A Use by Special Review permit for a lawn and landscaping business.
The Weld County Public Works Department has reviewed this proposal. This project falls under the Use
by Special Review Standard, Weld County Code, Chapter 23, Article II, Division 4, Section 23. Staff
comments made during this phase of the Use by Special Review process may not be all-inclusive, as
other issues may arise during the remaining application process.
COMMENTS:
The Town of Johnstown has jurisdiction over CR 17 and will dictate access and right-of-way
requirements.
The applicant stated that there may be up to 10 employees and trucks associated with the business
include four 1-ton pickups.
A water quality depression design has been submitted and is acceptable to Public Works. Please show
the water quality area on the Plat and label as Water Quality—No Build or Storage Area.
This area IS NOT in a Special Flood Hazard Area (SFHA) as determined by the Federal Emergency
Management Agency (FEMA).
REQUIREMENTS:
1. Show and label the Water Quality Area on the Plat as "Water Quality—No Build or Storage Area".
2. Add the following notes to the plat:
a. Pursuant to Chapter 15, Articles I and II of the Weld County Code, if noxious weeds exist
on the property or become established as a result of the proposed development, the
applicant/landowner shall be responsible for controlling the noxious weeds. All
vegetation, other than grasses, needs to be maintained at a maximum height of 12
inches until the area is completely developed.
b. The historical flow patterns and run-off amounts will be maintained on site in such a
manner that it will reasonably preserve the natural character of the area and prevent
property damage of the type generally attributed to run-off rate and velocity increases,
diversions, concentration and/or unplanned ponding of storm run-off.
c. Weld County is not responsible for the maintenance of onsite drainage related features.

Environmental Health Services has reviewed this proposal for lawn and landscape
business. There is an existing shop and office building on the property where the
business will be conducted. There will be up to 10 employees accessing the site to pick
up and drop off equipment. According to the application, the employees will only be on
site for approximately an hour to prepare for off-site job duties. Site access will be
restricted to the owner and employees; no customers accessing the site.
There is an existing residence on the property that is served by Little Thompson Water
District (Tap #4499).The applicant provided a letter from the District dated May 3, 2012,
stating that they can serve the proposed business. The existing residence is served by
an individual sewage disposal system (Permit No. SP-9600037). The septic system was
permitted for 2 bedrooms or 4 people. In the event the existing septic system at the
home is utilized for employee use, then the septic system will require evaluation by a
Colorado Registered Professional Engineer to determine if it is adequate for the
proposed hydraulic load.
It is the policy of this department that portable toilets are allowed when employees are
on site for less than 2 consecutive hours a day. As personnel will be on site for a short
duration, in accordance with Environmental Health Services policy the use of portable
toilets will be allowed. (Environmental Health Policy 2.2.K attached).
The applicant submitted a dust abatement plan which states that the access drive and
internal roadways will be covered in gravel. The applicant will need to submit a revised
dust abatement plan to include measures to mitigate dust from vehicle traffic and the
handling of waste in the onsite lawn debris storage area.
The waste handling plan states that a dumpster will be provided for refuse and will be
serviced by Royal Disposal. Organic materials and lawn debris will be temporarily
stored in a bermed containment area located in the southeast portion of the property.
The yard waste materials will be hauled to a recycling center during regular intervals.
The applicant will need to revise the waste handling plan to include the removal
frequency of the yard waste to ensure that it is not accumulating on the property. Also,
the waste plan shall include the name, address and phone number of the recycling
center where yard waste will be disposed.
According to the application, the existing shop will be used for maintenance and repairs
of vehicles and equipment. Information shall be provided regarding chemicals
(fertilizers, herbicides), tires, batteries and fluids (gas, oil, ect.) storage and disposal. If
a floor drain is installed in the shop building, it must discharge to a watertight vault and
contents removed for proper offsite disposal. The waste plan shall include the name,
address and phone number of the waste haulers and disposal facilities for any wastes
generated from vehicle and equipment maintenance, and chemical or fluid spills.
We have no objections to the proposal; however, we do recommend that the following
conditions be part of any approval:
We recommend that the following requirements be met prior to allowing the plat to be
recorded:
1 . The applicant shall submit a revised dust abatement plan to include measures to
mitigate on site dust, to the Environmental Health Services, Weld County
Department of Public Health & Environment.
2. In the event washing of vehicles and equipment will occur on site the applicant
shall ensure that any vehicle and equipment washing area(s) shall capture all
effluent and prevent discharges from the washing of vehicles and equipment in
accordance with the Rules and Regulations of the Water Quality Control
Commission, and the Environmental Protection Agency. Vehicle washing areas
should be designated on the plat.
3. In the event the applicant intends to utilize the existing septic system at the
home, for employee use, the septic system shall be reviewed by a Colorado
Registered Professional Engineer. The review shall consist of observation of the
system and a technical review describing the systems ability to handle the
proposed hydraulic load. The review shall be submitted to the Environmental
Health Services Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately sized or
constructed the system shall be brought into compliance with current
Regulations.
4. A copy of the Commercial Applicators license, from the Colorado Department of
Agriculture, shall be provided to Environmental Health Services, Weld County
Department of Public Health & Environment.
5. The applicant shall submit documentation that floor drain wastes from any
vehicle maintenance facility is captured in a watertight vault and hauled off for
proper disposal.

6. The applicant shall submit a revised waste handling plan, for approval, to the
Environmental Health Services Division of the Weld County Department of Public
Health & Environment. The plan shall include at a minimum, the following:
1) A list of wastes which are expected to be generated on site (this should
include expected volumes and types of waste generated).
2) A list of the type and volume of chemicals expected to be stored on site.
3) The waste handler and facility where the waste will be disposed (including
the facility name, address, and phone number).
We recommend that the following requirements be incorporated into the permit as
development standards:
1 . All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed
for final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a
solid waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5,
C.R.S., as amended.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and other
potential nuisance conditions.
4. The applicant shall operate in accordance with the approved "waste handling
plan", at all times.
5. Any vehicle and equipment washing area(s) shall capture all effluent and
prevent discharges from washing of vehicles and equipment in accordance with
the Rules and Regulations of the Water Quality Control Commission, and the
Environmental Protection Agency.
6. Fugitive dust and fugitive particulate emissions shall be controlled on this site.
The facility shall be operated in accordance with the approved "dust abatement
plan", at all times.
7. This facility shall adhere to the maximum permissible noise levels allowed in
the Residential Zone as delineated in Section 14-9-30 of the Weld County

Code.
8. Adequate drinking, hand washing and toilet facilities shall be provided for
employees of the facility, at all times. Portable toilets and Bottled water are
allowed in accordance with Environmental Health Policy 2.2.K. as attached.
9. Any septic system located on the property must comply with all provisions of
the Weld County Code, pertaining to Individual Sewage Disposal Systems.
10. In the event the applicant intends to utilize the existing septic system at the

proposed hydraulic load. The review shall be submitted to the Environmental

11.The facility shall utilize the existing public water supply (Little Thompson Water
District).
12.All pesticides, fertilizer, and other potentially hazardous chemicals must be
handled in a safe manner in accordance with product labeling and in a manner
that minimizes the release of hazardous air pollutants (HAP's) and volatile
organic compounds (VOC's). All chemicals must be stored secure, on an
impervious surface, and in accordance with manufacturer's recommendations.
13.The applicant shall comply with all provision of the Pesticide Applicators' Act
issued by the Colorado Department of Agriculture, Division of Plant Industry.
14. Process wastewater (such as floor drain wastes) shall be captured in a
watertight vault and hauled off for proper disposal. Records of installation,
maintenance, and proper disposal shall be retained.
15.The operation shall comply with all applicable rules and regulations of State
and Federal agencies and the Weld County Code.

Environmental Health Policy 2.2.K
Use of portable toilets and bottled water (revised 5/8/12)
Purpose: To define when portable toilets and commercially bottled water are
allowed.
Policy: Bottled water from a commercial source is allowed in the following
circumstances:
1 . Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day

Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.

Upon review of my case files and computer, an active Violation (ZCV12-00093) was noted. This
complaint was initiated due to the operation of a Landscape operation without first obtaining the necessary
Weld County Zoning Permits. This case has not yet proceeded to our County Court phase. Since this
case has not progressed to the Violation status, no investigation fee is required.
This complaint was from a private citizen.
This application if approved by the Board of County Commissioners and once a plat is recorded will
correct the violation. If this application is denied,the commercial operation and all associated operations
or equipment shall be removed from the property within 30 (thirty) days. Additionally, if denied by the
Board of County Commissioners please request this violation case be referred to the County Attorney's
Office with a delay of legal action for the 30 (thirty) days mentioned above.

will require permits in order to be used as part of the business. If these buildings comply with the ag-exempt
portion of the code,a certificate of compliance,COC, permit will need to be applied for.
Any owner or authorized agent who intends to construct,enlarge,alter, repair, move,demolish,or change
the occupancy of a building or structure,or to erect,install,enlarge,alter, repair,remove,convert or replace
any electrical,gas, mechanical or plumbing system,or to cause any such work to be done,shall first make
application to the building official and Weld County to obtain the required permit.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11, 2011
memorandums to county planning directors, this office will only perform a cursory review of the referral
information and provide informal comments. The comments do not address the adequacy of the water
supply plan for this project or the ability of the water supply plan to satisfy any County regulations or
requirements. In addition, the comments provided herein cannot be used to guarantee a viable water
supply plan or infrastructure, the issuance of a well permit, or physical availability of water.
According to the submitted information, this is an application for use by special review to
operate a landscaping business on the subject 1.6-acre parcel. This property currently receives water
from the Little Thompson Water District (District). The District provided a commitment letter to continue
