HomeMy WebLinkAbout791026.tiff • • /-7qRESOLUTION RE: APPROVAL OF REPLAT OF LOTS 6 AND 7 , UNION COLONY - HAROLD ARCHER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 1st day of October, 1979, a public hearing was held before the Board of County Commissioners of Weld County, Colorado concerning the application of Harold Archer for a replat of Lots 6 and 7 , Union Colony, more particularly described as follows : That portion of the Northwest Quarter of Section 10, Township 5 North, Range 65 West of the 6th Principal Meridian in the County of Weld, State of Colorado, described as follows: Beginning at the center Quarter Corner of said Section 10, (as established by the Weld County Surveyor) : Thence along the South line of the North Half of said Sec- tion 10, South 87°33 ' 10" West, 8. 00 feet; Thence along the East, North and West lines of that certain parcel of land described in deed to Yager, recorded in Book 1597 on page 546, records of said County as follows : North 2°26 ' 50" West 387. 20 feet; Thence South 87 °33' 10" West 225. 00 feet; Thence South 2°26 ' 50" East 157. 88 feet to the True Point of Beginning: Thence leaving said land of Yager and parallel with the South line of the North Half of said Section 10, South 87°33' 10" West 427 . 00 feet; Thence South 02°26 ' 50" East 229. 32 feet more or less to the South line of the North Half of said Section 10; Thence along said South line North 87°33' 10" East 427. 00 feet more or less to the West line of said land of Yager; Thence along said West line North 2°26 ' 50" West 229. 32 feet more or less to the True Point of Beginning; Containing 2. 248 acres more or less of which 0. 392 acres is road Right-of-Way. WHEREAS, the Board of County Commissioners heard the testi- mony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request of Harold Archer and the recommendations of the Weld County Planning Commission, and having been fully informed, is satisfied that the proposed replat of Lots 6 and 7 , Union Colony, 791026 / • • conforms in all respects with the requirements of the Weld County Subdivision Regulations. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the replat of Lots 6 and 7 , Union Colony be, and hereby is, approved subject to the accesses being limited to one driveway per lot and further subject to the following notation being placed on the plat: "There is hereby reserved for the use and benefit of the public, the right to over- fly the property depicted on this plat, including the rights incident to flight such as sound, vibration, and fumes. On August 23, 1979, the Weld County Utilities Coordinating Advisory Board recommended approval of the utility easements for this replat. 3. The West Greeley Soil Conservation District has no objections to this request. 4. The Weld County Health Department has indicated they can find no apparent conflict with local or State Health regulations concerning this request. 5 . The Weld County Engineering Department has no objections to this request. 6 . The City of Greeley Planning Commission has no objections to this request which is located in the City of Greeley' s Comprehensive Plan area. However, the City of Greeley has requested the following: a. The applicant agree to obtain an avigational easement to promote compatibility with the anticipated airport traffic. b. Driveway accesses to 16th Street be limited to one access per lot. c. An additional ten foot right-of-way for 16th Street be dedicated on the plat for a total right-of-way of 40 feet of right-of-way on the north side of 16th Street. 7. The Planning Commission recommendation for approval is conditional upon the following notation being placed on the plat : "There is hereby reserved for the use and benefit of the public, the right to overfly the property depicted on this plat , including the rights incident to flight such as sound, vibration, and fumes. " le • Comments : 1 . The Western Hills Fire Protection District has not responded to this request, however, they have signed the Utility List, which is part of the application packet. 2. The applicant has reserved the 40 feet of right-of-way for 16th Street. 3 . In a letter dated September 4 , 1979 the Colorado Water Conservatior. Board states the the property lies partially within the designated 100 year £loodplain of the Cache-La-Poudre River as defined in March of 1974 by the U. S. Army Corps of Engineers . The proposed replatting does not however affect buildings or building permits on the parcels. Nor has Weld County adopted Floodplain regulations to regular structures in designated floodplains. However the Department of Planning Services staff recommends the applicant consider alternatives to protect existing and proposed structures on both parcels. Res. 353-5375 ENGINEERING • SURVEYING * DRAFTING August 13, 1979 Norman Carlson County Commissioners Weld County, CO 80631 Dear Mr. Carlson, I am writing this letter in behalf of Mr. Harold Archer who is request- ing an approval for a replat of certain property bordering East Sixteenth Street. This property is located in the Southeast Quarter of the North- west Quarter of Section Ten, about a mile and a half east of Greeley. The property lies north of Sixteenth Street and is part of the original platting of Union Colony. Mr. Archer's property in this area is comprised of approximately the south 230 feet of lots five and six and the south 230 feet of the west 97 feet of lot seven in the southeast corner of the Northwest Quarter of Section Ten. That portion of lot seven which Mr. Archer owns has only 97 feet of frontage on Sixteenth Street. Mr. Archer built his residence on this lot unaware that the frontage was nonconforming. Because of some large trees located approximately at the platted lot line between lots six and seven, Mr. Archer cannot complete a circle drive for the residence. In-as-much as that portion of lot six owned by Mr. Archer has 330 feet of frontage while that portion of lot seven has only 97 feet of frontage, and due to the existing nonconformity of lot seven, and considering that Mr. Archer would like to complete his circle drive on and across a portion of lot six; Mr. Archer specifically requests that he be allowed to vacate the lot line between lots six and seven and to replat said lots with 227 feet of frontage for lot seven and 200 feet for lot six renumbering these lots as lot one and two respectively, all as shown on the accompanying plat. S. Army Corps of Engineers ' report. This report, "Flood Plain Information, Cache La Poudre River, Colorado, Volume II, Greeley, Weld County, " was designated by the Colorado Water Conservation Board on February 26, 1975, and thus can be used for regulation purposes. Therefore, appropriate county floodplain regulations should be applied. The 100-year flood elevations pub- lished range from 4, 619 feet at the downstream end of the property to 4, 621 feet at the upstream end. Also, please note that the National Flood Insurance Program' s June 8, 1979, Preliminary Floodway Map shows all three lots entirely within the 100-year floodplain and classified A3. Thus, we recommend applicable floodplain zoning and regulations be applied so as not to adversely affect other properties. If you have any questions, I will be happy to respond. The Commission noted a concern for not allowing the replat to increase the number of accesses onto 16th Street , which is designated as a collector . The Commission also noted the Industrial Element of the Comprehensive Plan which indicates that due to the influence area of the Weld County Municipal Airport Master Plan, the area is best suited for industrial or commercial development, and any residential develop- ment which may be allowed to occur should first obtain avigation easements to promote compatibility with the anticipated air traffic . The Commission recommended no objections conditioned upon one common driveway in addition to the existing driveway to provide access to both lots and conditioned upon consideration of an avigation ease- ment for any future residential development. An additional ten foot right-of-way for the 16th Street collector should be dedicated with this plat.
