Explain, in detail, the proposed amendment to the property. High Sierra Water Services currently runs a brine water disposal facility from the site. The site was originally permitted in 1986 through USR 729. An amendment was done in 2005. High Sierra does not wish to change the use on the site. The sole intent of the amendment is to expand the existing brine water disposal facility. 2. Explain how this proposal is consistent with the intent of the Comprehensive Plan pursuant to Chapter 22 of the Weld County Code. Section 22-2-70 of the Weld County Code describes allowing industrial development that is compatible with the surrounding environment. The site does not currently hinder the agricultural landscape of its surrounding neighbors due to it operating as a self-contained facility. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. This facility is classified as a mineral resource development facility per Chapter 23 section A. 1 of the Weld County Code. The site will not interfere with the neighboring agricultural landscape, nor will it keep its neighbors from conducting agricultural activities. This site is, and will remain fully contained. A water quality capture feature will also be added to the site per the attached drainage report. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). All property surrounding this site is agricultural . As described above, this site is fully contained and will not hinder the production of it's neighbors. 5. Describe, in detail, the following: a. Number of people who will use this site 45 to 50 truck drivers will visit the site per day. b. Number of employees proposed to be employed at this site Two employees will be on site at all times during operation hours. One employee will be on site at all times when the pump is running. c. Hours of operation This site is currently approved to operate daily from 7AM to 9PM with the pump allowed to run 24 per day. High Sierra would like to extend operating hours to 24 hours per day based on the new capacity of the facility. d. Type and number of structures to be erected (built) on this site Addition to this site will include a new injection well pump house, tank farm, and offload pad (new and completely separate from the existing tank farm and unloading pad), which will consist of two unloading tanks, five oil tanks, six sedimentation tanks, two solids collection tanks, and one clean water tank. These tanks will be accessed from a new unloading pad. e. Type and number of animals, if any, to be on this site No animals will be on this site. f. Kind of vehicles (type, size, weight) that will access this site and how often Transportation trucks weighing up to forty (40) tons will visit this site. High Sierra would like the number of trucks to visit this site to be amended to 130 per day. These are trucks that will travel North to the facility and in turn will be kept off of 85 southbound . g. Who will provide fire protection to the site The Greeley Fire Department will provide fire protection for this site. h. Water source on the property (both domestic and irrigation) The site is currently serviced by bottled water. i. Sewage disposal system on the property ( existing and proposed) A portable toilet has historically serviced this site . j. If storage or warehousing is proposed, what type of items will be stored No warehousing is proposed . 6. Explain the proposed landscaping for the site. The landscaping shall be separately submitted as a landscape plan map as part of the application submittal. There is no proposed landscaping for this site . 7. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. The existing disposal system tank farm and associated berm will be removed once the existing well is terminated . All tanks and associated piping will be removed and disposed of off-site. The existing berm will be removed and the berm area will be re-graded to match site grading for required drainage patterns. Any contaminated soils will be removed and disposed of off-site at an approved facility. 8. Explain how the storm water drainage will be handled on the site. Water drainage will be collected by a detention pond will be added to this site along with drainage swales as shown in the drainage study performed by Wernsman Engineering. 9. Explain how long it will take to construct this site and when construction and landscaping is scheduled to begin. Contingent upon the final USR and permit approval, construction will start as soon as possible thereafter. It is anticipated that construction will take approximately 130 days after mobilization. 10. Explain where storage and/or stockpile of wastes will occur on this site. This site is 100% contained and recycles all wastes used in the water treatment process. This will not change based on the proposed amendment. It addresses the current and proposed expanded operations at this site. The site is located north of WCR64 and west of WCR47 in Weld County, Colorado. Access to the site is provided from WCR64. The current hours of operation at C4 are 7 am to 9 pm. The new proposed hours of operation for C4 are 24 hours a day, however it is expected that the bulk of the truck activity will occur during the daylight hours. The existing C4 facility currently takes 4,700 barrels of water per day for disposal. This is the maximum amount of water that the C4 disposal well can take for disposal on a daily basis. Typically, water trucks for this site have a capacity of 130 barrels per truck. At that rate, the maximum number of trucks per day is currently 36 round trips to C4. The current Weld County Resolution indicates that this site is approved for 50 round trip trucks per day. Therefore, this site is currently operating at 72 percent of the approved activity. The expanded facilities and new well at the C4 facility will increase the capacity of the C4 water disposal by 7,000 barrels per day for a total maximum of 11 ,700 barrels per day. The capacity of 130 barrels per truck equates to approximately 90 round trips per day for disposal at expanded C4 facility. Experience of the operator indicates that these types of facilities operate at an 80% utilization factor. In this instance, it is expected that there will be an annual daily average of 72 round trips at the expanded C4 facility. By utilizing the C4 facility expansion , the number of truck trips in the area south of WCR 64 (going to High Sierra Cl south of Kersey) will be greatly reduced . This is an important benefit to the surrounding area (especially to the Town of Kersey) . The C4 facility currently does not have running water or sewage system. Per Environmental Health Policy 2.2.K the facility currently staffs no more than two full time employees at any one time and therefore bottled water is allowed. HSWS provides bottled water to employees. Per the same Environmental Health Policy 2.2. K portable toilets are allowed if two or less full time employees are located on site. The C4 facility has no more than two full time employees at any one time on site and therefore portable toilets are allowed . As the owner, with my sister, of the properties including the injection well under discussion, I have worked with many of the well operators including Noble, Conquest Disposal Services, and High Sierra Water Services. Since Conquest and High Sierra have been operating the injection well, I have had nothing negative to say about their operations. I have unlimited access to the well and its operations. I can also call the office with any concerns. In addition I am owner of the property where Poppe's live rent free. In return they sometimes pickup my mail and infrequently clear the walks from snow when I am not at home. They also keep an eye out for the properties. 2. Regarding trucks completing paper work on CR 64, this ceased several weeks ago and the trucks now complete their paper work while at the well site or elsewhere away from the site. 3. The concern of trucks backed up along CR 64 has not been done for many months. With some earlier modifications there is sufficient space for the trucks to enter and remain on the well site. (I would also note that in the past, if stopped, they were stopped adjacent to my properties on both sides of CR 64.) (CR 64 is not a through road since the expansion of the Greeley Weld County Airport several years ago.) 4. A 24 hour operation would reduce the number and congestion of trucks at any one time. This would, as a consequence, reduce the traffic on CR 64. My house and the house in which the Poppe's live are the only houses that would be affected as they are the only houses on CR 64 west of CR 47. Also, by the nature of the water production and hauling, the number of trucks running at night would probably be significantly less than those in operation during the day. It does not seem to make sense to concentrate them in a shorter period of time. I have no objection to a 24 hour operation. My experience has been that many times I see a truck leaving the site and I did not see or hear it entering. 5. The only non-paved road utilized by the trucks is CR 64 west from CR 47. (A very rare truck might come from the east of CR 47 on CR 64.) CR 64 is maintained by High Sierra and magnesium chloride has been applied many times over the past years. The road has the near consistency of concrete. It is extremely difficult to raise any dust on this road and any dust raised would affect only my house as the winds are normally from the south. Farm operations on the properties raise far more dust that could come from CR 64. 6. I have found High Sierra an excellent company with which to work. If I have a concern, they are only a phone call or visit away. I fully support their requests for the C4A injection site. 7.
