The application indicates no employees will be on site and no dump station or buildings will be constructed. At full capacity there may be a maximum of 43 customers per day during peak summer season. As this is a full time business, permanent drinking water and sewage disposal facilities are required if the number of customers exceeds 10 per day as indicated in revised Policy 2.2.K. The applicants have requested a waiver from water and sewer requirements. • "Policy 2.2.K Use of portable toilets and bottled water (revised 5/8/12) Purpose: To define when portable toilets and commercially bottled water are allowed. Policy: Bottled water from a commercial source is allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Gravel mines 3. 10 or less customers or visitors per day and/or one of the following: 4. 2 or less full time (40 hour week) employees located on site 5. 4 or less part time (20 hour week) employees located on site 6. employees or contractors that are on site for less than 2 consecutive hours a day Policy: Portable toilets are allowed in the following circumstances: 1. Temporary or seasonal uses that are utilized 6 months or less per year (for example recreational facilities, firework stands, farmers markets ) 2. Portable toilets shall be serviced by a cleaner licensed in Weld County and shall contain hand sanitizers." The dust abatement plan indicates the site will be covered with recycled asphalt. The waste handling plan indicates there will not be any trash facilities provided on the site. The applicant should provide some type of waste disposal so that blowing debris does not become an issue. We have no objections to the proposal; however, we do recommend that the following conditions be part of any approval: • We recommend that the following requirements be met prior to allowing the plat to be recorded: 1. An individual sewage disposal system is required for the proposed facility and shall be installed according to the Weld County Individual Sewage Disposal Regulations. The septic system is required to be designed by a Colorado Registered Professional Engineer according to the Weld County Individual Sewage Disposal Regulations. 2. The applicant shall submit written documentation indicating that water service is available for the commercial use. 3. The applicant shall submit a waste handling plan, for approval, to the Environmental Health Services Division of the Weld County Department of Public Health & Environment. The plan shall include at a minimum, the following: The location of trash cans on the site and the waste handler and facility where the waste will be disposed (including the facility name, address, and phone number). • 2 • We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. This is not meant to include those wastes specifically excluded from the definition of a solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S., as amended. 3. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. 4. The applicant shall operate in accordance with the approved "waste handling plan", at all times. 5. Fugitive dust and fugitive particulate emissions shall be controlled on this site. The facility shall be operated in accordance with the approved "dust abatement • plan", at all times. 6. This facility shall adhere to the maximum permissible noise levels allowed in the Commercial Zone as delineated in Section 14-9-30 of the Weld County Code. 7. Adequate drinking, hand washing and toilet facilities shall be provided for customers of the facility. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. Sewage disposal for the facility shall be by septic system. Any septic system located on the property must comply with all provisions of the Weld County Code, pertaining to Individual Sewage Disposal Systems. 10.The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. • 3 X86-�C'"" MEMORANDUM ! The Weld County Public Works Department has reviewed this proposal. This project falls under the Use by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff comments made during this phase of the Use by Special Review process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: CR 19 is an arterial road and requires an 140-foot right-of-way at full build out. There is presently a 60- foot right-of-way. This road is maintained by Weld County. Pursuant to the definition of SETBACK in the Weld County Zoning (23-1-90), the required setback is measured from the future right-of-way line. Proposed traffic consists of up to a maximum of 21 trips/day for Phase 1 and 43 trips/day total when Phase 2 is added. An access permit application is required for this site. Please submit an access permit application. No • additional accesses onto an arterial roadway will be granted. Please indicate which existing access will be used or closed to allow the new access to the facility to be opened. Access photos and fees described in the access permit application form are required. Show the approved access on the plat and label with the approved access permit number (will be provided when application is received). Please label the turning radiuses into the site. A minimum of 45 foot radiuses are required to allow trucks or RVs with trailers to turn. The gate must be set back 75 feet from future right-of-way to allow a truck or RV and trailer to pull completely off of the roadway and open the gate after the future road widening. The provided calculations for the Water Quality Area are acceptable. The Water Quality Area shown on the plat is acceptable. In the event that 1 or more acres are disturbed during the construction and development of this site, the applicant shall obtain a stormwater discharge permit from the Water Quality Control Division of the Colorado Department of Public Health and Environment. If more than 1 acre is to be disturbed, a grading permit will be required prior to the start of construction. The grading permit application must contain: an erosion and sediment control plan, a grading plan, installation details of all BMPs to be utilized, typical installation and maintenance notes for all BMPs to be utilized, and a copy of the approved CDPHE stormwater permit.
