As you are aware, our firm has been retained to represent Ed Orr, Orr House, LLC, and
Olando Ltd. Liability Co. with respect to the above-referenced encroachment matter. We sent a
certified letter dated February 17, 2012, to your attention (a copy of which is attached hereto);
however, to date, we have yet to hear back from you regarding resolution of this matter. Please
let me know if you did not receive the attached letter in its entirety.

Re: Encroachment by Poudre River Trail on Property of Ed Orr, Orr House, LLC,
and Olando Ltd. Liability Co.
Dear Mr. Barker:
Our firm has been retained to represent Ed Orr, Orr House, LLC ("Orr House"), and
Olando Ltd. Liability Co. ("Olando") with respect to the above-referenced encroachment, of
which Mr. Orr notified you in his letter of Sept. 12, 2011. It is apparent from the enclosed
survey that the Poudre River Trail (the "Trail"), as constructed, covers a land area well in excess
of that permitted by the relevant easement. Accordingly, we must insist that Weld County (the
"County") remove this encroachment immediately and relocate the Trail to its legally-defined
( location.
Be advised that Mr. On, Orr House, and Olando remain desirous of resolving this issue
amicably and without legal action. Please notify me at your earliest convenience of the County's
estimated timeline for removing the encroachment, and please do not hesitate to contact me if
you have any questions with respect to any of the foregoing.
