant had migrated to the site from elsewhere. The second mode of participation is a Voluntary Cleanup (VCUP). whereby the applicant proposes to undertake remediation at the site. Once the application is approved, and the cleanup has been completed and approved. the applicant applies to receive a No Action Determination. If granted, the applicant is given a letter of no further action relieving him of further liability over the site. Once cleanup is completed and the letter of no further action issued. VCUP properties that satisfy certain requirements qualify for tax credits through the State (or federal) Brownfield program. nalpsis/Comment: No VCP sites within an a 1/2 mile radius of the Subject were ident i lied. V1FiC Inc. 2_012.157 20 1 17 S. Crook St., Grover, Co. Colorado and Tribal Brownfield Sites The Colorado Voluntary Cleanup and Redevelopment program was created in 1994. The objective of the program is to facilitate the redevelopment and transfer of contaminated properties. Cleanup decisions are based on existing standards and the proposed use of the property. The actual cleanup and verification is the owner's responsibility. Analysis/Comment: The CER did not identify any Brownfield sites within a one-half mile radius of the subject. VIEC Inc. 2012_.1.7 �1 117 S. Crook St., Grover, Co. 7.0 SITE RECONNAISANCE At the time of the site visit. the property was used by the Weld County Grading operations. No indication of spills of petroleum products or other materials associated were observed on the property. 7.1 Hazardous Materials , Chemical Storage and Usage Five 35-gallon drums and a few smaller containers were observed located on portable spill containment pallets and the concrete floor. These containers still on the premises were either empty or partially full of fresh or used vehicle fluids. Such fluids include oil, hydraulic oils, gear lubricants, windshield wash, transmission fluid, and antifreeze. No substantial indication of spillage was observed. 7.2 Bulk Storage Tanks Underground Storage Tanks (USTs) and Aboveground Storage Tanks (ASTs) No USTs were observed on the property. Two ASTs are located on the north side of the subject property. The tanks are 1000 and 2000 gallon diesel storage tanks. The 2000 AST is currently in use and the 1000 AST is in temporary closure according to the state's COSTIS database. The ASTs are situated within a secondary concrete containment structure. No visible indication of spills or leaks were observed. The tank appears to be properly permitted with the Colorado Division of Oil and Public Safety. In addition to inspection observations. MEC Inc. contacted the Colorado Division of Oil & Public Safety(COOPS) and the Greeley Fire Department for information pertaining to current or prior LSTs or ASTs on the subject site. The tank section discussion in Section 6.2 and the interview response information from CDOPS in Section 5.6 discusses regulatory documentation regarding former tanks on the properly. 7.3 Site Waste and Wastewater Solid Waste One solid waste dumpster is located adjacent to the building. No indication of improper waste disposal was observed. Sanitary Sewage A copy of the septic information and permit was obtained from the Weld County Department of Public I lealth and Environment and is included in Appendix F. VFC Inc _2012.15" 22 117 S. Crook St., Grover, Co. Hazardous Waste The county representative indicted that a limited amount of wastes may be generated from the site activity. The majority of vehicle fluids used are consumed by their respective purpose. Waste fluids from vehicle service are typically removed offsite by the mobile service vehicle. 7.4 Stained Soil, Stained Pavement, or Stressed Vegetation No significant visible indications of stained soil, pavement or stressed vegetation was observed on the premises. The most likely potential source of release at the site is the vehicle fueling operation from drippage or vehicle overfilling in the area outside of the secondary containment. 7.5 Liquid Discharges No visible evidence of active liquid discharges from the property arc currently generated on the premises. Sanitary waste discharges historically, have been the primary discharges from the property. 7.6 Pools of Liquid No pools of liquid were observed on the subject site. . 7.7 Pits, Ponds, or Lagoons No ponds are on the property. 7.8 Wells No water wells are located on the premises. There are four water wells located within the subject site's area (Section 5). Two ofthe four wells had static water depths of 32 and 85 feet below grade. The wells are owned by the Town of Grover. One additional well is permitted in the area by Upper Crow Creek. 7.9 On-Site Fill Based on MEC Inc. observations, it could not be determined if fill materials have been used on the site. 7.10 Drums and Containers for Storing Waste \IF.C Inc. 2012.157 23 117 S. Crook St., Grover, Co. At the time of the site visit. any waste containers were located on the portable secondary containment pallets. 7.11 Floor Drains and Sumps No floor drains, aside from one such drain in the building 1 bathroom, arc present in building. No visible indication of discoloration or staining was observed around the bathroom floor drain. 7.12 Odors MEC Inc. did not identify strong. pungent.or noxious odors suspected to represent an environmental concern. 7.13 Air Emissions During the site inspection. no air emissions aside from natural gas furnace emissions were observed on the property. 7.14 Polychlorinated BiphencIs (PCBs) No leaks or weepage was observed from the transformer(s) serving the property. The transformers arc labeled as non-PCB. The transformers are assumed to be owned by the local utility. 7.15 NON-SCOPE ASTM ISSUES The ASTM protocol does not require assessing or sampling specific potential building material hazards such asbestos, mold. lead paint, lead in drinking water, soil vapor intrusion. and radon. These are only representative listings of Non-ASTM issues, there are more than a dozen such categories. It is beyond the scope of this report to provide a detailed evaluation of these non-scope ASTM Phase I issues. Asbestos-Containing Material (ACMs) During the site inspection and based on the age of the building pre 1979, it is possible that ACMs were used in the construction of the building. It is beyond the scope of this report to sample for asbestos. The majority of the structure is either untreated wood or steel which reduces to potential for the presence of asbestos. Water quality (Lead-in-Drinking Water) It is beyond the scope of this report to test or evaluate the potential for lead in drinking water. Radon NIH. Inc. '-0t2.I57 24 117 S. Crook St., Grover. Co. Radon is naturally occurring radioactive gas found in soils and rocks; it comes from the natural breakdown or decay of radium. Radon is a colorless and odorless gas, which is believed to be harmful at all exposure levels. Once inside an enclosed space, such as a residence or office building, radon can accumulate. There is an increased risk of developing lung cancer when exposed to elevated levels of radon. In general, the risk increases as both the level of radon and the length of exposure increase. MEC Inc. reviewed the Colorado Geological Survey report entitled. Results of the 1987- 88 EPA Supported Radon Study in Colorado. The report indicated that the average radon concentration in Weld County based on 50 screening locations was 3.92 pCi/L. No radon data was available in the report for the site's 80729 zip code area. Based on the county data, the radon concentrations in buildings in this area on the average may slightly less the regulatory guideline level of4.0 pCi/L. However, because of the random patterns for radon occurrence, it is not possible to predict or interpret documented data for correlation to specific locations. In addition, radon concentrations in structures may vary based on use, seasonal changes, or other potential influences. In general radon, is not considered a significant concern because the property is not used for residential purposes, the building does not have a below grade area, and the large garage doors are frequently opened which allows for air change in these buildings. Radon screening was not within the scope of work for this project. Mold During the site inspection, ,MEC Inc. did not observe any likely mold growth conditions. It is beyond the scope of this report to determine if mold growth is/has occurred in the building. Lead-Based Paint (LBP) Since the building was constructed before the Consumer Product Safety Commission's 1978 ban on the sale of LBP to consumers and the use of LBP in residences. it is possible that that LBP may be present on the premises. It is beyond the scope of this report to perform a detailed lead base paint survey'. Soil Vapor Intrusion It is beyond the scope of this report to do perform a soil vapor intrusion assessment/survey. MEC Inc. did not identify any current or past onsite activities that may contribute to soil vapor intrusion concerns. It is beyond the scope of this report to perform a vapor intrusion assessment. \IEC Inc. 201-'.157 117 S. Crook St., Grover, Co. 8.0 Owners and Interview Information 8.1 Identification of Involved Parties MEC Inc's. client for this project was Weld County. It is understood that the county may transfer the property ownership to another entity. MEC Inc. was not informed as to who the other entity is and therefore had not contact with this party. 8.2 User (Seller) 8.2.1 Title Records MEC Inc. was not provided a copy of the chain of title information for the subject property assemblage. MEC Inc. obtained a limited record of prior site ownership from readily available sources such as: the Weld County Assessor office and the County Clerk's office. Also. the other information sources reviewed by MEC Inc. may have identified other prior owners or tenants. The current property owner is Weld County. 8.2.2 Environmental Clean Up Liens and Activity and Use Limitations (AULs) The Seller/Owner User representative indicated that they were not aware of any environmental liens against the subject site. MEC Inc. did not identify any such liens or covenants pertaining to the subject site. 8.2.3 Specialized Knowledge Mr. Toby Taylor. Weld County Representative indicated that the county acquired the property circa 1989 and he has been aware of the site activity for approximately 5 years. Ile is not aware of any substantial environmental concerns on the site. 'fhe Buyer User response indicated that they had not observed any substantial environmental concerns on the site. 8.2.4 Relationship of Purchase Price to Fair Market Value Due to Contamination in Connection with the Subject The SellerOwner representative indicated that the sale price is not affected by any known contamination on the site. 8.2.5 Common Knowledge or Reasonably Ascertainable Information As indicated. Mr. Taylor. Weld County was the primary source of site information obtained from the county. MEC Inc. _2012.1577 26 117 S. Crook St.. Grover, Co. 8.2.6 Purpose for Conducting the Phase I Environmental Site Assessment MEC Inc. was requested to perform the Phase I on the property for the planned property transaction. 8.2.7 Proceedings Involving the Property The Seller/Owner representative, questionnaire responses indicated that they were not aware if the property isiwas involved with environmental actions or proceedings. 8.3 Key Site Manager 8.3.1 Historic Site Use Mr. Taylor, Weld County indicated that to his knowledge the property was undeveloped prior to the construction of the existing structure on the site. 8.4 Occupants At the time ot'MEC's site visit, the premises were occupied by Weld County. 8.5 Past Owners MLC Inc. attempted to contact the prior site owners without success. 8.6 Local Regulatory Agency Interviews and/or File Reviews Fire Department MEC Inc. attempted to the contact the local tire department but has not received a reply at this time. County Health Department MEC Inc. arranged to review the Weld County Department of Public Health and Environmental (WCDPHE)county health department file reviews for the subject site addresses 1 17 S. Crook St.. Grover. The county health department had no files for this site related to environmental inspections. incidents, spills. or complaints. State Health Department MEC Inc. has sent a request to the Colorado Department of Public I Icalth and Environment (C'DPIIF) for environmental information pertaining to the subject property. \II:C Inc _2(11'.197 117 S. Crook St., Grover, Co. The state health department representative, Ms Diana Huber, CDPHE indicated via phone that no files were available for the subject site. Colorado Department of Oil and Public Safety MEC Inc. sent a request to the Colorado Department of Oil and Public Safety(CDOPS) for information pertaining to the presence of USTs or ASTs on the subject property. As discussed in Sections one 1 I) diesel fuel AST is located on the property. No information was available indicating that there has been a release from the tank system. County Tax Assessor and Clerk's Office A review of the Weld Assessor's office and the Clerk and Recorders office did not identify any environmental liens with respect to the subject property. The readily available records in the county database are available from 1982 through the present. MEC Inc's review of the lien records at the Weld County Clerk's office is not considered a certified review/search. such as. that may be performed by a title company. A limited historical discussion of information obtained from the assessor's office is included in section 5.8. .N1EC IIH'. 2012.1 57 �� 117 S. Crook St., Grover, Co. 9.0 FINDINGS and CONCLUSIONS MEC Inc. has attempted to perform a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Standard Practice E1527-05 and the EPA AM Rule, of the 117 S. C'r'ook St., Grover, Colorado location. This assessment reviewed the readily available information for issues that may be considered current and historical recognized environmental conditions associated with hazardous materials/wastes or petroleum materials in connection with the Subject Site and also some non-Rec conditions. Any exceptions to, or deletions from, the standard practice are described within Section 2.0 of this report. The following environmental findings were determined: This assessment did not identify current or historical recognized environmental conditions associated with hazardous materials/wastes or petroleum materials in connection with the Subject Site. Listed below and discussed within the report are potential non-Rec or non-ASTM conditions that may be associated with the property. General EPA AAI Rule Requirement The EPA AAI Rule requires that the property owners (both existing and future owners) to operate in a manner not cause adverse impact to the environment. In addition, the property owners are responsible for monitoring the environmental conditions of offsite properties that may impact the subject site. Therefore. best management environmental practices are recommended for the fhture use of the site. This notice is included in the findings to inform all parties involved in the property transaction. Non Scope ASTM Issues (De Minimis Conditions) It is beyond the scope of this report to provide a detailed evaluation of non-scope issues such as asbestos, lead paint, radon, or drinking water quality, etc. It is recommended that any future activities that may disturb the building materials comply with applicable regulations pertaining to potential: asbestos containing building materials. lead based paint. mold, radon, and lead in drinking water. Note. there are other non-ASTM issues that may influence potential environmental conditions, therefore. it is suggested that property management comply with applicable regulations and guidelines. Current Site Activities Based on current site activities, the possible environmental management practices that inay be applicable to future site use include: I ) establish procedures to limit the potential for a release associated with the AST: 2) do not dispose of chemicals in any drains on the property: 3) follow all applicable regulations pertaining to zoning requirements: and 4) provide secondary containment for bulk chemicals-fuels/lubricant storage and waste materials on the site. These suggestions are considered as examples, the actual environmental best management practices will depend on the site activities and use. The current site activity uses two hulk diesel fuel .AST. No records of release was reported in the regulatory records. VIF( Inc. 20'2.157 �q 117 S. Crook St., Grover, Co. 10.0 LIMITING CONDITIONS 10.1 This report has been prepared in compliance with the ASTM standard entitled"Standard Practice for Environmental Site Assessments: Phase I Environmental Site Assessment Process" E1527-05. 10.2 The observations described in this report were made under the conditions staled herein.
