RESOLUTION RE: APPROVAL OF RECORDED EXEMPTION NO. 342 - EUGENE ASHBAUGH WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public hearing held on the 2nd day of October, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption number 342, being the property of Eugene Ashbaugh, described as part of the Northwest Quarter of Section 11, Township 5 North, Range 67 West of the 6th P.M. , Weld County, Colorado, being more particularly described as follows: A tract of land located in the Northwest Quarter of Section 11, Township 5 North, Range 67 West of the sixth principal meridian, Weld County, Colorado and being more particularly described as follars: Beginning at the center of said Section 11 and considering the North-South centerline of said Section 11 to bear North 00°00'50" East with all other bearings contained herein being rela- tive thereto; Thence North 00°00'50" East along the North- South centerline of said Section 11, a distance of 649.96 feet to a point on the southerly right-of-way line of U.S. Highway No. 34 business route; Thence along said southerly right-of-way line by the following two courses; South 53°46;00" West, 572.57 feet; South 45°30'30" West, 428.00 feet to a point on the East-West centerline of said Section 11; Thence South 89°08'05" East along the Fast-West centerline of said Section 11, a distance of 767.09 feet to the point of beginning; Said tract of land contains 6.126 acres, more or less. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land, " pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within �) l C(� ; e 4,7,c- 3V 780762 the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-lA(3) of the Weld County Subdivision Regulations . The property in question is described as Pt . NW* of Section 11, T5N, R67W of the 6th P.M. , Weld County, Colorado. This property is located immediately southwest of the State Highway Maintenance Yard on Colorado Highway 34, four and one half miles west of Greeley. The property contains approximately six acres of non- irrigated land with Class 6 soils. The request is to split the property into parcels of 4. 911 acres and 1.215 acres. On October 24, 1977, the Board of County Commissioners approved a request by Mr. Ashbaugh for a lot size variance so that he could make application for this recorded exemption. At the time they made the decision on that request , the Department of Planning Services Staff submitted a letter of recommendation to the Board. A copy of that letter of recommendation is included in the at- tached packet . The property in question is described as Pt. of the NW* of Section 11, T5N, R67W of the 6th p.m. , Weld County, Colorado. Said property is located immediately southwest of the State Highway maintenance yard on State Highway 34 west of Greeley. The property in question contains approximately 6 acres of non-irrigated land with Class VI soils. The request is to obtain a variance from the minimum lot size requirement , Section 9-4(a) (6) , so that Mr. Ashbough may make application to apply for a recorded exemption. Section 9-4(a) (6) states, "That the original tract or parcel of land to be divided under this section meets the minimum lot size requirement established by the Weld County Zoning Resolution; variance from this requirement being allowed only upon good cause being shown to the Board of County Commissioners or where said tract or parcel of land lies within the comprehensive plan area of an existing incorporated town of Weld County. (Revised 4/17/74)" If this lot size variance is granted, Mr. Ashbough will proceed with his application for a recorded exemption to divide the property into two lots . One lot is proposed to contain approximately 1# acres with an existing set of improvements. The second lot is proposed to contain approximately 4; acres with no existing residential improvements. As indicated in a letter dated June 2 , 1977, Mr. Ashbough desires to sell the existing improvements and the 11 acre parcel and retain the 4-i acre parcel for a new residential home site for himself . A separate access exists for each of the two proposed parcels in question. The request complies with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Regulations) , the intent clause of the Agricultural District (Section 3 . 3A of the Weld County Zoning Resolution) , and the Weld County Comprehensive Plan since non-productive agricultural land is proposed to be split and utilized for residential purposes which would be compatible with land uses in the surrounding area. 2.
