HomeMy WebLinkAbout20120397.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO FEBRUARY 8, 2012 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, February 8, 2012, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Sean P. Conway, Chair Commissioner William F. Garcia, Pro-Tem Commissioner Barbara Kirkmeyer Commissioner David E. Long Commissioner Douglas Rademacher Also present: County Attorney, Bruce T. Barker Acting Clerk to the Board, Elizabeth Strong Director of Finance and Administration, Monica Mika MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County Commissioners meeting of February 6, 2012, as printed. Commissioner Long seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. PUBLIC INPUT: Doug Meyer, Weld County resident, read a portion of a document into record regarding the difference between a democracy and a republic, marked Exhibit A. Commissioner Garcia stated he is teaching American Government at Aims and when he asked the students what type of government the United States has in place, every one of the students mistakenly stated it is a democracy, as opposed to a republic. CONSENT AGENDA: Commissioner Rademacher moved to approve the Consent Agenda as printed. Commissioner Garcia seconded the motion, and it carried unanimously. COMMISSIONER COORDINATOR REPORTS: Chair Conway stated Governor Hickenlooper is coming to Weld County to meet with the Commissioners and Craig Harrison about the Niobrara Business Park this afternoon. He stated the Governor will participate in a one-hour tour of the park provided by Mr. Harrison and there will be a press conference afterwards. He stated he is pleased the Governor is taking time out of his busy schedule to highlight the first Industrial Planned Unit Development (PUD) in the State. Chair Conway stated the Commissioners will testify on behalf of Representative Vaad's Emission Bill tomorrow at the State capitol. He stated he spoke to Senator Renfroe regarding Senate Bill 126, which will extend the timeframe for which new cars will be exempt from emissions testing from four (4) to Minutes, February 8, 2012 2012-0397 3-I Page 1 BC0016 a� eight (8) years, and the hearing for it will be on February 13, 2012, in the afternoon. He stated the Board has taken the position to support the Bill; therefore, at least one of the Commissioners will testify about it before the Senate Transportation Committee. BIDS: PRESENT BID #61200037, SIGN MATERIAL FOR 2012 - DEPARTMENT OF PUBLIC WORKS: Monica Mika, Director of Finance and Administration, stated said bid will be presented for approval on February 22, 2012, and a long list of vendors have submitted bid proposals. She stated multiple vendors will be awarded different portions of the bid. Commissioner Rademacher inquired as to why there are no bid proposals from Colorado vendors. Ms. Mika stated this question was asked last year as well, and the reason the bid has not captured many local vendors is because of the specific unique requirements for the paint. NEW BUSINESS: CONSIDER GRANT CONTINUATION APPLICATION FOR FISCAL YEARS 2012 AND 2013, INCLUDING 2011 PROGRESS REPORT, FOR NURSE HOME VISITOR PROGRAM AND AUTHORIZE CHAIR TO SIGN: Dr. Mark Wallace, M.D., Director, Department of Public Health and Environment, stated there are two (2) stages of this application process, and at a previous work session he discussed with the Board the issues needing to be addressed concerning Senate Bill 130. He stated he has not seen the proposed amendments to the Bill; however, the current Bill seems similar to what was in the earlier draft concerning creating a new Office of Early Childhood Programming and a Council to oversee it. He stated the application is due for the County to renew its Nurse Home Visitor Program and, although he spoke to the Board about reimbursement issues at the work session, he has elected to submit the application to the Colorado Department of Public Health and Environment, since there is no other entity to submit it to yet. Dr. Wallace stated the full amount of the Program is being requested, since the State directs the Program and determines the size of the staff and the curriculum to be delivered. He stated the funding is provided from two (2) sources: the Colorado Tobacco Settlement Fund and Medicaid, and the only item which is different from what was provided at the work session is the application now requests the entire cost for the operation of the Program. He stated the Department can enter into negotiations after the State has reviewed the costs, and it is anticipated the Program will continue to operate as it has in the past. Dr. Wallace stated the application is for activities to occur between July 1, 2012, and June 30, 2013. In response to Commissioner Rademacher, Dr. Wallace confirmed the amount being requested is $678,480.00. Commissioner Rademacher moved to approve said application and authorize Chair to sign. Commissioner Long seconded the motion. Chair Conway stated this is a great program, which the Board will continue to support, and he requested Dr. Wallace relay the Board's appreciation to the Program staff. Commissioner Rademacher concurred with Chair Conway. There being no further discussion, the motion carried unanimously. CONSIDER RESCINDING DOCUMENT #2012-0293, DATED JANUARY 30, 2012, CONCERNING INTERGOVERNMENTAL AGREEMENT FOR PAYMENT OF BONUS AMOUNTS FOR CERTAIN REPORTED OIL AND GAS EMPLOYEES RESIDING WITHIN MUNICIPAL BOUNDARIES — TOWN OF NUNN: Bruce Barker, County Attorney, stated the Town Clerk requested this agreement be rescinded, and he has provided a copy of an e-mail documenting the conversation. He stated the Town provided a check for $24.45, which is the base amount listed on Exhibit A of the agreement, and the Town mistakenly understood that was the full amount it had to pay. He stated when he explained to the Town Clerk the bonus amount for all reported oil and gas employees residing within the Town's municipal boundaries, she indicated the Town will not have the funds available and she requested that the agreement be rescinded, upon the direction from the Town Board. In response to Commissioner Kirkmeyer, Mr. Barker stated he does not have a Resolution or documentation that the Town Board discussed this matter at its meeting. Commissioner Kirkmeyer inquired as to how the Board can act on the matter without assurance the Board for the Town of Nunn has acted on it, and Chair Conway concurred. Mr. Barker stated he will contact the Town Clerk to obtain documentation, and he Minutes, February 8, 2012 2012-0397 Page 2 BC0016 suggested the Board continue this matter for about three (3) weeks, to ensure the Town Board has sufficient time to act on the matter. Commissioner Garcia moved to continue the matter to March 7, 2012. Commissioner Kirkmeyer seconded the motion, which carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Acting Clerk to the Board.
