RESOLUTION RE: ACTION OF THE BOARD CONCERNING SUSPENSION / REVOCATION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE - CULVER'S RESTAURANT WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS,Culver's Restaurant, located at 3502 29th Street, Greeley, Colorado, is allegedly in violation of the Colorado Retail Food Establishment Rules and Regulations, and WHEREAS, on January 16, 2012, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violations at the facility owned by Joe Gibbons, who was represented by Eric Powers, General Manager, and WHEREAS, after hearing testimony from all present, the Board of County Commissioners deemed it advisable to accept the plan of correction submitted by the ownership and management of Culver's Restaurant and to assess the $750.00 civil penalty, with the understanding that if the facility does not comply with the items contained within the plan of correction through the next follow-up inspection, as well as the next regular inspection, another hearing may be scheduled with the Board of Commissioners to consider suspension or revocation of said license, and WHEREAS, after hearing testimony from all present, the Board of County Commissioners deemed it advisable to accept the plan of correction, assess the civil penalty in the amount of $750.00, and refer the matter back to staff, with the direction to promptly bring the matter back before the Board if it necessary. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that it accepts the plan of correction concerning the Colorado Retail Food License issued to Culver's Restaurant, do Joe Gibbons, located at 3502 29th Street, Greeley, Colorado, with the condition that the ownership pay the assessed civil penalty of$750.00, and the matter be, and hereby is, referred back to staff. BE IT FURTHER RESOLOVED by the Board that if the facility does not comply with the items contained within the plan of correction through the next follow-up inspection, as well as the next regular inspection, another hearing may be scheduled with the Board of Commissioners to consider suspension or revocation of said license. The Weld County Department of Public Health and Environment (Department) has given the facility all opportunities to come into compliance as afforded to them in the Colorado Revised Statutes. Unfortunately, our staff continues to observe violations that have the potential to directly result in illnesses of patrons dining at the establishment. The Department recommends acceptance of the plan of correction submitted by the ownership and management of Culver's Restaurant. The Department also asks that the Board of County Commissioners (BOCC) direct Culver's Restaurant to pay the assessed $750.00 civil penalty with the understanding that if the facility does not comply with the items contained within the plan of correction through the next follow-up inspection as well as the next regular inspection, another hearing will be scheduled with the BOCC at which time the Department will make a request for license suspension or revocation. 2012-0161 Culver's Restaurant History of Violations 2010 - 2011 SUMMARY Since 2010 the Department has performed 9 inspections where 36 violations were cited for an average of 4 per inspection. This is more than double the average for all facilities (we currently cite 1.9 violations per regular inspection). Of the 36 violations cited, 29 were critical violations (81%). Of those critical violations, 13 were foodborne illness risk factor violations (45%). CRITICAL ITEMS Critical items are related directly to foodborne illness. He will work with Eric Powers, General Manager,to oversee operation and daily functions of the restaurant. Approval of any and all repair or maintenance calls will go through Joe Gibbons. Eric Powers-General Manager. Eric Powers over sees every aspect of the restaurant's daily operations from within the restaurant. He will be responsible for directing the management team and checking on their jobs and duties on a daily basis. All managers and shift leaders will report to Eric Powers, who will then report to Joe Gibbons. Hugh Barnes, Danyel Morrison, and Jenny Chavez-Assistant Managers. It will be their job to maintain all policies and procedures of the restaurant, while adhering to it themselves. They will be responsible for pre-shift checks on product, cleanliness of the store, making sure temperature logs are completed, and spray bottles are labeled and filled with the correct cleaning agent. Whitney Friesen, Tonya Villareal, and Alma Dominguez- Shift Leaders. It will be their responsibility to run the shift with a high awareness of food safety and handling, while serving the customer. Crystal Lopez and Dominic Gonzalez- Kitchen Managers. They will be responsible for rotation of product within the kitchen. They will check the quality of the product and are responsible for food safety and sanitation within the kitchen area. Past areas of concern: Moldy Food (ib)- This was an isolated occurrence with a single product used on a seasonal item. The fresh strawberries would sometimes be delivered with a few bad ones in the case. At time of prep, these would be removed. They do not need to be prepped every day, which is why one may sometimes be in the case. We do however, understand the importance to check on these, and other items, on a daily basis to avoid this problem and not let any contamination occur. We will begin keeping a daily log to prove as evidence that will be checking this on a daily basis. This log will be provided along with our other logs submitted to the Weld County Health Department. Cold Holding (3e)-This was a major problem for a period of time. Unfortunately, a couple compressors under warranty were not working up to standard. We were able to replace all compressors with new ones and moving forward are in great working condition. Should any future problems occur with the cold holding units, Restaurant Services Inc. will be our primary maintenance provider. Eric Powers will be responsible for notifying Restaurant Services Inc., as well as informing Joe Gibbons. We will also be providing temperature logs for a four week period for the temperatures of the cold holding units themselves, aside from the daily temperature log that lists the temperature of the items stored in the units. Hand Sinks (5b)-The major problem with the sinks were the batteries. I, as General Manager, will show all other management team members how to replace batteries; and have informed all team members to report a non-working hand sink to management immediately. Spray Bottles (8b)- Assistant Managers will be responsible for checking spray bottles multiple times on a daily basis. Since we have implemented these responsibilities there is no longer any confusion or misunderstanding of labeled bottles. Food Safety Education- It will be our goal to get our management team certified through the Weld Star Classes. On Monday,January 30th, 2012, Eric Powers and Hugh Barnes will be the first two to do so. After that, all other managers in the Chain of Command will go through this class as well. We will also enroll management team members in ServSafe certification classes, starting with Eric Powers and Hugh Barnes. Eric Powers and Joe Gibbons have set a deadline of July 3151 to complete all of the food safety education courses. I have met with my staff and informed them of the ongoing process we have with the Weld County Health Department. I have made them aware of our violations and educated them how to avoid further violations. Introduction of Dan Joseph-Joe Gibbons and Eric Powers both feel that introducing Dan Joseph to the store and developing a working relationship with Dan is very essential to our future success. We recognize his knowledge of food safety and handling as a very valuable asset that can be shared with Joe Gibbons, the owner, down to the newest members of our team. We would like to schedule a time in which Dan Joseph can meet with us and coordinate that with a time in which Joe Gibbons can be present as well.
